This means, even if the four justices needed to take the case agree, and even if SCOTUS rules in favor of the Pennsylvania lawmakers, it will likely not be in time for any meaningful action to be taken before the election in November. <\/p>\n<p>It also means federal agencies can continue their unfettered meddling in the meantime.<\/p>\n<h2 class=\"wp-block-heading\">What Does The Suit Allege?<\/h2>\n<p>Republican Pennsylvania State Rep. Dawn Keefer, along with 26 other state legislators, argue Biden overstepped his constitutional authority to take control of elections with his \u201cBidenbucks\u201d Executive Order, as my colleague M.D. Kittle <a href=\"https:\/\/thefederalist.com\/2024\/04\/23\/exclusive-pennsylvania-lawmakers-appeal-to-supreme-court-in-case-challenging-bidenbucks\/\">reported<\/a>. <\/p>\n<p>The <a href=\"https:\/\/dockets.justia.com\/docket\/pennsylvania\/pamdce\/1:2024cv00147\/140876\">suit<\/a> was filed in January against President Biden, Pennsylvania Democrat Gov. Josh Shapiro, Secretary of the Commonwealth Al Schmidt, and Jonathan Marks \u2014 who serves as deputy secretary for state Elections and Commissions.<\/p>\n<div class=\"fdrlst__b89e9-12c651e2484899ee4920e97983473885 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-12c651e2484899ee4920e97983473885\"><\/div>\n<p>The suit claims the executive order is unconstitutional because it violates the right of lawmakers to set the time, place, and manner in which an election shall be held.<\/p>\n<p>\u201c[A]ll agency action in conformity with [EO] 14019 is without congressional delegation or funding, and conducted merely by executive fiat,\u201d the <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/M.D.-Pa.-24-cv-00147-dckt-000048_000-filed-2024-03-26.pdf\">suit<\/a> alleges. In particular, the Pennsylvania delegation of state lawmakers <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/1-2024-01-25-Complaint-3.pdf\">argues<\/a> that \u201cBidenbucks\u201d has the capability of changing Pennsylvania\u2019s election law \u201cwhich usurps the state legislature\u2019s powers and violates the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-pennsylvania-lawmakers-appeal-to-supreme-court-in-case-challenging-bidenbucks\/\" title=\"Exclusive: Pennsylvania Legislators Seek Supreme Court Review in 'Bidenbucks' Challenge\">state legislators\u2019 federal civil rights<\/a> under the Electors Clause and the Elections Clause.\u201d<\/p>\n<p>The U.S. District Court for the Middle District of Pennsylvania <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-wont-consider-challenge-to-bidens-order-on-elections-until-sept-30-post-5667462?src_src=RTNews&#038;src_cmp=rtbreaking-2024-06-12-2&#038;est=AAAAAAAAAAAAAAAAa%2B0yVQcEzMfN6LYcv2lQGKA0yEwDRjxnDT8PiSutFoYjw6SRhA%3D%3D\">dismissed<\/a> the challenge in March, arguing individual state representatives did not have standing to bring the case. The lawmakers appealed to the U.S. Court of Appeals for the 3rd Circuit but also asked the Supreme Court to expedite their consideration of the case so \u201cthey can possibly obtain a preliminary injunction in the district court well before the November 2024 election,\u201d according to <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-wont-consider-challenge-to-bidens-order-on-elections-until-sept-30-post-5667462?src_src=RTNews&#038;src_cmp=rtbreaking-2024-06-12-2&#038;est=AAAAAAAAAAAAAAAAa%2B0yVQcEzMfN6LYcv2lQGKA0yEwDRjxnDT8PiSutFoYjw6SRhA%3D%3D\">The Epoch Times<\/a>.<\/p>\n<p>The Supreme Court rejected this request<strong> <\/strong>in May and announced Wednesday it will instead make a decision in September.<\/p>\n<div class=\"fdrlst__b89e9-ca6c773f53e30c8846f1be24b87b6cbf fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-ca6c773f53e30c8846f1be24b87b6cbf\"><\/div>\n<h2 class=\"wp-block-heading\">How Bidenbucks Works<\/h2>\n<p>Federal agencies are required under <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/03\/07\/executive-order-on-promoting-access-to-voting\/\">Executive Order 14019<\/a> to use taxpayer dollars to meddle in elections. One way this is being done is through the Department of Education, which issued a <a href=\"https:\/\/fsapartners.ed.gov\/knowledge-center\/library\/dear-colleague-letters\/2024-02-26\/use-federal-work-study-funds-voter-registration\">memo<\/a> in February announcing federal work-study funds could be used to pay students at government agencies to register voters or serve as a poll watcher.<\/p>\n<p>The Department of Agriculture is colluding with left-wing groups like <a href=\"https:\/\/www.dailysignal.com\/2024\/05\/02\/exclusive-under-biden-order-usda-teams-with-left-wing-groups-to-grow-new-voters\/\">Demos<\/a> to turn out voters. Further, the USDA\u2019s <a href=\"https:\/\/www.fns.usda.gov\/cn\/promoting-voting-access\">Food and Nutrition Service<\/a>, as reported by my colleague <a href=\"https:\/\/thefederalist.com\/2024\/02\/22\/bidenbucks-stink-emanates-from-leftist-groups-voter-drive-in-milwaukee-schools\/\">M.D. Kittle<\/a>, \u201cencourages all state agencies administering the child nutrition programs to provide local program operators with promotional materials, including voter registration and non-partisan, non-campaign election information, to disseminate among <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidenbucks-make-zuckbucks-look-like-chump-change\/\" title=\"Bidenbucks' Dwarf 'Zuckbucks' in Comparison\">voting-age program participants<\/a> and their families.\u201d<\/p>\n<p>The agency went so far as to recommend that \u201cschool food authorities administering the National School Lunch Program \u2026 in high schools, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gov-newsom-announces-statewide-vaccine-mandate-for-california-healthcare-workers\/\" title=\"Gov. Newsom Announces Statewide Vaccine Mandate For California Healthcare Workers\">adult day care centers<\/a> and emergency shelters participating in the Child and Adult Care Food Program \u2026 to promote voter registration and election information among <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/9-ways-the-feds-are-using-bidenbucks-to-rig-the-2024-election\/\" title=\"9 Ways the Federal Government is Manipulating the 2024 Election with 'Bidenbucks\">voting-age participants<\/a> and use congregate feeding areas, such as cafeterias, or food distribution sites, as sites for the dissemination of information.\u201d<\/p>\n<p>Then there\u2019s the <a href=\"https:\/\/thefederalist.com\/2024\/03\/29\/bidenbucks-tentacles-expand-as-judge-shuts-down-lawsuit\/\">key state<\/a> of Michigan whose Department of State signed a <a href=\"https:\/\/www.sba.gov\/article\/2024\/03\/19\/sba-administrator-guzman-announces-agencys-first-ever-voter-registration-agreement-michigan\">Memorandum of Understanding<\/a> with the U.S. Small Business Administration (SBA) \u201cto promote civic engagement and voter registration in Michigan.\u201d The House Oversight Committee on Small Business <a href=\"https:\/\/thefederalist.com\/2024\/06\/04\/hearing-federal-business-agency-spends-bidenbucks-to-win-michigan-for-democrats\/\">heard<\/a> from witnesses about <a href=\"https:\/\/thefederalist.com\/2024\/05\/16\/republicans-to-small-business-administration-on-bidenbucks-coverup-stop-stonewalling\/\">these efforts<\/a>, with Republican Colorado Rep.
