This decision was communicated in a letter from Assistant Attorney General Carlos Uriarte to House Speaker Mike Johnson, stating that Garland\u2019s actions did not constitute a crime. This stance aligns with the DOJ&#8217;s previous expressions that the House\u2019s contempt vote lacked legal basis and contrasted \u2064with longstanding precedents. This controversy arose after Garland repeatedly declined to release\u2062 the transcript \u200cof an interview between former \u200bspecial\u200d counsel Robert\u2063 Hur and President Joe Biden, which was part of an investigation \u2063into Biden&#8217;s mishandling of classified documents during his time\u200b as Vice President and Senator. Forensic Report BOMBSHELL Reveals Dominion Machines Were Set At 68.05% Error Rate\u2026Meaning 68.05% Of Ballots Could Be Sent Out For Mass Adjudication, Giving Individuals Or Machines Ability To Change 68.05% Of Votes\">assistant <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">attorney general<\/a><\/a>, wrote in a <a href=\"https:\/\/www.scribd.com\/document\/742293215\/Uriarte-to-Johnson?secret_password=9IWhfE89MXopFh9CKvBe\" target=\"_blank\" rel=\"noopener\" title>letter<\/a> to House Speaker Mike Johnson (R-LA) that Garland\u2019s actions \u201cdid not constitute a crime.\u201d<\/p>\n<p>The DOJ\u2019s notice came as expected after it <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3039998\/garland-blasts-republicans-contempt\/\" target=\"_blank\" rel=\"noopener\" title>said<\/a> its stance was that the House\u2019s contempt vote was not grounded in law and defied roughly seven decades of precedent.<\/p>\n<p>The House\u2019s vote was nearly entirely on party lines and came after the attorney general repeatedly refused to provide the transcript of an interview former special counsel Robert Hur conducted with President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a> last year. All Democrats and one Republican voted against the measure.<\/p>\n<p>The interview was part of Hur\u2019s investigation into Biden\u2019s handling of classified documents. Hur found at the conclusion of his inquiry that Biden mishandled classified material during his time as vice president and senator and that the president inappropriately shared classified information with his ghostwriter.<\/p>\n<p>However, Hur declined to prosecute Biden, in part because he said the president displayed memory problems. The president came off as a \u201csympathetic, well-meaning, elderly man with a poor memory\u201d who could give a jury pause as to whether he acted intentionally, Hur wrote.<\/p>\n<p>House lawmakers leading an impeachment inquiry into Biden sought information from the DOJ related to Hur\u2019s investigation, including the transcript and audio of the interview. The DOJ was largely compliant and provided the transcript and other items, but it remained adamant that it would not provide the audio, prompting lawmakers to subpoena Garland for it.<\/p>\n<p>In the face of a contempt threat, Biden asserted executive privilege over the recordings at Garland\u2019s direction.<\/p>\n<p>The DOJ noted Friday that it has, on several occasions and across various administrations, declined to prosecute officials who defied subpoenas because of executive privilege.<\/p>\n<p>\u201cThe longstanding position of the Department is that we will not prosecute an official for contempt of Congress for declining to provide subpoenaed information subject to a presidential assertion of executive privilege,\u201d Uriarte wrote.<\/p>\n<p>Garland became the third attorney general in U.S. history to be held in contempt after Attorneys General Bill Barr and Eric Holder. According to their contempt report, they can also move to sue the DOJ as a way to enforce their subpoena of the recordings.<\/p>\n<p>The conservative groups Judicial Watch and the Heritage Foundation, along with a CNN-led media coalition, have all already filed their own lawsuits against the DOJ to obtain the audio separately from Congress.
