This guidance was\u2062 first issued during the 2020 elections. The Michigan Republican Party and the Allegan County clerk challenged it, leading to a court ruling against the presumption of validity. Despite criticism and a negative public response, this presumption language was inadvertently included in the final guidelines issued by the\u2064 state.\u2063 Reacting to\u200b further controversy, Benson issued \u2064new guidance in December 2023, \u2062which upheld an initial presumption of validity for voter signatures on \u2062absentee ballots. This led to another lawsuit from the Michigan Republican Party and other stakeholders against the state and\u200b the Director of Elections,\u200d labeling the\u2064 guidance as impermissible.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>A judge ruled Wednesday that Michigan\u2019s Democrat Secretary of State Jocelyn Benson\u2019s guidance telling election officials to presume the validity of absentee ballot signatures is unconstitutional.<\/p>\n<p>During the 2020 election, Benson sent out guidance to election officials \u201cthat included a presumption of validity for voters\u2019 signatures on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/zuckerberg-used-a-tax-exempt-foundation-to-help-biden-fix-the-2020-election\/\" title=\"Zuckerberg Used a Tax-Exempt Foundation to Help Biden Fix the 2020 Election\">absentee-ballot applications<\/a> and absentee ballots processed at the local level,\u201d the <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/03\/2024-06-12-Order-and-opinion.pdf\">ruling<\/a> from Court of Claims Judge Christopher Yates explains.<\/p>\n<p>The Michigan Republican Party and the Allegan County clerk initially challenged the presumption of validity provision, and the Court of Claims \u201cdetermined that the guidance was impermissible.\u201d In response to the ruling, the Michigan Department of State created new guidance for signature matching that included a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congress-wants-to-know-what-the-intel-community-is-doing-to-make-spying-more-inclusive-and-diverse\/\" title=\"Congress Wants To Know What The Intel Community Is Doing To Make Spying More \u2018Inclusive\u2019 And \u2018Diverse\u2019\">provision requiring officials<\/a> to presume that the signature being reviewed is valid. Yates, in his ruling, noted that there was a \u201cstrong\u201d negative response to this particular provision during a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-canvassers-rescind-their-votes-to-certify-wayne-county-michigan-results\/\" title=\"Republican Canvassers Rescind Their Votes to Certify Wayne County, Michigan, Results\">public comment period<\/a>, and the state agreed on striking the language.<\/p>\n<p>The language nonetheless made it in the final version, \u201cperhaps due to an oversight,\u201d according to Yates\u2019 ruling.<\/p>\n<p>Benson then issued guidance in December of 2023 on how to conduct signature verification for absentee ballot applications and envelopes. The guidance, in part, states \u201c[v]oter signatures are entitled to an <em>initial <\/em>presumption of validity.\u201d The Michigan Republican Party, alongside the Republican National Committee (RNC) and other plaintiffs, sued the state and the Director of Elections arguing the guidance was \u201cimpermissible,\u201d once again due to the presumption of validity provision. Yates ruled in agreement.<\/p>\n<p>The court found that the state constitution \u201ccalls for a signature comparison without making any presumption for or against validity.\u201d<\/p>\n<p>\u201c[T]he \u2018initial presumption\u2019 of validity in signature verification of absentee-ballot applications and envelopes mandated by the December 2023 guidance manual issued by defendants is incompatible with the Constitution and laws of the State of Michigan,\u201d Yates ruled.<\/p>\n<p>Yates also awarded a \u201cdeclaratory judgment describing as impermissible all presumption language contained in the guidance manual for dealing with absentee-ballot applications and envelopes.\u201d<\/p>\n<p>Yates did, however, uphold a section of Michigan\u2019s administrative code offering election officials possible \u201cexplanations for differences in signatures.\u201d Some examples in the guidance include a shaky hand due to age or health, signing too fast, or even a difference in signature style.<\/p>\n<p>The Michigan Supreme Court is set to hold a special session on June 18 to hear challenges to a manual Benson issued in May 2022.
