Justice Clarence Thomas, writing for\u2064 the majority, \u200cargued that the Bureau\u200c of Alcohol, Tobacco, Firearms\u2062 and Explosives (ATF) did \u2062not have the \u200dauthority to enact the\u2063 ban after the Las Vegas mass shooting in 2017. According to Thomas, a bump stock, which is an\u2062 attachment for semi-automatic rifles that allows for rapid trigger re-engagement, does not convert these firearms into\u2063 machine guns. Consequently, such devices do not fall under the existing legal definitions that would classify them as machine guns and thus \u200dsubject them to\u200d prohibition.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">The <a href=\"https:\/\/www.dailywire.com\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> struck down a federal ban on bump stocks enacted by the Trump administration on Friday. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The 6-3 ruling was split along ideological lines. Justice <a href=\"https:\/\/www.dailywire.com\/topic\/clarence-thomas\" target=\"_blank\" rel=\"noopener\">Clarence Thomas<\/a> wrote in the majority opinion that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) exceeded its statutory authority when it announced a ban on bump stocks following a 2017 mass shooting in Las Vegas. In the ruling, Thomas said that equipping rifles with bump stocks does not turn them into machine guns, meaning they cannot be prohibited under existing law.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThis case asks whether a bump stock \u2014 an accessory for a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bail-fund-praised-by-kamala-harris-has-twice-freed-the-same-rioter-he-was-just-charged-again\/\" title=\"Bail Fund Praised By Kamala Harris Has Twice Freed The Same Rioter. He Was Just Charged Again.\">semi-automatic rifle<\/a> that allows the shooter to rapidly reengage the trigger (and therefore achieve a high rate of fire) \u2014 converts the rifle into a \u2018machinegun,\u2019\u201d Thomas <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-976_e29g.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in his decision. \u201cWe conclude that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-strikes-down-ban-on-bump-stocks\/\" title=\"Supreme Court overturns bump stock ban\">semiautomatic rifle equipped<\/a> with a bump stock is not a \u2018machinegun\u2019 because it does not fire more than one shot \u2018by a single function of the trigger.\u2019\u201d<\/span><\/p>\n<p>A <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-agrees-to-take-up-challenge-to-trump-era-bump-stock-ban\" target=\"_blank\" rel=\"noopener\">bump stock<\/a> is a device that can be attached to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-to-congress-enact-major-restrictions-on-constitutionally-protected-second-amendment-rights\/\" title=\"Biden To Congress: Enact Major Restrictions On Constitutionally Protected Second Amendment Rights\">semi-automatic firearm<\/a>. It reduces the length of time between trigger pulls by harnessing the gun\u2019s energy from recoil.<\/p>\n<p><span style=\"font-weight: 400\">Thomas was joined in his decision by Justices John Roberts, Neil Gorsuch, Brett Kavanaugh, Amy Coney Barrett, and Samuel Alito, who wrote a concurring opinion. <\/span><span style=\"font-weight: 400\">In his concurrence, Alito said it would require new congressional legislation to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-panel-rejects-federal-bump-stock-ban\/\" title=\"Appeals Court Panel Rejects Federal Bump Stock Ban\">ban bump stocks<\/a>. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe horrible shooting spree in Las Vegas in 2017 did not change the statutory text or its meaning. That event demonstrated that a semiautomatic rifle with a bump stock can have the same lethal effect as a machinegun,\u201d Alito wrote. \u201cThere is a simple remedy for the disparate treatment of bump stocks and machineguns.
