This decision comes at the\u2062 conclusion of a three-year legal dispute spearheaded by attorneys Bevis Schock and Mark Milton, \u200bwho did not\u2062 charge\u2062 fees for their\u2063 service. They represented six plaintiffs who had been denied refunds by\u2063 the Collector\u2064 of Revenue, Gregory Daly. A court\u200c of appeals supported a previous trial court \u2062ruling that \u200dnon-resident employees working remotely are not subject to the\u2064 city&#8217;s 1% earnings tax. This\u200b ruling forced a change \u200din\u2063 the\u200b tax interpretation that the city and Daly initially believed was justified. Daly expressed\u2062 his respect for the judicial outcomes, affirming his delayed compliance with the court ruling due to his statutory obligations.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2013 Taxpayers who worked remotely during the pandemic and paid earnings taxes to the City of St. Louis are eligible for a refund, according to a settlement.<\/p>\n<p>Attorneys Bevis Schock and Mark Milton announced the settlement on Friday, ending a three<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/free-speech-organization-sues-university-of-central-florida-for-discriminatory-speech-policies\/\" title=\"Free Speech Organization Sues University of Central Florida For \u2018Discriminatory\u2019 Speech Policies\">-year legal battle<\/a>. They represented six plaintiffs who worked remotely during the pandemic, applied for refunds but were denied by Collector of Revenue Gregory Daly. The attorneys collected no fees for the case.<\/p>\n<p>\u201cThe city and the collector have decided now to do the right thing,\u201d Schock said during a press conference.<\/p>\n<p>An <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-upholds-ohio-law-banning-down-syndrome-abortions\/\" title=\"Appeals Court Upholds Ohio Law Banning Down Syndrome Abortions\">appeals court upheld<\/a> a trial court ruling stating the city can\u2019t charge the 1% earnings tax on non-city residents whose work is performed outside the city.<\/p>\n<p>\u201cMy office, along with the city, chose to fight this lawsuit because we believed our actions were consistent with the terms of the statute and the right thing to do on behalf of the people of the City of St. Louis,\u201d Daly said in a statement. \u201cWhile the Courts affirmed the majority of the collector\u2019s and city\u2019s positions, it determined that remote work for non-city residents would not be subjected to earnings and payroll taxes in the manner in which the city and the collector interpreted the statute.\u201d<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/daily-mail-releases-new-evidence-of-hunter-bidens-depravity\/\" title=\"Daily Mail releases new evidence of Hunter Biden\u2019s depravity\">media release<\/a> from Daly\u2019s office said he had a \u201cstatutory duty to collect the tax unless and until a Court told him he did not. While the city and the collector could have sought further review of the Court\u2019s decision, the collector determined he had sufficient guidance from the Courts, and it was time to move forward.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/vaccine-mandates-for-navy-seals-remain-blocked-by-u-s-court-of-appeals\/\" title=\"Vaccine Mandates for Navy Seals Remain Blocked by U.S. Court of Appeals\">appeals court denied<\/a> a request for class action for all taxpayers.<\/p>\n<p>\u201cThe city has essentially given us <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sesame-place-hit-with-25-million-racial-discrimination-lawsuit-after-alleged-snub-from-costumed-character-goes-viral\/\" title=\"Sesame Place Hit With  Million Racial Discrimination Lawsuit After Alleged Snub From Costumed Character Goes Viral\">class action status<\/a>,\u201d Schock said. \u201cThey have waived the statute of limitations.\u201d<\/p>\n<p>The settlement states taxpayers eligible for a refund for remote work in 2020, 2021 and 2022 must file a claim during a 90-day period starting July 1 and ending Sept. 30. The city and the collector also will accept request for refunds already filed.<\/p>\n<p>The attorneys said the city and the collector estimated approximately $25 million in refunds are at stake per year. City officials told multiple media outlets the cost of the refunds will be tens of millions of dollars.<\/p>\n<p>Milton said the tax for remote workers often put employers against employees when it came to withholding taxes from payroll checks. Both attorneys said the city\u2019s legal team was ethical and professional.<\/p>\n<p>\u201cThey were all fair minded, followed the rules of court and we obliterated them,\u201d Schock said.<\/p>\n<p>The attorney\u2019s offer to hold a joint press conference announcing the settlement was turned down and Daly and Mayor Tishaura Jones scheduled a press conference on the subject on Monday.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>\u201cI think this is good for taxpayers,\u201d Milton said. \u201cIt\u2019s good for the rule of law and ultimately it\u2019s good for the City of St. Louis.\u201d<\/p>\n<p>The legislature held special committee hearings and legislation was filed to stop cities from collecting earnings taxes. Kansas City also collects a 1% earnings tax.
