The decision aligns with similar rulings in other states and has <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blm-riots-dragged-democrats-down-in-2020-data-shows-but-peaceful-protests-helped-them\/\" title=\"BLM Riots Dragged Democrats Down In 2020, Data Shows \u2014 But Peaceful Protests Helped Them\">sparked intense debate<\/a> about gender identity and privacy rights in \u200beducational settings.\u200c The disputed rules would\u200c have allowed transgender students to use bathrooms and facilities corresponding to\u200c their gender \u200cidentity and mandated the\u200b use of preferred pronouns, which opponents \u2062argue compromises the safety and privacy of cisgender students. \u200cThis legal battle reflects broader national controversies surrounding gender identity and educational policies.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   June 14, 2024 at 3:36pm <\/span> <\/span>  <\/header>\n<section>\n<p>The Biden administration\u2019s revision of Title IX rules to favor transgender students suffered a major defeat Thursday after a federal judge in Louisiana allowed four states to block the rules.<\/p>\n<p>In a <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/akveoawjmvr\/06132024titleix.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> that impacts Louisiana, Mississippi, Montana and Idaho, U.S. District Court Judge Terry Doughty demolished the rule issued by the Department of Education that decided that Title IX \u2014 the landmark 1972 law banning sex discrimination \u2013 should be used to force schools to give in to the demands of transgender students.<\/p>\n<p>\u201cThis case demonstrates the abuse of power by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dont-say-inmate-biden-admin-using-taxpayer-dollars-to-push-woke-language-guides\/\" title=\"Don't Say 'Inmate': Biden Admin Using Taxpayer Dollars To Push Woke Language Guides\">executive federal agencies<\/a> in the rulemaking process. The separation of powers and system of checks and balances exist in this country for a reason,\u201d Doughty wrote, noting that the Biden administration went beyond its authority in imposing a rule that would have drastic fiscal impacts on every school in the nation and affirming that Title IX \u201cwas written and intended to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/women-plead-with-ivy-leaguers-to-reject-transgenderism\/\" title=\"Women Plead with Ivy Leaguers to Reject Transgenderism\">protect biological women<\/a> from discrimination.\u201d<\/p>\n<p>Doughty was appointed by former President <a href=\"https:\/\/www.westernjournal.com\/trump-floats-plan-eliminate-income-tax\/\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a>, according to <a href=\"https:\/\/www.usatoday.com\/story\/news\/education\/2024\/06\/14\/title-ix-biden-lgbtq-block\/74097580007\/\" target=\"_blank\" rel=\"noopener\">USA Today<\/a>.<\/p>\n<p>The Education Department rules said Title IX, enacted to protect female students from discrimination or harassment, must be used to protect students based on gender identity as well, according to <a href=\"https:\/\/www.nytimes.com\/2024\/06\/14\/us\/politics\/biden-title-ix-transgender-students-schools.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>.<\/p>\n<p>The rule would allow students to use bathrooms and locker rooms that align with their gender identity. Schools that fail to do so, or fail to use a transgender student\u2019s preferred pronoun, could be creating a hostile environment that could be investigated by the Education Department.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8\ud83d\udea8\ud83d\udea8 BREAKING: Another Federal Judge AXES Biden Title IX!!!: U.S. District Judge Terry A. He wrote that the Biden administration rule \u201cwould subvert the original purpose of Title IX.\u201d<\/p>\n<div id=\"firefly-poll-container\">\n<p>Did the judge get this one right?<\/p>\n<\/p><\/div>\n<p>\u201cTitle IX was enacted for the protection of the discrimination of <a href=\"https:\/\/www.westernjournal.com\/biological-man-enters-skateboarding-contest-transgender-look-pre-teen-girl-competitors\/\" target=\"_blank\" rel=\"noopener\">biological<\/a> females. However, the Final Rule may likely cause biological females more discrimination than they had before Title IX was enacted,\u201d Doughty wrote. \u201cImportantly, Defendants did not consider the effect the Final Rule would have on biological females by requiring them to share their bathrooms and locker rooms with biological males.<\/p>\n<p>\u201cThe Final Rule only focuses on the \u2018effect on the student who changes their gender identity\u2019 and fails to address the effect on the other students (\u2018cisgender students\u2019). These cisgender females must use the bathroom, undress, and shower in the presence of persons who may identify as females but still have male biological parts.\u201d<\/p>\n<p>Doughty wrote that the department \u201cdeclared in the Final Rule, with no explanation, that transgender students do not pose a safety risk for cisgender students.\u201d<\/p>\n<p>But, Doughty wrote, \u201cBy allowing biological men who identify as a female into locker rooms, showers, and bathrooms, biological females risk invasion of privacy, embarrassment, and sexual assault.<\/p>\n<p>\u201cAllowing a biological male student to change to a female by simply declaring it, requiring no documentation of the change, and allowing the student to shower with cisgender females in the girls\u2019 <a href=\"https:\/\/www.westernjournal.com\/watch-mom-makes-epic-points-ripping-school-board-males-allowed-females-locker-room\/\" target=\"_blank\" rel=\"noopener\">locker room<\/a> goes beyond the scope of arbitrary and capricious.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8\ud83d\udd25\u2764\ufe0f.
