The House&#8217;s contempt \u2063action might \u200dlead to a DOJ case against Garland, potentially resulting in prison time \u200band\u2062 fines,\u2064 though a DOJ memo suggests Garland might be \u200blegally protected.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The GOP-led <a href=\"https:\/\/www.dailywire.com\/topic\/u-s-house-of-representatives\" target=\"_blank\" rel=\"noopener\">House<\/a> passed a resolution on Wednesday to hold Attorney General <a href=\"https:\/\/www.dailywire.com\/topic\/merrick-garland\" target=\"_blank\" rel=\"noopener\">Merrick Garland<\/a> in contempt of Congress for withholding subpoenaed recordings from the investigation into President <a href=\"https:\/\/www.dailywire.com\/topic\/joe-biden\" target=\"_blank\" rel=\"noopener\">Joe Biden<\/a>\u2018s handling of classified documents led by special counsel <a href=\"https:\/\/www.dailywire.com\/topic\/robert-hur\" target=\"_blank\" rel=\"noopener\">Robert Hur<\/a>.<\/p>\n<p>In a vote <a href=\"https:\/\/x.com\/CraigCaplan\/status\/1800993155715678335\" target=\"_blank\" rel=\"noopener\">largely party-line vote<\/a>, 216 Republicans backed the measure while 206 Democrats and one Republican opposed it. Eight members, including one Republican and seven Democrats, did not vote. Rep. Dave Joyce (R-OH) was the <a href=\"https:\/\/x.com\/liz_elkind\/status\/1800993131959112057\" target=\"_blank\" rel=\"noopener\">sole<\/a> Republican who <a href=\"https:\/\/x.com\/AndrewSolender\/status\/1800993826602967454\" target=\"_blank\" rel=\"noopener\">voted against the resolution<\/a>.<\/p>\n<p>\u201cWe can\u2019t allow the Department of Justice, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pelosi-slammed-while-blaming-others-for-end-of-eviction-moratorium-is-your-memory-as-bad-as-joes\/\" title=\"Pelosi Slammed While Blaming Others For End Of Eviction Moratorium: \u2018Is Your Memory As Bad As Joe\u2019s?\u2019\">executive branch agency<\/a>, to hide information from Congress. We have important oversight responsibilities, and that is what is being pursued here,\u201d Speaker Mike Johnson (R-LA) said during a <a href=\"https:\/\/www.youtube.com\/watch?v=fj9OAG1mvkg\" target=\"_blank\" rel=\"noopener\">press conference<\/a> before the vote on Wednesday.<\/p>\n<p>Garland drew the ire of Republicans for not fully complying with two subpoenas that demanded tapes of Hur\u2019s two-day interview with Biden and of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/roger-stone-announces-he-will-sue-those-who-arrested-him-and-put-him-in-front-of-a-kangaroo-court\/\" title=\"Roger Stone Announces He Will Sue Those Who Arrested Him and Put Him In Front of a Kangaroo Court\">special counsel\u2019<\/a>s interview with Biden\u2019s ghostwriter, Mark Zwonitzer, arguing that such a request would <a href=\"https:\/\/www.dailywire.com\/news\/garland-under-threat-of-contempt-calls-house-gops-request-for-biden-tapes-illegitimate\" target=\"_blank\" rel=\"noopener\">impede future investigations<\/a>.<\/p>\n<p>Contempt of Congress proceedings <a href=\"https:\/\/www.dailywire.com\/news\/house-judiciary-to-begin-contempt-proceedings-against-garland-over-biden-docs-probe-audio\" target=\"_blank\" rel=\"noopener\">have been going on<\/a> since last month and Biden <a href=\"https:\/\/www.dailywire.com\/news\/biden-asserts-executive-privilege-over-tapes-in-docs-probe\" target=\"_blank\" rel=\"noopener\">asserting<\/a> executive privilege over the tapes failed to quell that endeavor. Judiciary Chairman Jim Jordan (R-OH) <a href=\"https:\/\/www.dailywire.com\/news\/house-judiciary-to-begin-contempt-proceedings-against-garland-over-biden-docs-probe-audio\" target=\"_blank\" rel=\"noopener\">said<\/a> Republicans believe such privilege got waived when the transcripts were released.<\/p>\n<p>The contempt resolution could, in theory, prompt a Department of Justice (DOJ) case that <a href=\"https:\/\/apnews.com\/article\/garland-contempt-biden-classified-documents-justice-department-bc2fb71b225ae672eb257ee2055cfa67\" target=\"_blank\" rel=\"noopener\">could result in Garland facing<\/a> up to a year of prison time and as much as $100,000 in fines. However, a DOJ memo obtained by The Hill <a href=\"https:\/\/thehill.com\/homenews\/house\/4718115-garland-contempt-doj-memo\/\" target=\"_blank\" rel=\"noopener\">insists<\/a> Garland is shielded from prosecution because of privilege.<\/p>\n<p>The report from Hur\u2019s team described Biden as a \u201csympathetic, well-meaning, elderly man with a poor memory\u201d whom a jury likely would not convict \u201cof a serious felony that requires a mental state of willfulness.\u201d Prosecutors ultimately declined to recommend charges against the president.<\/p>\n<p>Hur also found that Zwonitzer deleted recordings of conversations with Biden upon learning about the documents inquiry. <b><\/b>But the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/garland-risks-contempt-of-congress-as-doj-spurns-house-gop-demand-for-biden-audio\/\" title=\"Garland faces potential contempt of Congress as DOJ rejects House GOP's request for Biden audio\">ghostwriter provided \u201cplausible<\/a>, innocent reasons\u201d for his actions during the interview and Hur\u2019s team said they ultimately determined the evidence would not suffice for a conviction on obstruction of justice, according to the special counsel report.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1715949071524000&#038;usg=AOvVaw1epNxV4INiQhMMvO61rHiP\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Biden rejected Hur\u2019s characterizations in his report, but Garland insisted that it would have been <a href=\"https:\/\/www.dailywire.com\/news\/garland-says-censoring-hurs-biden-docs-report-would-have-been-absurd\" target=\"_blank\" rel=\"noopener\">\u201cabsurd\u201d<\/a> for someone in his position to have edited or censored the special counsel\u2019s explanation.<\/p>\n<p>The fight over the Hur probe audio comes as Biden is running for a second term, paving the way toward another face-off against former President Donald Trump, who faces his own classified records case and was just <a href=\"https:\/\/www.dailywire.com\/news\/verdict-trump-found-guilty-on-all-charges-in-hush-money-case\" target=\"_blank\" rel=\"noopener\">convicted<\/a> in a hush-money trial in New York.
