Judge Doughty criticized the changes as a misuse of power and a threat to democracy, emphasizing that Title IX was originally intended to prevent discrimination against biological women. Additionally, he ruled that the interpretation of sex discrimination to include gender identity, as recognized in employment law \u2063by the Supreme Court in Bostock v. Clayton County, \u200bdoes not apply to\u200d Title IX education regulations.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A federal judge in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/louisiana\/\" target=\"_blank\" rel=\"noopener\" title>Louisiana<\/a> has blocked the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Biden<\/a> administration\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/title-ix\/\" target=\"_blank\" rel=\"noopener\" title>Title IX<\/a> overhaul for four states, calling the rewrite a \u201cthreat to democracy\u201d and an \u201cabuse of power.\u201d<\/p>\n<p>U.S. District Court Judge Terry Doughty issued a preliminary injunction Thursday to the Biden administration\u2019s new Title IX rules, which changed the definition of sex to include \u201cgender identity,\u201d which many critics argue will result in the shuttering of sex-specific spaces such as restrooms in schools.<\/p>\n<p>\u201cThis case demonstrates the abuse of power by executive federal agencies in the rulemaking process,\u201d Doughty <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.205659\/gov.uscourts.lawd.205659.53.0.pdf\" target=\"_blank\" rel=\"noopener\" title>wrote<\/a>. \u201cThe separation of powers and system of checks and balances exist in this country for a reason.\u201d<\/p>\n<p>The judge said the phrase \u201cgender discrimination\u201d was limited to biological males and females when Title IX was enacted and that the expansive changes to the definition of sex sought by the Biden administration were inadmissible, writing the law \u201cwas written and intended to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/women-plead-with-ivy-leaguers-to-reject-transgenderism\/\" title=\"Women Plead with Ivy Leaguers to Reject Transgenderism\">protect biological women<\/a> from discrimination.\u201d<\/p>\n<p>He also determined that the U.S. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noopener\" title=\"Supreme Court\">Supreme Court<\/a> ruling in <em>Bostock v. Clayton County<\/em>, which expanded the definition of sex discrimination to include claims of transgender identity in Title VII employment law, does not apply to Title IX. The Biden administration has been relying on the reasoning in <em>Bostock<\/em> to expand definitions of sex across federal law, and there currently exists a split at the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-right-scotus-should-step-in-and-stop-any-further-interference-by-new-york-in-2024-election\/\" title=\"Trump is correct: SCOTUS should intervene to halt New York's interference in the 2024 election\">federal circuit court level<\/a> as to whether it can apply to Title IX.<\/p>\n<p>\u201cThis is a big win for women\u2019s rights. This decision will keep young women and girls protected from dangerous situations, just as Title IX has done for decades,\u201d Montana Attorney General Austin Knudsen, a Republican, said in a statement. \u201cIn issuing the rule, President Biden abandoned scientific reality, put women\u2019s rights at risk, and overstepped his authority.\u201d<\/p>\n<p>Montana joined Louisiana in its challenge to the new rule, along with Idaho and Mississippi. <\/p>\n<p>The lawsuit, which includes counsel from the Defense of Freedom Institute, was the first in the country to challenge the Title IX overhaul, but more than two dozen states have pending lawsuits challenging the rules.
