Cargill case, \u200bconcerning\u200c the legality of bump stocks\u2014attachments that \u200dallow <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/what-if-it-saves-one-life-why-doesnt-the-lefts-logic-apply-to-illegal-immigration\/\" title=\"\u2018What If It Saves One Life?\u2019 Why Doesn\u2019t The Left\u2019s Logic Apply To Illegal Immigration?\">semi-automatic weapons<\/a> to fire more rapidly.\u200b The\u200c Supreme \u2064Court \u200doverturned a Trump-era\u200d ban on the sale of bump stocks \u2062by a 6-3 decision,\u200d concluding that bump stocks do not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-rules-bump-stock-ban-unlawful\/\" title=\"Supreme Court Strikes Down Bump Stock Ban\">convert semi-automatic rifles<\/a> into &#8220;machineguns,&#8221; which are \u200dillegal\u2063 for civilian ownership. The majority opinion, \u200cauthored by\u2063 Justice\u200d Clarence Thomas, emphasized that \u2063these attachments do not alter the fundamental function of the trigger on semi-automatic firearms. The\u200d ruling rebuked \u2062substantial \u200cATF backtracking on their longstanding interpretation under\u2064 political pressures following the 2017 Las Vegas shooting. Cargill case.<\/p>\n<p>That <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-976_e29g.pdf\" target=\"_blank\" rel=\"noopener\">case<\/a>, which saw U.S. Attorney General <a href=\"https:\/\/www.westernjournal.com\/attorney-general-merrick-garland-lambasted-threatening-americans-criticism-biden-doj-must-stop\/\" target=\"_blank\" rel=\"noopener\">Merrick Garland<\/a> going against Texas gun shop owner Michael Cargill, centers on the legality of bump stock gun attachments.<\/p>\n<p>(Bump stocks replace the stock \u2014 the part that rests against the shoulder \u2014 of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/calls-mount-for-evangelical-publication-to-retract-article-likening-kyle-rittenhouse-to-mass-shooter\/\" title=\"Calls Mount For Evangelical Publication To Retract Article Likening Kyle Rittenhouse To \u2018Mass Shooter\u2019\">semi-automatic weapon<\/a>. Bump stocks harness recoil energy and allow the user to fire bullets more rapidly than with a standard stock.)<\/p>\n<p>A ruling stemming from former President Donald Trump\u2019s administration banned the sale of bump stocks in 2017.<\/p>\n<p>Cargill had to give up his Texas store\u2019s bump stocks to the <a href=\"https:\/\/www.westernjournal.com\/multistate-coalition-rises-biden-atfs-attempt-halt-firearm-sales-americans\/\" target=\"_blank\" rel=\"noopener\">Bureau of Alcohol, Tobacco, Firearms and Explosives<\/a> before ultimately filing the suit.<\/p>\n<p>At the heart of the matter is the issue of whether or not bump stocks can turn semi-automatic weaponry into \u201cmachineguns,\u201d which are illegal for civilians to own.<\/p>\n<p>The Supreme Court, by a 6-3 decision along ideological lines, ruled that bump stocks do not turn semi-automatic weapons into \u201cmachineguns,\u201d thus overturning the Trump-era ruling.<\/p>\n<p>\u201cCongress has long restricted access to \u2018machinegun[s],\u2019 a category of firearms defined by the ability to \u201cshoot, automatically more than one shot\u2026 by a single function of the trigger,\u201d Supreme Court Justice <a href=\"https:\/\/www.westernjournal.com\/clarence-thomas-already-issued-perfect-response-media-members-want-quit-supreme-court\/\" target=\"_blank\" rel=\"noopener\">Clarence Thomas<\/a> wrote in the majority opinion. \u201cSemiautomatic firearms, which require shooters to reengage the trigger for every shot, are not machineguns. This case asks whether a bump stock\u2014an accessory for a semiautomatic rifle that allows the shooter to rapidly reengage the trigger (and therefore achieve a high rate of fire)\u2014converts the rifle into a \u2018machinegun.\u2019<\/p>\n<p>\u201cWe hold that it does not and therefore affirm.\u201d<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you agree with the ruling in this case?<\/p>\n<\/p><\/div>\n<p>Thomas would further explain:\u00a0 \u201cThe question in this case is whether a bump stock transforms a semiautomatic rifle into a \u2018machinegun.\u2019<\/p>\n<p>\u201cFor many years, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) took the position that semiautomatic rifles equipped with bump stocks were not machineguns under the statute.<\/p>\n<p>\u201cOn more than 10 separate occasions over several administrations, ATF consistently concluded that rifles equipped with bump stocks cannot<br \/> \u2018automatically\u2019 fire more than one shot \u2018by a single function of the trigger.&#8217;\u201d<\/p>\n<p>The majority opinion further argued that it was beyond the ATF\u2019s scope to abruptly change that definition following the horrific 2017 mass shooting at a <a href=\"https:\/\/www.westernjournal.com\/new-clues-las-vegas-shooter-revealed-fbi-releases-docs-years-massacre\/\" target=\"_blank\" rel=\"noopener\">Las Vegas<\/a> concert, despite the great political pressure that was put on them by public discourse and politicians alike.<\/p>\n<p>The majority opinion ultimately argued: \u201cA semiautomatic rifle equipped with a bump stock does not fire more than one shot \u2018by a single function of the trigger.\u2019<\/p>\n<p>\u201cWith or without a bump stock, a shooter must release and reset the trigger between every shot. And, any subsequent shot fired after the trigger has been released and reset is the result of a separate and distinct \u2018function of the trigger.\u2019<\/p>\n<p>\u201cAll that a bump stock does is accelerate the rate of fire by causing these distinct \u201cfunction[s]\u201d of the trigger to occur in rapid succession.\u201d<\/p>\n<p>Associate Justice Sonia Sotomayor wrote the dissenting opinion, where she lamented the decision.
