The court criticized \u2064the Bureau of Alcohol, Tobacco, Firearms \u200dand\u2063 Explosiles (ATF) for its sudden change to a longstanding exemption.\u200b The decision was \u200ccelebrated by the \u200bFirearms Policy Coalition, which had pushed \u2063the case, suggesting \u2062that the ATF had overstepped \u2063its boundaries. This case, \u2063known \u200cas\u2063 Mock vs.\u2062 Garland, is \u200dlikely to \u2063escalate to \u2063the U.S.\u2063 Supreme President.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In a huge blow to President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Joe Biden<\/a>\u2019s bid to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/expert-warns-biden-has-launched-four-prong-attack-against-second-amendment-advises-how-to-respond\/\" title=\"Expert Warns Biden Has Launched \u2018Four-Prong Attack Against\u2019 Second Amendment, Advises How To Respond\">ban \u201cassault weapons<\/a>,\u201d a federal court today ruled that the administration\u2019s effort to regulate and tax <a href=\"https:\/\/www.washingtonexaminer.com\/news\/washington-secrets\/3029518\/fight-over-ar-15-pistols-moves-closer-to-supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>AR-15 style \u201cpistols\u201d<\/a> is \u201cunlawful\u201d and \u201cillegitimate.\u201d<\/p>\n<p>In a 12-page decision, the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Texas\" target=\"_blank\" rel=\"noopener\" title>Texas<\/a>-based U.S. District Court vacated the rule that could have led to the destruction of millions of firearms, among the most popular in America, and the jailing of owners who had refused to comply with the administration.<\/p>\n<p>The court also blasted the Bureau of Alcohol, Tobacco, Firearms and Explosives for thinking that it could change a long-established exemption overnight to make ownership of the firearms illegal.<\/p>\n<p>In reacting to the case, Mock vs. Garland, the Firearms Policy Coalition, which pushed the case, tweeted out what it called the \u201clayman\u2019s\u201d summary.<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>\ud83d\udea8 FPC GRASSROOTS ARMY WIN \ud83d\udea8<\/p>\n<p>In our Mock v. Therefore, the right thing for the Court to do was throw the Rule in the trash. The Court threw the Pistol Brace Rule in the trash,\u201d it said.<\/p>\n<p>The same court had earlier approved the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/atf\/\" target=\"_blank\" rel=\"noopener\" title>ATF<\/a> rule, but an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-smacks-down-effort-to-nullify-arkansas-anti-bds-law\/\" title=\"Federal Court Smacks Down Effort To Nullify Arkansas\u2019 Anti-BDS Law\">appeals court overruled<\/a> it. Typically, short barreled rifles are regulated under the Al Capone era National Firearms Act which requires a $200 tax stamp and registration.<\/p>\n<p>In his decision, Judge Reed O\u2019Connor said that the ATF was wrong in just changing its mind without giving an explanation. He also hit the agency for ignoring comments from users and writing the rule vaguely.<\/p>\n<p>\u201cThe court finds that the adaptation of the final rule was arbitrary and capricious for two reasons. First, the defendants did not provide a detailed justification for their reversal of the agency\u2019s longstanding position. And second, the final rule\u2019s standards are impermissibly vague,\u201d wrote the judge.<\/p>\n<p>There are an estimated 10 million or more of the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/firearms\/\" target=\"_blank\" rel=\"noopener\" title>firearms<\/a> in America.
