Abortion Clinic\">pro-life doctors<\/a> group, the Alliance for Hippocratic\u2062 Medicine, did not\u200c have the legal standing to sue the Food and Drug Administration \u200b(FDA)\u200d over changes to the regulations for prescribing the abortion pill, mifepristone. The court found that since\u2062 the plaintiffs neither prescribe nor use mifepristone, and are not required to do so by the FDA, they cannot claim harm\u2064 from the FDA&#8217;s policy and therefore lack standing to sue. The case focused strictly on the issue of standing, as emphasized by Justice Clarence Thomas in a concurring opinion, meaning the court did not address whether the FDA\u2019s actions were lawful or not.<\/p>\n<p>The \u2062FDA had relaxed the rules surrounding \u200cmifepristone during \u2063the Obama and Biden\u200c administrations,\u2064 reducing the number of required doctor visits\u2063 and allowing prescriptions through telehealth and mail. Despite the ruling, groups like the Alliance Defending Freedom,\u2064 represented by attorney Erin Hawley, expressed disappointment, citing safety concerns\u2063 due to the relaxed guidelines. On the other hand, organizations such\u2062 as Planned Parenthood viewed the decision as positive, underscoring ongoing access to mifepristone in states where it is legal. Critics, including The Heritage Foundation legal fellows, argued that the decision ignored the original safety standards of the FDA and accused the Biden administration of compromising health for a \u200c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-fight-bidens-overseas-abortion-order\/\" title=\"Republicans Fight Biden\u2019s Overseas Abortion Order\">pro-abortion agenda<\/a>. The case has been sent back to the district court for further proceedings.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/randydesoto\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/randydesoto\/%20\"><span>Randy DeSoto<\/span><\/a> <\/span> <span>   June 13, 2024 at 11:12am <\/span> <\/span>  <\/header>\n<section>\n<p>The Supreme Court ruled unanimously Thursday that a pro-life doctors group, which sued the Food and Drug Administration over relaxing its safety standards for prescribing the abortion pill mifepristone, lacked standing.<\/p>\n<p>The lead medical group in the suit, the Alliance for Hippocratic Medicine, argued the FDA did not follow the Administrative Procedure Act in implementing the change.<\/p>\n<p>Justice Brett Kavanaugh, who wrote the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-235_n7ip.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a> of the court said, \u201cIn 2016 and 2021, the Food and Drug Administration relaxed its regulatory requirements for mifepristone, an abortion drug. Those changes made it easier for doctors to prescribe and pregnant women to obtain mifepristone.\u201d<\/p>\n<p>\u201cSeveral pro-life doctors and associations sued FDA, arguing that FDA\u2019s actions violated the Administrative Procedure Act,\u201d he continued. \u201cBut the plaintiffs do not prescribe or use mifepristone. And FDA is not requiring them to do or refrain from doing anything.\u201d<\/p>\n<p>\u201cRather, the plaintiffs want FDA to make mifepristone more difficult for other doctors to prescribe and for pregnant women to obtain,\u201d Kavanaugh wrote. \u201cUnder Article III of the Constitution, a plaintiff\u2019s desire to make a drug less available for others does not establish standing to sue. Nor do the plaintiffs\u2019 other standing theories suffice. Therefore, the plaintiffs lack standing to challenge FDA\u2019s actions.\u201d<\/p>\n<p>Justice Clarence Thomas emphasized in a concurring opinion that the ruling was about standing, explaining, \u201cJust as abortionists lack standing to assert the rights of their clients, doctors who oppose abortion cannot vicariously assert the rights of their patients.\u201d<\/p>\n<p><a href=\"https:\/\/www.dailysignal.com\/2024\/06\/13\/breaking-supreme-court-rules-against-pro-lifers-on-abortion-drugs\/\" target=\"_blank\" rel=\"noopener\">The Daily Signal<\/a> reported that when the FDA first approved mifepristone in 2000 it required three doctor visits: \u201cthe first to take mifepristone, the second to take misoprostol, and the third to confirm that the baby was dead.\u201d<\/p>\n<p>In 2016, during the Obama administration, the FDA reduced the number of required doctor office visits from three to one and removed the requirement that a doctor had to prescribe the drugs.<\/p>\n<p>Then in 2021, during the Biden administration, the FDA ended the requirement that the drugs be dispensed to mothers in person, allowing telehealth prescriptions, which could be fulfilled by mail.<\/p>\n<p>Alliance Defending Freedom attorney Erin Hawley, whose firm represented the Alliance for Hippocratic Medicine, said in a <a href=\"https:\/\/adfmedia.org\/case\/us-food-and-drug-administration-v-alliance-hippocratic-medicine\" target=\"_blank\" rel=\"noopener\">statement<\/a> following the Supreme Court ruling, \u201cWe are disappointed that the Supreme Court did not reach the merits of the FDA\u2019s lawless removal of commonsense safety standards for abortion drugs.\u201d<\/p>\n<p>\u201cNothing in today\u2019s decision changes the fact that the FDA\u2019s own label says that roughly one in 25 women who take chemical abortion drugs will end up in the emergency room \u2014 a dangerous reality the doctors and medical associations we represent in this case know all too well,\u201d she continued.<\/p>\n<p>\u201cThe FDA recklessly leaves women and girls to take these high-risk drugs all alone in their homes or dorm rooms, without requiring the ongoing, in-person care of a doctor,\u201d Hawley said.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">BREAKING: SCOTUS\u2019s ruling on our case against the FDA will allow the FDA to continue to endanger women\u2019s health for now.<\/p>\n<p>While we\u2019re disappointed the Court did not reach the merits of the FDA\u2019s unlawful actions, nothing in today\u2019s decision changes this fact: women and girls are\u2026<\/p>\n<p>\u2014 Alliance Defending Freedom (@ADFLegal) <a href=\"https:\/\/twitter.com\/ADFLegal\/status\/1801263907769659637?\">June 13, 2024<\/a><\/p>\n<\/blockquote>\n<p>Danco Laboratories, a mifepristone manufacturer that had intervened in the case, said it was \u201cpleased with the Supreme Court\u2019s decision,\u201d according to<a href=\"https:\/\/www.cnn.com\/2024\/06\/13\/politics\/supreme-court-rejects-challenge-abortion-pill-mifepristone\/index.html\" target=\"_blank\" rel=\"noopener\"> CNN<\/a>.<\/p>\n<p>Danco spokesperson Abigail Long said, the ruling \u201cmaintained the stability of the FDA drug approval process, which is based on the agency\u2019s expertise and on which patients, healthcare providers and the U.S. pharmaceutical industry rely.\u201d<\/p>\n<p>Planned Parenthood posted on social media following the ruling, \u201cGood news for now: SCOTUS ruled against restricting access to mifepristone, a pill for medication abortion &#038; miscarriage care.
