This decision, seen as a significant win for \u200cadvocates of sex-based eligibility in women\u2019s sports, supports World Aquatics&#8217; policy requiring male-to-female \u2063transgender athletes to demonstrate they have \u200dnot experienced male puberty beyond a very early stage to compete\u200d in women&#8217;s events.\u200c The\u200c ruling highlights issues surrounding biological advantages and reaffirms World Aquatics&#8217; commitment to maintaining separate\u200b categories based \u200bon biological sex. An open category for \u200ctransgender athletes \u2062has been \u200dcreated as an alternative by World Aquatics. The decision was celebrated by Riley Gaines, a female sports \u2062advocate and plaintiff in a \u2063related lawsuit against\u2062 the NCAA, underscoring the ongoing debate and legal \u2063battles over transgender participation in sports.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>The Swiss-based Court of Arbitration for Sport rejected a challenge on <a href=\"https:\/\/www.reuters.com\/sports\/olympics\/transgender-swimmer-lia-thomas-loses-cas-case-overturn-world-aquatics-ban-2024-06-12\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wednesday<\/a>  brought by Lia Thomas against World Aquatics\u2019 ban on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/caitlyn-jenner-comes-out-in-support-of-path-to-citizenship-for-californias-illegal-aliens\/\" title=\"Caitlyn Jenner Comes Out In Support Of \u2018Path To Citizenship\u2019 For California\u2019s Illegal Aliens\">transgender athletes participating<\/a> in the women\u2019s category at elite swimming competitions, thus barring him from participating in the 2024 Summer Olympics.<\/p>\n<p>The court\u2019s rejection is a massive win for women\u2019s sports and a major defeat for transgender athletes\u2019 attempts to subvert biological reality.<\/p>\n<p>World Aquatics\u2019 <a href=\"https:\/\/resources.fina.org\/fina\/document\/2023\/03\/27\/dbc3381c-91e9-4ea4-a743-84c8b06debef\/Policy-on-Eligibility-for-the-Men-s-and-Women-s-Competiition-Categrories-Version-on-2023.03.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">transgender policy<\/a> prohibits male athletes from competing against women, stating male-to-female transgender athletes are only granted permission to compete in the women\u2019s category \u201cif they can establish to World Aquatics\u2019 comfortable satisfaction that they have not experienced any part of male puberty beyond Tanner Stage 2 or before age 12, whichever is later.\u201d<\/p>\n<p>\u201cA <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/progressive-policies-need-to-be-fought-off-by-states-rep-steube\/\" title=\"Progressive Policies Need to Be Fought Off by States: Rep. Steube\">biological female athlete<\/a> cannot overcome that advantage through training or nutrition. Nor can they take additional testosterone to obtain the same advantage, because testosterone is a prohibited substance under the World Anti-Doping Code,\u201d World Aquatics <a href=\"https:\/\/resources.fina.org\/fina\/document\/2023\/03\/27\/dbc3381c-91e9-4ea4-a743-84c8b06debef\/Policy-on-Eligibility-for-the-Men-s-and-Women-s-Competiition-Categrories-Version-on-2023.03.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>.<\/p>\n<p>According to its <a href=\"https:\/\/resources.fina.org\/fina\/document\/2023\/03\/27\/dbc3381c-91e9-4ea4-a743-84c8b06debef\/Policy-on-Eligibility-for-the-Men-s-and-Women-s-Competiition-Categrories-Version-on-2023.03.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">policy<\/a> on eligibility, \u201cWorld Aquatics should remain committed to the separation of athletes in sport into men\u2019s and women\u2019s categories based on biological sex.\u201d<\/p>\n<p>The policy was established in June 2022. Since then, World Aquatics has created an open category for transgender athletes to compete in.  <\/p>\n<p>The Court of Arbitration for Sport <a href=\"https:\/\/nypost.com\/2024\/06\/12\/sports\/transgender-swimmer-lia-thomas-fails-in-challenge-to-rules-that-bar-her-from-olympics\/\" target=\"_blank\" rel=\"noreferrer noopener\">upheld<\/a> the World Aquatics ban. According to the New York Post, the international body said it has no authority \u201cto modify such scope of application\u201d determined by World Aquatics.<\/p>\n<p>Riley Gaines, female sports advocate and plaintiff in a lawsuit against the NCAA, was thrilled with the decision. The <a href=\"https:\/\/www.cbsnews.com\/news\/riley-gaines-college-athletes-lawsuit-ncaa-transgender-policies\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>, filed by over a dozen college athletes, was in response to the NCAA\u2019s decision to allow Thomas to compete at the 2022 national championships. Gaines, among others, argued allowing Thomas to participate violates their Title IX rights.<\/p>\n<p>\u201cGreat news! Lia Thomas won\u2019t be able to compete in women\u2019s category at the Olympics or any other elite competition,\u201d Gaines <a href=\"https:\/\/x.com\/Riley_Gaines_\/status\/1800949740739457262\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cThis is a victory for women and girls everywhere.\u201d <\/p>\n<p>Canadian powerlifter April Hutchinson also spoke out.<\/p>\n<p>\u201cH-ll yeah, and this is why female athletes and women around the world speak up &#038; fight this madness,\u201d she <a href=\"https:\/\/x.com\/Lea_Christina4\/status\/1800975704881856639\" target=\"_blank\" rel=\"noreferrer noopener\">wrote on X<\/a>. \u201cWe will keep fighting. Women will always speak!!! We deserve fair sport and safety.\u201d<\/p>\n<p>The left has continually attacked women\u2019s sports in pursuit of a supposed \u201cequity\u201d for transgender athletes who wish to compete against females.<\/p>\n<p>The Biden administration\u2019s rewriting of Title IX, which was recently blocked by a <a href=\"https:\/\/thefederalist.com\/2024\/06\/12\/biden-administrations-dangerous-title-ix-rewrite-struck-down-by-texas-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling in a recent Texas lawsuit<\/a>, replaced the word \u201csex\u201d with \u201cgender identity.\u201d These changes reinforce the detrimental narrative that male and female biology is negligible, enabling a select few of the mentally unwell to infiltrate already vulnerable women\u2019s spaces.<\/p>\n<hr>\n<p>      Kamden Mulder is a summer intern at The Federalist.
