The lawsuit claims that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/san-francisco-officials-declare-acronyms-racist\/\" title=\"San Francisco Officials Declare Acronyms Racist\">school district&#8217;<\/a>s policies, which include mandates\u2064 about using preferred pronouns for individuals, \u200deffectively constitute &#8220;speech codes&#8221; that \u200ddiscriminate based on viewpoint, compel speech, and prohibit a wide range \u2063of protected speech using vague language that is difficult for students to understand. \u200bThe policies in question have been argued to unconstitutionally restrict students&#8217; ability to express themselves freely and \u2064require them to endorse views endorsed by the district at all times, both within and\u200c outside of school settings. Parents Defending Education, representing various parents within the\u200c district, \u200dseeks\u200c a judicial \u2063verdict that several specific district policies are unconstitutional.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">A parental rights group filed a federal lawsuit on Wednesday accusing a <a href=\"https:\/\/www.dailywire.com\/topic\/new-york\" target=\"_blank\" rel=\"noopener\">New York<\/a> school district of establishing \u201cspeech codes\u201d that violate the <a href=\"https:\/\/www.dailywire.com\/topic\/first-amendment\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a> rights of conservative students, according to documents first shared with The Daily Wire.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The suit was filed by Parents Defending Education against Croton-Harmon Union Free School District north of New York City over its harassment and discrimination policies. It argues that the First and Fourteenth Amendment rights of students have been violated by the policies, which include requirements for students to use the \u201cpreferred pronouns\u201d of others.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe District has adopted multiple \u2018harassment\u2019 policies that prohibit a broad swath of controversial speech at the heart of the First Amendment,\u201d the <a href=\"https:\/\/defendinged.org\/wp-content\/uploads\/2024\/06\/1_Complaint.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> says. \u201cIn so doing, the District unconstitutionally discriminates based on viewpoint, requires a student to affirm another student\u2019s gender identity when inconsistent with that student\u2019s sex, prohibits a substantial amount of protected speech, and uses vague terms that an average student cannot understand.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The lawsuit was filed in U.S. District Court for the Southern District of New York. The suit is asking for the judge to rule that the <a href=\"https:\/\/defendinged.org\/wp-content\/uploads\/2024\/06\/PDEvCHExhibits.pdf\" target=\"_blank\" rel=\"noopener\">district policies<\/a> 0110, 0110-R, 0115, 0115-R, 0115-E, 5300, 4526, and 4526-R are unconstitutional. These policies \u201cpunish students for their speech and compel them to mouth support for the District\u2019s preferred views at all times of day, whether at school or not,\u201d according to the suit.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In the suit, Parents Defending Education noted that its members included multiple parents who had students in the district who felt like their ability to speak freely had been restricted.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The challenged policies describe discrimination as including \u201crestrictions on the use of names or pronouns,\u201d and include an acceptable use policy for electronics about the sending of \u201chate mail.\u201d Additionally, the policies restrict speech determined to be \u201coffensive,\u201d \u201cdisparaging,\u201d \u201cdegrading,\u201d \u201cderogatory,\u201d \u201cintimidating,\u201d or \u201cdemeaning.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to Parents Defending Education, the policies are overly broad and allow students to be punished for their conservative opinions.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cSpeech codes punish students for unpopular speech labeled as \u2018harassment,\u2019 \u2018bullying,\u2019 \u2018hate speech,\u2019 or \u2018incivility\u2019 \u2014 categories so broad that school officials can use them to ban speech based on one\u2019s firmly held views including religious views, or to compel speech contrary to those views,\u201d the suit says. \u201cWhen these policies impose vague, overbroad, or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/a-small-business-complained-about-crime-in-chicago-then-the-feds-came-after-it\/\" title=\"Small business in Chicago complains about crime, faces federal consequences.\">viewpoint-based restrictions<\/a> on speech, they are unconstitutional.\u201d<\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">Parents Defending Education has been active across the country in efforts to push for accountability and transparency at public schools.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cOver the past century, the Supreme Court has <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-ag-nominee-wont-commit-to-keeping-durham-as-special-counsel\/\" title=\"Biden\u2019s AG nominee won\u2019t commit to keeping Durham as special counsel\">made abundantly clear<\/a> that students have robust First Amendment rights \u2013 and that education officials may not trample on these rights at their pleasure,\u201d Parents Defending Education President Nicole Neily said in a statement to The Daily Wire. \u201cSilencing unpopular viewpoints and compelling the speech of students in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sf-school-board-president-accuses-mayor-of-division-for-criticizing-renaming-re-opening-plans\/\" title=\"SF School Board President Accuses Mayor Of \u2018Division\u2019 For Criticizing Renaming, Re-Opening Plans\">public school system<\/a> is fundamentally un-American.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Croton-Harmon Union Free School District did not respond to a request for comment.<\/span><\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A parental rights organization, Parents Defending Education, filed a federal lawsuit against Croton-Harmon Union Free School District in New York.
