The case possibly moving to \u2063the Supreme Court signals \u200bongoing contentious debates regarding gun control and\u200d Second Amendment rights in the\u200b U.U.S.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/%20\"><span>Samuel Short<\/span><\/a> <\/span> <span>   June 17, 2024 at 6:47am <\/span> <\/span>  <\/header>\n<section>\n<p>President Joe Biden\u2019s war on the Second Amendment just suffered a major setback.<\/p>\n<p>On Thursday, Judge Reed O\u2019Connor for the U.S. District Court for the Northern District of<a href=\"https:\/\/www.westernjournal.com\/mexico-hot-tub-leaves-texas-man-dead-wife-life-threatening-injuries-horrible-accident\/\" target=\"_blank\" rel=\"noopener\"> Texas<\/a> Fort Worth Division wrote a 12-page decision in which he vacated a rule by the Bureau of Alcohol Tobacco, Firearms, and Explosives to regulate pistol braces.<\/p>\n<p><a href=\"https:\/\/americanmilitarynews.com\/2024\/06\/federal-judge-throws-out-atf-firearm-stabilizing-brace-rule\/\" target=\"_blank\" rel=\"noopener\">American Military News reports<\/a> Attorney General Merrick Garland approved the ATF\u2019s \u201cFactoring Criteria for Firearms with Attached \u2018Stabilizing Braces\u2019\u201d in January 2023. The rule would have imposed a scoring system to determine if a pistol brace makes a pistol a short-barreled rifle.<\/p>\n<p>In the event that a pistol is classified as such, it would be subject to more strict regulations under the <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/national-firearms-act\" target=\"_blank\" rel=\"noopener\">National Firearms Act<\/a>.<\/p>\n<p>An NFA-regulated firearm requires a waiting period, registration of ownership with the federal government, and a $200 payment. Anyone who does not comply would face a $10,000 fine and up to 10 years in <a href=\"https:\/\/www.westernjournal.com\/crime-ridden-california-progressive-dems-push-newsom-defund-prison-system-1-billion\/\" target=\"_blank\" rel=\"noopener\">prison<\/a>.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/washington-secrets\/3043608\/bidens-atf-loses-big-in-pistol-brace-case\/\" target=\"_blank\" rel=\"noopener\">The Washington Examiner reported<\/a> Garland-approved rule was a total reversal from the ATF\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/it-isnt-based-in-science-desantiss-office-blasts-cdc-over-k-12-in-school-mask-guidelines\/\" title=\"\u2018It Isn\u2019t Based In Science\u2019: DeSantis\u2019s Office Blasts CDC Over K-12 In-School Mask Guidelines\">long-held position<\/a> on pistol braces, something O\u2019Connor made note of in his ruling.<\/p>\n<p>The <a href=\"https:\/\/www.firearmspolicy.org\/\" target=\"_blank\" rel=\"noopener\">Firearms Policy Coalition<\/a>, a gun rights group based in Sacramento, California, pushed the case \u2013 \u201cMock v. Garland\u201d \u2013 and<a href=\"https:\/\/www.westernjournal.com\/hilarious-trump-cranking-couple-mean-tweets-verdict-soon-come-stay-tuned\/\" target=\"_blank\" rel=\"noopener\"> tweeted<\/a> enthusiastically about the ruling along with 2 pages from it.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8 FPC GRASSROOTS ARMY WIN \ud83d\udea8<\/p>\n<p>In our Mock v. Garland ATF Pistol Brace Rule Lawsuit, the District Court has issued its decision and VACATED THE RULE! <a href=\"https:\/\/t.co\/OOsFcPZilk\">pic.twitter.com\/OOsFcPZilk<\/a><\/p>\n<p>\u2014 Firearms Policy Coalition (@gunpolicy) <a href=\"https:\/\/twitter.com\/gunpolicy\/status\/1801253523260162556?\">June 13, 2024<\/a><\/p>\n<\/blockquote>\n<div id=\"firefly-poll-container\">\n<p>Do you support the 2nd Amendment?<\/p>\n<\/p><\/div>\n<p>O\u2019Connor\u2019s ruling described the ATF actions as, \u201carbitrary and capricious.\u201d The 12-page ruling can be read <a href=\"https:\/\/johnpierceesq.com\/wp-content\/uploads\/2024\/06\/Mock_v_Garland_Summary_Judgment_06-13-24.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>The Examiner highlighted one particularly telling passage in which O\u2019Connor explained his decision based on the ATF\u2019s actions in trying to implement this new rule.<\/p>\n<p>\u201cThe court finds that the adaptation of the final rule was arbitrary and capricious for two reasons. First, the defendants did not provide a detailed justification for their reversal of the agency\u2019s longstanding position. And second, the final rule\u2019s standards are impermissibly vague.\u201d<\/p>\n<p>While the Examiner also said, per the parties involved, that the case is probably going to the <a href=\"https:\/\/www.westernjournal.com\/lefts-latest-sting-supreme-court-justice-alito-backfires-proves-right\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a>, this is blow to the Biden administration\u2019s war on guns.<\/p>\n<p>The left\u2019s favorite phrase when they speak of disarming the American people is \u201cassault weapon.\u201d We are asked why we need them while being communicated the <a href=\"https:\/\/www.westernjournal.com\/come-high-water-biden-puts-tyranny-full-display-vow-assault-weapons-ban\/\" target=\"_blank\" rel=\"noopener\">futility of owning them<\/a> in response to an occasion of dealing with a tyrannical government.<\/p>\n<p>Never mind the fact that the country was built by a group of men who were outmanned and outgunned by the mighty British Empire, the left can\u2019t even define <a href=\"https:\/\/www.westernjournal.com\/assault-weapons-ban-take-effect-just-weeks-supreme-court-declines-block\/\" target=\"_blank\" rel=\"noopener\">\u201cassault weapon\u201d<\/a> because it isn\u2019t an actual classification.<\/p>\n<p>Attempting to redefine pistols with braces as short-barreled rifles is yet another episode of the left asking, \u201cWhy do you need them?\u201d as more firearms are subject to more regulations, making them harder for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">law-abiding citizens<\/a> to obtain.<\/p>\n<p>Anti-gun rhetoric never lands with those who are competent in using them and well-read in history.<\/p>\n<p>While independence was declared in 1776, this great nation was arguably born on the <a href=\"https:\/\/www.history.com\/topics\/american-revolution\/battles-of-lexington-and-concord\" target=\"_blank\" rel=\"noopener\">Lexington, Massachusetts, town green<\/a> the morning of April 19, 1775, when the British attempted to do just what the Biden administration wants to achieve \u2013 disarming a free people.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
