Douglas Golden<\/span><\/a> <\/span> <span>   June 13, 2024 at 7:45am <\/span> <\/span>  <\/header>\n<section>\n<p>Nathan Wade \u2014 prosecutor, former lover of Fulton County, Georgia, District Attorney Fani Willis, and unlikely wrench in the gears of the lawfare campaign against presumptive GOP nominee Donald Trump \u2014 has a poor grasp of discretion, as we now well know.<\/p>\n<p>To that, we can add that he has a poor grasp of the significant body of constitutional scholarship, which states that a sitting president can\u2019t just be dragged into a court of law.<\/p>\n<p>This revelation came as part of Wade\u2019s interview on CNN Wednesday with Kaitlan Collins, which focused \u2014 as you might expect \u2014 on his amorous dalliance with the Fulton County DA trying to nail Trump and his associates on RICO charges based on their attempts to <a href=\"https:\/\/www.westernjournal.com\/detail-judge-assigned-georgia-trump-case-raises-eyebrows\/\" target=\"_blank\" rel=\"noopener\">challenge the results of the 2020 election<\/a>.<\/p>\n<p>That effort <a href=\"https:\/\/www.westernjournal.com\/georgia-judges-ruling-2-defendants-will-make-rico-case-difficult-fulton-county\/\" target=\"_blank\" rel=\"noopener\">wasn\u2019t exactly going stellar<\/a> <em>before<\/em> the evidence of their relationship came to light. Without going through a full rehash of l\u2019affaire Willis\/Wade \u2014 which did indeed provide some much needed levity to an otherwise dreary, underwhelming set of proceedings \u2014 Wade was forced off the case, and Willis was given a strong rebuke but allowed to continue as lead prosecutor. Trump\u2019s lawyers are <a href=\"https:\/\/www.westernjournal.com\/court-makes-huge-decision-trump-election-case-will-affect-2024-campaign\/\" target=\"_blank\" rel=\"noopener\">appealing that decision<\/a>, which has pushed the start of the case off indefinitely.<\/p>\n<p>However, you can\u2019t fill a full interview with the legal consequences of intraoffice hanky-panky, so Collins asked about what would happen if the case was pushed off past the election and Trump were to win.<\/p>\n<p>\u201cIf Trump wins the election, and the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/radical-cultural-change-coming-to-america\/\" title=\"Radical Cultural Change Coming to America?\">district attorney<\/a>, next spring, when this \u2014 when this does go before the Court of Appeals is not disqualified from that, is it constitutional, for a district attorney, to put a sitting president on trial, and if he\u2019s convicted, and jailed, potentially?\u201d Collins asked, according to a CNN <a href=\"https:\/\/transcripts.cnn.com\/show\/skc\/date\/2024-06-12\/segment\/01\" target=\"_blank\" rel=\"noopener\">transcript<\/a>.<\/p>\n<p>\u201cSo, let\u2019s look at the question in reverse. Is it \u2014 are you asking me, if there\u2019s anyone, who\u2019s above the law at any point in time, and they\u2019re allowed \u2013\u201d Wade responded.<\/p>\n<p>\u201cNo, but I don\u2019t think it\u2019s been litigated about a sitting president, of course, going on trial,\u201d <a href=\"https:\/\/www.westernjournal.com\/tucker-carlson-interviewed-kaitlan-collins-years-cnn-town-hall-said-trump\/\" target=\"_blank\" rel=\"noopener\">Collins<\/a> noted. \u201cWe\u2019ve never seen that.\u201d<\/p>\n<p>\u201cNever seen it. Never expected to see it, which is why a lot of the questions about experience,\u201d Wade said.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Will Donald Trump go to jail?<\/p>\n<\/p><\/div>\n<p>\u201cNo one has ever done this before. No one. This is \u2014 this is a new animal. But if he wins the election, then certainly there are lawyers, out there, who will be charged with figuring out that issue, and maneuvering around it.\u201d<\/p>\n<p>Yes, that\u2019s right \u2014 \u201cmaneuvering around it.\u201d He\u2019s not even good at euphemizing this.<\/p>\n<p>Collins, just to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-fails-to-override-biden-veto-on-gop-repeal-of-epas-clean-waterways-rule\/\" title=\"House fails to override Biden's's veto on the sharp waters rule repealed by the GOP.\">make things clear<\/a>, noted that Wade was \u201cnot sure if he can \u2014 if he can go on trial, if you believe it\u2019s constitutional or not for him, to actually be on, if he\u2019s the sitting president.<\/p>\n<p>\u201cBut you just talked about how important this case is. I mean, personally, how important do you believe it is, for this case, to go to trial, for voters to see the evidence here, of what\u2019s alleged in that indictment?\u201d<\/p>\n<p>\u201cOh, it\u2019s very important,\u201d Wade responded. \u201cBut let\u2019s back up a moment. You said that I\u2019m not sure about the constitutionality of trying a sitting president.\u201d<\/p>\n<p>\u201cYes. Do you believe he can \u2014 sorry, if that wasn\u2019t clear. Do you believe he can be on trial, if he\u2019s in the White House?\u201d <a href=\"https:\/\/www.westernjournal.com\/watch-anti-trump-john-bolton-tells-cnn-wont-vote-trump-biden-reveals-name-voted-2020-wholl-pick-now\/\" target=\"_blank\" rel=\"noopener\">Collins<\/a> responded.<\/p>\n<p>\u201cI do believe that he can,\u201d Wade said. \u201cI don\u2019t \u2014 I don\u2019t believe that it looks good to the rest of the world. But certainly, I don\u2019t think that there\u2019s anything that will prevent that from happening.\u201d<\/p>\n<p>Collins then asked the obvious question: What happens if he\u2019s convicted?<\/p>\n<p>\u201cI mean, it would create a moment, like we\u2019ve never seen, in this country, with the Secret Service, with who\u2019s enforcing that. And, of course, he would be the head of a federal branch of government,\u201d she said.<\/p>\n<p>\u201cThat\u2019s a much different question. We know that sentencing is totally up to the trial court. That judge that\u2019s sitting there, he\u2019s charged with \u2014 with making those types of decisions. Special prosecutors are not,\u201d Wade responded.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">Nathan Wade says he believes Trump can be put on trial in Georgia, even if he wins a second term and is in the White House. \u201cI don\u2019t believe it looks good to the rest of the world. But certainly I don\u2019t think that there\u2019s anything that would prevent that from happening.\u201d <a href=\"https:\/\/t.co\/1KjBbZ2Wqt\">pic.twitter.com\/1KjBbZ2Wqt<\/a><\/p>\n<p>\u2014 Kaitlan Collins (@kaitlancollins) <a href=\"https:\/\/twitter.com\/kaitlancollins\/status\/1801028028341932150?\">June 12, 2024<\/a><\/p>\n<\/blockquote>\n<p>I hope Nathan Wade was a spectacular boyfriend because he\u2019s an absolute nightmare as a damage control specialist for the <a href=\"https:\/\/www.westernjournal.com\/judge-fani-willis-case-makes-big-announcement-closing-arguments-disgraced-fulton-county-da\/\" target=\"_blank\" rel=\"noopener\">Fulton County District Attorney\u2019s Office<\/a>. Literally every word choice Wade went with made this sound manipulative and horrible for democracy \u2014 but he swears what sounds like a Very Bad Idea\u2122 can be done!<\/p>\n<p>As it turns out, he\u2019s just about as good at the constitutionality thing as he is regarding both amatory discretion and word choice.<\/p>\n<p>No sitting president has ever been charged with a crime. As the <a href=\"https:\/\/www.law.cornell.edu\/wex\/indictment_of_presidents\" target=\"_blank\" rel=\"noopener\">Cornell Legal Information Institute<\/a> noted, the closest we\u2019ve come is the arrest of <a href=\"https:\/\/www.westernjournal.com\/far-left-rioters-use-juneteenth-tear-statue-ulysses-s-grant-defeated-confederacy\/\" target=\"_blank\" rel=\"noopener\">Ulysses S. Grant<\/a> on a speeding charge. Apparently, he was able to get his one-horsepower vehicle \u2014 quite literally, since it was a horse \u2014 up to enough of a gallop that a Washington, D.C., policeman <a href=\"https:\/\/www.npr.org\/2018\/12\/22\/679448648\/that-time-a-president-got-in-trouble-with-the-police\" target=\"_blank\" rel=\"noopener\">detained him<\/a> and issued him a fine. Grant made sure this didn\u2019t repeat itself by getting a Yugo, which couldn\u2019t outrun either or a horse or Grant himself. Part of that last paragraph was made up.<\/p>\n<p>As for a serious crime \u2014 such as a state RICO charge based around the president\u2019s decision to challenge the election results in the state in 2020 \u2014 nothing of that sort has ever happened. This is in spite of the fact that there have been instances where a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-biden-administration-is-cooking-the-books-on-illegal-immigrant-arrests\/\" title=\"The Biden Administration Is Cooking The Books On Illegal Immigrant Arrests\">criminal act committed<\/a> while the president was in the White House was indeed on the table.<\/p>\n<p>You may remember there was ample evidence that Bill Clinton committed perjury and obstruction of justice in the Monica Lewinsky scandal; while he was impeached, eventually surrendered his law license for a period and paid a fine, the matter was officially handled through the constitutionally outlined impeachment process, as it should have been.<\/p>\n<p>While Richard Nixon resigned mere days after the \u201csmoking gun\u201d tape indicated he knew about the origins of the Watergate break-in well before he said he had and had helped direct the cover-up, there was never a serious effort to federally prosecute him for it while in office, even after it became increasingly clear that his statements about what he knew were at variance with the facts. Again, the avenue chosen was the impeachment process. Once he left office, he was subject to criminal prosecution, but he was given a pardon by President Gerald Ford.<\/p>\n<p>Trump\u2019s case would be unique since, as the Cornell Legal Information Institute noted, \u201cno court has been given the opportunity to rule on the topic.\u201d That said, there is a body of constitutional scholarship that indicates that, no, a president cannot be dragged into to court.<\/p>\n<p>First, there\u2019s precedent in government policy: \u201cThe Department of Justice (DOJ) has a continuing policy since the 1970s that sitting presidents cannot be indicted as it would unconstitutionally prevent them from performing their duties as the head of the executive branch,\u201d the Legal Information Institute noted.<\/p>\n<p>\u201cEssentially, if a president became indicted, this position holds that the entire Executive would be compromised from fulfilling its obligations given the unique powers of the president. This privilege does not extend to any other person, including the vice president. This line of reasoning has been supported by Supreme Court Justice Joseph Story in a treatise and strongly argued for by Justice Samuel Alito in a dissent in Trump v. Vance.\u201d<\/p>\n<p>Also, a <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB11121\" target=\"_blank\" rel=\"noopener\">research paper<\/a> published in March by the nonpartisan Congressional Research Service, Congress\u2019 in-house think-tank, noted that the DOJ\u2019s Office of Legal Counsel takes the position \u201cthat sitting Presidents do possess absolute immunity from criminal prosecution, at least while they hold office.\u201d<\/p>\n<p>The OLC, the paper said, \u201cbases this criminal immunity on the separation of powers, reasoning that imprisoning, prosecuting, or even indicting a sitting President would \u2018unduly interfere\u2019 with the President\u2019s ability to \u2018perform his constitutionally assigned duties.\u2019 Each stage of the criminal process would, in OLC\u2019s view, impose unacceptable burdens and distractions on the presidency that would outweigh the public interest in criminal accountability.<\/p>\n<p>\u201cOLC acknowledges however, that a President\u2019s immunity from criminal process is \u2018temporary\u2019 and ends when a President leaves office. In a 2000 opinion, OLC reasoned that \u2018the constitutional structure permits a sitting President to be subject to criminal process only after he leaves office or is removed therefrom through the impeachment process.\u2019\u201d<\/p>\n<p>In other words, while the question is untested, the preponderance of thought on the matter \u2014 assembled by scholars far more immersed in the workings of the Constitution than Mr. <a href=\"https:\/\/www.westernjournal.com\/nathan-wades-cellphone-data-may-just-blown-huge-hole-fani-willis-story-claim\/\" target=\"_blank\" rel=\"noopener\">Nathan Wade<\/a> \u2014 seems to indicate sitting presidents <em>can\u2019t<\/em> be prosecuted. But, beyond that, is <em>this<\/em> the case that Wade wants to break the mold?<\/p>\n<p>It\u2019s a dubious thing to bring a former \u2014 and possibly future \u2014 president before a court for honestly believing he won the state of Georgia in 2020. It\u2019s even more dubious to charge him and those in his orbit with RICO violations when there appears to be no proof of a cohesive, directed criminal conspiracy \u2014 a necessary element of any RICO charge. We\u2019ve had presidents who have escaped prosecution for blatant perjury and obstruction of justice, and <em>this<\/em> is where Nathan Wade wants to cross the Rubicon?<\/p>\n<p>Note to Fani Willis: The next time you want to jeopardize a case that could change the course of American political history by having a fling, <a href=\"https:\/\/www.westernjournal.com\/fani-willis-allegedly-warned-nathan-wades-lawyer-keep-quiet-coming-us\/\" target=\"_blank\" rel=\"noopener\">pick a better fling-mate<\/a>.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
