Following his conviction, Hunter\u2063 Biden\u2019s \u200blegal team is contemplating an appeal that might reach\u2064 the Supreme too, bolstered by a circuit court decision potentially favoring his Second Amendment rights.<\/p>\n<p>At the heart of Hunter\u2019s potential appeal is recent \u200bjudicial skepticism about the\u200b constitutionality of Section 922(g) of\u200b the federal law, which restricts gun ownership\u2064 based on certain criteria including drug use. These legal developments \u2064place President Biden in a precarious spot \u2064as he navigates support for his son \u200bwhile advocating for an agenda that includes\u200d bans on \u2063assault weapons and other stringent \u2063gun control measures. Both Hunter\u2019s potential appeals and other\u200c related cases\u2062 could prompt the Supreme Court to\u2062 review\u2064 and possibly reshape existing gun laws,\u2063 adding \u2063pressure on President Biden&#8217;s political and paternal commitments.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Joe Biden<\/a> could be forced to walk a thin line to promote his gun control agenda while his son <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/hunter-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hunter Biden<\/a>\u2018s legal team considers appealing the first son\u2019s conviction on gun-related charges all the way to the Supreme Court.<\/p>\n<p>Hours after a jury convicted the younger Biden on Tuesday of lying on a federal form to purchase a gun by asserting he was not a drug user, lying to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-strategy-for-combating-surge-in-crime-focuses-largely-on-combating-gun-violence\/\" title=\"Biden\u2019s Strategy For Combating Surge In Crime Focuses Largely On Combating \u2018Gun Violence\u2019\">federally licensed firearm dealer<\/a>, and illegally owning the gun\u00a0for 11 days, the president spoke before Everytown for Gun Safety\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3037512\/biden-touts-gun-restrictions-hunter-firearm-verdict\/\" target=\"_blank\" rel=\"noreferrer noopener\">annual conference<\/a>,\u00a0in which he bragged about his executive actions on gun restrictions and reinforced his support of an all-out ban on <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2024\/06\/11\/remarks-by-president-biden-at-everytowns-gun-sense-university\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cassault weapons.\u201d<\/a><\/p>\n<figure><figcaption>President Joe Biden talks with his son Hunter Biden as he arrives at Delaware Air National Guard Base in New Castle, Delaware, on Tuesday, June 11, 2024. (AP Photo\/Manuel Balce Ceneta)<\/figcaption><\/figure>\n<p>\u201cMy predecessor told the [National Rifle Association] convention recently he\u2019s proud that \u2018I did nothing on guns when I was president,\u2019 and by doing nothing, he made the situation considerably worse,\u201d Joe Biden said, referring to former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a>\u2018s remarks at an NRA convention earlier this year.<\/p>\n<p>Following the Supreme Court\u2019s summer 2022 decision in<em> New York Rifle &#038; Pistol Association<\/em> <em>v.<\/em> <em>Bruen<\/em>, which expanded constitutional protections for the Second Amendment, Joe Biden said he was \u201cdisappointed\u201d by the ruling, arguing it \u201ccontradicts both common sense and the Constitution, and should deeply trouble us all.\u201d<\/p>\n<p>But it is through the <em>Bruen <\/em>precedent that Joe Biden\u2019s son may have a fighting chance to challenge Section 922(g),\u00a0which creates nine disqualifiers for gun ownership, including unlawful use or addiction to a controlled substance. District courts in Texas and Oklahoma, along with a ruling by the Louisiana-based U.S. Court of Appeals for the 5th Circuit, have flung into question whether Section 922(g) will survive the Supreme Court\u2019s new test.<\/p>\n<p>Jake Charles, a professor at Pepperdine Caruso School of Law, said Hunter Biden has a \u201cplausible\u201d Second Amendment claim for the unlawful possession count given the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1372372\/federal-gun-law-used-in-hunter-biden-case-voided-by-appeals-court\/\" target=\"_blank\" rel=\"noopener\" title>5th Circuit\u2019s decision<\/a> in a case known as <em>U.S. v. Daniels<\/em>. Last August, the 5th Circuit voided <a href=\"https:\/\/www.justice.gov\/sites\/default\/files\/usao-ut\/legacy\/2013\/06\/03\/guncard.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Section 922(g)(3)<\/a>, which punishes anyone who is an \u201cunlawful user of or addicted to any controlled substance\u201d in possession of a firearm by up to 10 years in prison.<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Hunter has a plausible Second Amendment claim for the unlawful possession count, given that some other courts (5th Circuit ofc) have said that law is unconst&#8217;l in some settings. But the charges for lying in the process aren&#8217;t gonna be ruled unconst&#8217;l.<a href=\"https:\/\/t.co\/387O4jXWXw\">https:\/\/t.co\/387O4jXWXw<\/a> <a href=\"https:\/\/t.co\/9Bb5hjUALv\">pic.twitter.com\/9Bb5hjUALv<\/a><\/p>\n<p>\u2014 Jake Charles (@JacobDCharles) <a href=\"https:\/\/twitter.com\/JacobDCharles\/status\/1800558005660070320?ref_src=twsrc%5Etfw\">June 11, 2024<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<p>But Charles posted to X that Hunter Biden\u2019s charges for merely lying on the form most likely \u201caren\u2019t gonna be ruled unconstitutional.\u201d<\/p>\n<p>The same day the president delivered his speech underscoring his efforts to impose stricter federal gun control policies, Hunter Biden\u2019s attorney Abbe Lowell vowed to \u201ccontinue to vigorously pursue all the legal challenges available to Hunter.\u201d<\/p>\n<p>Charles said it may not even be Hunter Biden\u2019s appeal that causes the Supreme Court to weigh in on the constitutionality of Section 922(g) because his case is much further behind in the appeals process. The <em>Daniels <\/em>appeal is already pending before the Supreme Court, so the justices could decide to take that case rather than wait for the younger Biden\u2019s case to develop.<\/p>\n<p>Joe Biden\u2019s tightrope between supporting his son and supporting his party\u2019s gun control efforts could soon become thinner. The Supreme Court is just days away from releasing a decision in the case <em>U.S. v. Rahimi<\/em>, which asks the court whether a person who is under a civil domestic violence restraining order is barred from owning a firearm, which is a violation of Section 922(g)(8).<\/p>\n<p>If the Supreme Court were to rule in favor of <em>Rahimi<\/em>, it could give the president\u2019s son the ammunition he needs to invalidate one of the disqualifiers that landed him a guilty verdict on one of the three counts he faced before a jury in Delaware federal court. But even if <em>Rahimi <\/em>fails to challenge Section 922(g)(8), the younger Biden might still have hope through the <em>Daniels <\/em>precedent.<\/p>\n<p>Meanwhile, the president has made no secret about his love and support of his son \u2014 and his desire for Hunter Biden to be found innocent. But the political realities of representing the Democratic Party in the presidential election mean Joe Biden is likely to continue his tirade against guns in public, while behind the scenes, the Republican-appointed majority on the Supreme Court could become Hunter Biden\u2019s saving grace.<\/p>\n<p>Meanwhile, some Republican lawmakers are already becoming strange bedfellows with the president\u2019s son after his guilty conviction, as many on the Right see the law behind Hunter Biden\u2019s conviction as wrong in the wake of the Supreme Court\u2019s embrace of strict scrutiny against gun control measures.<\/p>\n<p>Rep. Thomas Massie (R-KY) posted to X on Tuesday that \u201cHunter might deserve to be in jail for something, but purchasing a gun is not it,\u201d adding that \u201cthere are millions of marijuana users who own guns in this country, and none of them should be in jail for purchasing or possessing a firearm against current laws.\u201d<\/p>\n<p>During oral arguments on Nov. 7 over <em>Rahimi<\/em>,<em> <\/em>a majority on the high court <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2586217\/supreme-court-threads-needle-between-gun-rights-and-limits-for-domestic-abusers\/\" target=\"_blank\" rel=\"noreferrer noopener\">seemed poised<\/a> to uphold parts of the federal law barring domestic violence offenders from possessing guns. However, it is possible the justices could rule in a way that limits how the prohibition applies to people courts deem dangerous.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Deciding <em>Rahimi <\/em>could also result in the justices sending cases such as <em>Daniels <\/em>back to the appeals court level to apply a new standard to Section 922(g), though it remains to be seen whether the justices will offer specific instruction pertaining to similar cases.<\/p>\n<p>A decision in the case is expected by the end of June but could come as soon as Thursday or Friday this week, as the Supreme Court is poised to release more opinions.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Joe Biden faces a delicate balance in advancing his gun control agenda as his son, Hunter Biden, contemplates appealing his gun-related conviction to the Supreme Court.
