This <\/em>Washington Examiner<em> series will look at how a departure from this precedent could rip up the regulation nation<\/em>. <em>Part 1 <a href=\"https:\/\/www.washingtonexaminer.com\/news\/business\/3029041\/supreme-court-may-soon-undercut-bidens-regulatory-regime\/\" target=\"_blank\" rel=\"noreferrer noopener\">focused on<\/a> the underlying court case<\/em>. <em>Part 2 <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/finance-and-economy\/3036280\/what-downfall-chevron-deference-mean-economic-regulations\/\" target=\"_blank\" rel=\"noreferrer noopener\">explored<\/a> the possible economic repercussions.<\/em> <em>Part 3 <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/energy-and-environment\/3034057\/downfall-chevron-deference-energy-climate-regulations\/\" target=\"_blank\" rel=\"noopener\" title=\"examined\">examined<\/a> what the fallout would be for energy and environmental policy.<\/em> <em>Part 4 looks at what the end of<\/em> Chevron <em>could mean in a second Trump administration. <\/em><\/p>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a> has long promised to curtail the \u201cDeep State\u201d of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-instructs-fed-agencies-to-say-biden-harris-administration-report-says\/\" title=\"White House Instructs Fed Agencies To Say \u2018Biden-Harris\u2019 Administration, Report Says\">federal government agencies<\/a> and drain \u201cthe swamp\u201d of bureaucrats in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/washington-dc\/\" target=\"_blank\" rel=\"noopener\" title>Washington, D.C.<\/a><\/p>\n<p>A pending <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> ruling could help him achieve those goals, even three years after leaving office. <\/p>\n<p>The high court will soon issue a ruling that could reshape the balance of power between federal agencies, the judiciary, and legislative branches, while simultaneously disrupting President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Joe Biden<\/a>\u2018s progressive regulatory agenda.<\/p>\n<p>A ruling that curtails or fully overturns the 40-year-old precedent known as the <em>Chevron<\/em> deference would put an end to courts deferring to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-may-soon-undercut-bidens-regulatory-regime\/\" title=\"Supreme Court likely to weaken Biden's regulatory framework soon\">federal agencies\u2019 reasonable interpretations<\/a> of ambiguous statutes, which many businesses and industry groups say has led to overregulation from unelected government officials.<\/p>\n<p>The ruling itself could be a win for Trump in a roundabout way, as his judicial nominees, especially Justice Neil Gorsuch, who has long opposed <em>Chevron<\/em>, would be largely responsible. But it could also represent a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-education-nominee-ignored-sexual-assault-allegations-lawsuit-charges\/\" title=\"Biden Education Nominee Ignored Sexual Assault Allegations, Lawsuit Charges\">double-edged sword<\/a> in a second Trump administration, as the executive branch itself would lose some power.<\/p>\n<p>\u201cThe idea is to empower Congress more, relative to the executive branch,\u201d said Mark Chenoweth, president of the New Civil Liberties Alliance. \u201cWhat we had been seeing under <em>Chevron<\/em> was a 180-degree flip from administration to administration where they\u2019d change dozens and dozens of rules. And there has been limited ability to challenge some things through the courts.\u201d<\/p>\n<p><em>Chevron<\/em> was mostly celebrated by conservatives when the Supreme Court handed it down in 1984, as it was expected to curtail the influence of \u201cactivist\u201d judges who were seen as legislating from the bench. But over time, figures on the Right became wary of the ruling, as Washington-based federal agencies were empowered to fill in gaps left by Congress or try to use existing legal language in novel ways.<\/p>\n<p>\u201cRight now, you have agencies sort of rummaging through old statutes and looking for authorities that Congress never gave them,\u201d Chenoweth added. <\/p>\n<p>Trump has never campaigned heavily on <em>Chevron<\/em> deference specifically. Some of his allies and Gorsuch have instead made the case against it.<\/p>\n<p>Gorsuch, in a 2022 dissent, slammed the doctrine as \u201cplac[ing] a finger on the scales of justice in favor of the most powerful of litigants, the federal government, and against everyone else.\u201d<\/p>\n<p>\u201cRather than say what the law is, we tell those who come before us to go ask a bureaucrat,\u201d he added. <\/p>\n<p>Trump\u2019s appointees at agencies such as the Department of Education or the Environmental Protection Agency might have less influence if there is no <em>Chevron<\/em> doctrine during a second Trump administration, but the ruling would still be widely seen as a win for Republicans.<\/p>\n<p>\u201cLess well understood [during the Reagan era] was the extent to which administrative agencies tend in the main to be committed to a policy of maximization,\u201d said Heritage Foundation legal fellow Jack Fitzhenry. \u201cThe tendency has been for agencies to adopt policies that push at the outer boundaries of the law.\u201d<\/p>\n<p>Someone who has chosen to spend a career working at the EPA, Fitzhenry argued, is likely to have a high degree of commitment toward furthering its mission.<\/p>\n<p>The cases before the high court, <em>Loper Bright Enterprises v. Raimondo<\/em> and<em> Relentless, Inc. v. Department of Commerce<\/em>, were brought by two fishing companies challenging a National Marine Fisheries Service mandate that forces their fishing companies to pay and house at-sea herring monitors. <a href=\"https:\/\/www.nationalfisherman.com\/national-international\/supreme-court-hears-fishermen-s-challenge-that-could-upend-agency-powers\">Commercial<\/a> <a href=\"https:\/\/www.nationalfisherman.com\/national-international\/supreme-court-hears-fishermen-s-challenge-that-could-upend-agency-powers\" target=\"_blank\" rel=\"noreferrer noopener\">fishers in the Northeast<\/a> can pay upward of $700 a day to hire outside observers they are now required to have on board.<\/p>\n<p>Opponents of <em>Chevron<\/em> argue it would give too much power to the judiciary branch, with Justice Ketanji Brown Jackson cautioning the courts could become \u201cuber legislators,\u201d bringing back the problems that led to <em>Chevron<\/em> in the first place.<\/p>\n<p>If the Supreme Court strikes down the precedent, the outcome of the presidential contest could affect the immediate future of administrative power because whoever wins will be able to appoint judges to various federal courts. Biden has <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/2989071\/biden-remaking-courts-counter-trump\/\" target=\"_blank\" rel=\"noopener\" title=\"outpaced Trump\">outpaced Trump<\/a> in this regard and would be able to continue appointing more progressive-minded judges if reelected.<\/p>\n<p>The Trump and Biden campaigns did not respond to a request for comment from the <em>Washington Examiner.<\/em><\/p>\n<p>The Center for American Progress <a href=\"https:\/\/www.americanprogress.org\/article\/supreme-court-appears-poised-to-overrule-chevron-deference-in-judicial-power-grab\/\" target=\"_blank\" rel=\"noopener\" title=\"warned\">warned<\/a> in an analysis that overturning <em>Chevron<\/em> \u201ccould upend 40 years of administrative jurisprudence, impede the federal government\u2019s ability to effectively serve the American people, and allow the federal judiciary to amass unchecked levels of power.\u201d<\/p>\n<p>But conservatives argue that it\u2019s Congress that would be empowered, as it would need to be more clear in its intentions when crafting new laws. <\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Mike Berry of the America First Policy Institute holds that it\u2019s the \u201cadministrative state\u201d that stands to lose. <\/p>\n<p>\u201cIt\u2019s important to keep in mind that the administrative state controls and influences more of our daily lives than do the other branches of government,\u201d Berry said. \u201cDespite the sky-is-falling scenarios presented by <em>Chevron<\/em>\u2018s defenders, America is much better off under the separation of powers framework our Founders established.\u201d<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The fate of the administrative state is uncertain as Supreme Court justices deliberate on potentially overturning the longstanding Chevron deference in upcoming cases.
