The case, brought forward by religious leaders supportive of abortion\u200c rights, argued that\u2064 Missouri&#8217;s abortion \u2063law was \u2064unconstitutional. \u2063Judge Jason\u2063 Sengheiser noted that while\u200d the law&#8217;s preamble \u200dreferences a &#8220;Supreme Ruler of \u2064the Universe,&#8221; similar \u200clanguage is\u200b also present in the Missouri Constitution and \u2062does not explicitly enforce religious practice or beliefs. \u200bHe clarified that the \u200dassertion \u200bthat life begins \u2063at conception is not inherently a religious belief and\u2064 does not inhibit\u2062 freedom of worship. The case \u2062dismissal has prompted advocacy groups like Americans\u2062 United \u200dfor Separation \u200dof Church &#038; State and the National Women\u2019s Law to consider further legal action, asserting that\u200d the law intrudes \u200bon both religious and reproductive\u200b freedoms.\u2062 Meanwhile, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mississippi-supreme-court-strikes-down-voter-approved-medical-marijuana-initiative\/\" title=\"Mississippi Supreme Court Strikes Down Voter-Approved Medical Marijuana Initiative\">state attorneys defend<\/a> the law, suggesting \u2064it does not \u200dforce religious beliefs on others.\u2064 Following the 2022 Supreme \u2062Court\u2064 ruling that overturned Roe v. \u2062Wade, Missouri \u2064was quick to enforce an existing 2019 law that severely restricts\u2063 abortions, permitting them only in medical emergencies.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/ap-reports\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/ap-reports\/%20\"><span>The Associated Press<\/span><\/a> <\/span> <span>   June 15, 2024 at 1:19pm <\/span> <\/span>  <\/header>\n<section>\n<p>A <a href=\"https:\/\/www.westernjournal.com\/federal-judge-blocks-bidens-transgender-title-ix-changes-slams-admin-abuse-power\/\" target=\"_blank\" rel=\"noopener\">judge<\/a> in Missouri says lawmakers who passed a restrictive <a href=\"https:\/\/www.westernjournal.com\/breaking-scotus-rules-americabreaking-scotus-rules-americans-access-abortion-pillns-access-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">abortion<\/a> ban weren\u2019t trying to impose their religious beliefs on everyone in the state, rejecting a case filed by more than a dozen Christian, Jewish and Unitarian Universalist leaders who <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-choice-jenner-supports-texas-right-to-choose-to-ban-abortions\/\" title=\"Pro-Choice Jenner Supports Texas\u2019 Right To Choose To Ban Abortions\">support abortion rights<\/a>.<\/p>\n<p>The groups sought a permanent injunction last year barring Missouri from enforcing its <a href=\"https:\/\/www.westernjournal.com\/texas-abortion-law-saved-babys-life-mom-glad-didnt-abort\/\" target=\"_blank\" rel=\"noopener\">abortion law<\/a> and a declaration that provisions violate the state Constitution.<\/p>\n<p>One section of the statute at issue reads: \u201cIn recognition that Almighty God is the author of life, that all men and women are \u2018endowed by their Creator with certain unalienable Rights,\u2019 that among those are Life.\u2019\u201d<\/p>\n<p>Judge Jason Sengheiser in his ruling Friday said there is similar language in the preamble to the Missouri Constitution, which expresses \u201cprofound reverence for the Supreme Ruler of the Universe.\u201d The rest of the challenged provisions contain no explicit religious language, he said.<\/p>\n<p>\u201cWhile the determination that life begins at conception may run counter to some religious beliefs, it is not itself necessarily a religious belief,\u201d Sengheiser wrote. \u201cAs such, it does not prevent all men and women from worshipping Almighty God or not worshipping according to the dictates of their own consciences.\u201d<\/p>\n<p>The Americans United for Separation of Church &#038; State and the National Women\u2019s Law Center, who sued on behalf of the religious leaders, responded in a joint statement that they were considering their legal options.<\/p>\n<p>\u201cMissouri\u2019s abortion ban is a direct attack on the separation of church and state, religious freedom and reproductive freedom,\u201d the statement said.<\/p>\n<p>Attorneys for the state have countered that just because some supporters of the law oppose abortion on religious grounds doesn\u2019t mean that the law forces their beliefs on anyone else.<\/p>\n<p>Sengheiser added that the state has historically sought to restrict and criminalize abortion, citing statutes that are more than a century old.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Is it possible to want to kill babies, remove God from public life, and still be a Christian?<\/p>\n<\/p><\/div>\n<p>\u201cEssentially, the only thing that changed is that Roe was reversed, opening the door to this further regulation,\u201d he said.<\/p>\n<p>Within minutes of the 2022 Supreme Court decision, then-Attorney General Eric Schmitt and Gov. Mike Parson, both Republicans, filed paperwork to immediately enact a 2019 law prohibiting abortions \u201cexcept in cases of medical emergency.\u201d That law contained a provision making it effective only if <a href=\"https:\/\/www.westernjournal.com\/superman-actor-gives-biden-reality-check-pledge-restore-roe-v-wade\/\" target=\"_blank\" rel=\"noopener\">Roe v. Wade<\/a> was overturned.<\/p>\n<p>The law makes it a felony punishable by five to 15 years in prison to perform or induce an abortion. Medical professionals who do so also could lose their licenses.<\/p>\n<p>The law says that women who undergo abortions cannot be prosecuted.<\/p>\n<p>Missouri already had some of the nation\u2019s more <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/celebrities-outraged-pro-life-legislation-stands-in-texas-we-will-boycott-you\/\" title=\"Celebrities Outraged Pro-Life Legislation Stands In Texas: \u2018We Will Boycott You\u2019\">restrictive abortion laws<\/a> and had seen a significant decline in the number of abortions performed, with residents instead traveling to clinics just across the state line in Illinois and Kansas.<\/p>\n<p>The Western Journal has not reviewed this Associated Press story prior to publication.
