This lawsuit follows unsuccessful legal \u2064challenges in seven other states where \u2063claims were made that such regulations violated constitutional rights \u2064and federal\u2064 law.<\/p>\n<p>The plaintiffs argue that \u2064the \u200bdistribution of pornography is protected under the First Amendment, asserting \u2062that\u2064 any imposing\u2062 law must be scrutinized closely \u200cto ensure\u200b it&#8217;s\u200b the least restrictive means to \u200bachieve a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/opinion-people-of-faith-must-educate-themselves-on-the-supreme-court\/\" title=\"Opinion: People Of Faith Must Educate Themselves On The Supreme Court\">compelling government interest<\/a>. However, the Fifth U.S. Circuit Court has previously upheld a similar \u200dlaw in Texas based on the 1968 Supreme Court decision in Ginsberg v. New York, which allows for different standards\u2063 for\u200c minors, \u2063suggesting that\u200d rational-basis\u200d review is sufficient.<\/p>\n<p>The Indiana law specifically targets websites where at least\u2063 one-third of the content\u200d is deemed\u200d harmful to minors, incorporating standards similar to the Miller Test to define \u200cwhat \u200dcontent is considered obscene and unprotected\u2064 by the\u2064 First Amendment. The law lists acceptable age verification methods, such as mobile credentials, third-party services, or reliance on transactional data such as credit card \u200cinformation.<\/p>\n<p>The lawsuit \u200balso touches upon \u200cthe alleged violation of Section\u2064 230 of the Communications Decency \u2063Act,\u200d arguing that the \u200bregulation improperly treats websites as responsible for third-party content. It also claims the regulation violates\u2062 the 14th and Fifth Amendments \u2064regarding equal protection and the imposition of costly\u2063 verification protocols.<\/p>\n<p>Some plaintiffs in the case, like Aylo\u200d (formerly Mindgeek), which owns Pornhub\u200c and has been implicated in sex trafficking \u200clawsuits, are accused\u200b of having a virtual\u200d monopoly\u2062 in the pornography sector. The group seeks to block a <a href=\"https:\/\/iga.in.gov\/legislative\/2024\/bills\/senate\/17\/details\">recent law<\/a> that prevents minors from accessing pornography websites from going into effect. The lawsuit comes after a series of unsuccessful legal challenges in seven other states, where the pornography lobbyists claimed similar regulations violated constitutional rights and federal law. <\/p>\n<p>Central to the plaintiffs\u2019 argument is that pornography is a fundamental right protected by the First Amendment. Therefore, any law regulating its distribution must pass strict scrutiny or be the least restrictive means of accomplishing a compelling government interest. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-927598104\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-1c822870cc742f5e2ac34e0cfd473cf7 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-1c822870cc742f5e2ac34e0cfd473cf7\"><\/div>\n<p>However, the Fifth U.S. Circuit Court has already <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-50627-CV0.pdf\">ruled<\/a> on an equivalent Texas law that, based on the precedent set in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/390\/629\/\"><em>Ginsberg v. New York<\/em><\/a><em> <\/em>(1968)<em>, <\/em>the distribution of obscene or sexually explicit materials to minors is subject to the much lower standard of rational-basis review. The Supreme Court declined to hear an appeal on this decision.<\/p>\n<p><em>Ginsberg v. New York <\/em>involved an individual who sold obscene magazines to a minor in violation of New York state law. The same distributor was allowed, by law, to sell the magazines to adults and did so. The situation with the pornography website operators is similar, in that the prescribed remedy of age verification is permitted to apply to all customers. Age verification would rationally fulfill the compelling government interest in preventing minors from accessing obscene materials.<\/p>\n<p>The lawsuit claims the restriction provides \u201cneither a coherent standard for assessing to which websites it applies, nor adequate guidance on what \u2018age verification\u2019 entails.\u201d<\/p>\n<p>The <a href=\"https:\/\/iga.in.gov\/pdf-documents\/123\/2024\/senate\/bills\/SB0017\/SB0017.05.ENRH.pdf\">law<\/a>, however, states that the requirement applies to websites \u201cif at least one-third (1\/3) of the images and videos published on the website depict material harmful to minors.\u201d It is defined in the <a href=\"https:\/\/law.justia.com\/codes\/indiana\/title-35\/article-49\/chapter-2\/section-35-49-2-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">code<\/a> with similar language to the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/miller-test\/\">Miller Test<\/a>, which was established by the Supreme Court to determine what constitutes obscenity (which is not protected by the First Amendment). The language in the code says:<\/p>\n<div class=\"fdrlst__b89e9-ebc94475a2dd0f42a7d94fcbaee6c091 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ebc94475a2dd0f42a7d94fcbaee6c091\"><\/div>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n[If it]  describes or represents, in any form, nudity, sexual conduct, sexual excitement, or sadomasochistic abuse; considered as a whole, it appeals to the prurient interest in sex of minors; it is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable matter for or performance before minors; and considered as a whole, [and] it lacks serious literary, artistic, political, or scientific value for minors.<\/p>\n<\/blockquote>\n<p>The three listed age verification method categories acceptable under the <a href=\"https:\/\/iga.in.gov\/pdf-documents\/123\/2024\/senate\/bills\/SB0017\/SB0017.05.ENRH.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">law<\/a> are a \u201cmobile credential,\u201d or scan of a driver\u2019s license or other form of ID; an \u201cindependent third party age verification service\u201d that compares identifying information entered by the individual with a commercial database; or any other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pornhub-blocks-access-in-utah-after-state-passes-new-age-verification-law\/\" title=\"Pornhub Blocks Access in Utah After State Passes New Age Verification Law\">commercially reasonable method<\/a> that \u201crelies on public or private transactional data,\u201d such as what can be provided by a credit card. <\/p>\n<p>There are already several companies that specialize in one or more of the previous verification methods, such as <a href=\"https:\/\/www.yoti.com\/business\/age-verification\/?utm_medium=adwords&#038;utm_campaign=Yoti_B2B_AV_US_PPC_Age-Verification-Providers&#038;utm_source=age-verification-providers_Phrase&#038;utm_content=696295547028&#038;utm_term=p_age%20verification%20providers&#038;hsa_acc=3662910724&#038;hsa_cam=15827728051&#038;hsa_grp=130727464534&#038;hsa_ad=696295547028&#038;hsa_src=g&#038;hsa_tgt=kwd-1552225507352&#038;hsa_kw=age%20verification%20providers&#038;hsa_mt=p&#038;hsa_net=adwords&#038;hsa_ver=3&#038;gad_source=1&#038;gclid=CjwKCAjw65-zBhBkEiwAjrqRML6S4PXPRy0U9DP-BTuNxcaaN2nkXzMNKjMV3jdlM-uE-QRae-qDChoCTCkQAvD_BwE\">Yoti<\/a>. <\/p>\n<p>The lawsuit also claims the regulation violates <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/230\" target=\"_blank\" rel=\"noreferrer noopener\">Section 230<\/a> of the Communications Decency Act. However, the Fifth Circuit Court already ruled that the Texas state law is not preempted by federal law. Even if that were not the case, it is unclear what part of the law would be violated.<\/p>\n<p>The Federal Speech Coalition lawsuit claims the federal law \u201cprohibits treating website operators as if they were responsible for alleged harm caused by content created and uploaded by third parties.\u201d However, the federal law itself doesn\u2019t mention exemption from harm. Rather, it gives interactive computer services an exemption to moderate their content. <\/p>\n<div class=\"fdrlst__b89e9-c875a8f00a0876b5d8c9a66074dae845 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-c875a8f00a0876b5d8c9a66074dae845\"><\/div>\n<p>Even if that were not the case, several of the plaintiffs, including Aylo (owners of Pornhub) and\u00a0WGCZ Holding (owners of XVideos and Bang Bros studio), also participate in content creation and moderation. Aylo (formerly Mindgeek) has even been the subject of several lawsuits for its <a href=\"https:\/\/www.sanfordheisler.com\/case\/criminal-sexual-violence-litigation\/mindgeek-sex-trafficking-civil-lawsuit\/\">connection<\/a> to sex trafficking. <\/p>\n<p>The lawsuit later contradicts itself, admitting that only a rational basis is needed for supposed violations of the 14th Amendment in the law. It makes various claims about property rights, suggests it violates equal protection by exempting most social media sites and search engines, and asserts that it violates the Fifth Amendment, which deals with taking private property for public use without compensation because it forces \u201cplatforms to adopt age verification protocols they cannot afford and will cause a mass exodus of customers.\u201d <\/p>\n<p>For context, Aylo has long been <a href=\"https:\/\/www.advisoryexcellence.com\/what-is-mindgeek-we-explain-here\/\">accused<\/a> of operating a virtual monopoly over the pornography business making about $340.7 million per year. <\/p>\n<p>As far as the exemptions for search engines go, it would be difficult to prove that over one-third of their content is material harmful to minors. It is <a href=\"https:\/\/www.bbc.com\/news\/technology-23030090#:~:text=The%20academics%20behind%20the%20research,frequented%20sites%20in%20the%20world.&#038;text=Their%20estimate%3F,of%20those%20websites%20were%20porn.\">estimated<\/a> that only 4 percent of websites are pornography. Not to mention, websites aren\u2019t manually \u201centered\u201d into a search engine; rather, the search engine is viewed as more of a tool to find whatever is held on the internet itself that hasn\u2019t opted out of indexing or been moderated by the search engine provider. <\/p>\n<p>Some social media sites do, however, toe the line on the one-third limit. For example, X, formerly known as Twitter, is <a href=\"https:\/\/techcrunch.com\/2024\/03\/29\/x-confirms-plans-for-nsfw-communities\/#:~:text=According%20to%20internal%20documents%20obtained,photos%2C%20videos%20and%20other%20pornography.\">projected<\/a> to be around 13 percent porn, and that will likely increase in the future as Elon Musk <a href=\"https:\/\/www.kxnet.com\/news\/business-beat\/ap-business\/ap-musks-x-is-allowing-users-to-post-consensual-adult-content-formalizing-a-prior-twitter-policy\/\">recently changed<\/a> X\u2019s policy around explicit content. Some pornography sites also try to market themselves as social media. <\/p>\n<p>The lawsuit also claims the harms associated with exposing minors to pornography are \u201cfabricated,\u201d and that the fines proposed by the law are excessive. <\/p>\n<p>However, there has been a long and <a href=\"https:\/\/decencyusa.org\/whats-wrong-with-porn\/\">well-established link <\/a>between early exposure to pornography and depression, self-esteem issues, risky sexual behavior, and distorted expectations around sex. <\/p>\n<div class=\"fdrlst__b89e9-37045feac8a7094a260399b703400a1d fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-37045feac8a7094a260399b703400a1d\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Free Speech Coalition, Inc. and various pornography website operators sued Indiana Attorney General Todd Rokita on Monday.
