The ruling came as a result of a lawsuit filed by Texas Attorney General Ken Paxton in June 2023, in response to a\u200b 2021 guidance from the\u2062 Biden administration&#8217;s Education Department. \u200bThis guidance aimed to enforce Title \u200bIX to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kamala-and-biden-continue-their-war-against-american-women-and-children\/\" title=\"Kamala And Biden Continue Their War Against American Women And Children\">prevent discrimination based<\/a>\u2064 on sexual orientation\u200c and gender identity\u2062 in schools that\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mayo-clinic-debuts-woke-policies-including-wearable-pronoun-buttons\/\" title=\"Mayo Clinic Debuts Woke Policies Including Wearable Pronoun Buttons\">receive federal funding<\/a>, potentially affecting policies on bathroom access \u2062and \u2064sports team participation based on gender identity.<\/p>\n<p>Judge\u2062 O\u2019Connor stated in his\u200b 112-page ruling that Title IX does not explicitly prohibit\u2063 discrimination on these grounds and\u200d allows for sex-based differentiation in certain cases, such as intimate facilities and athletic teams, based on \u200bbiological sex. The judge argued \u200dthat \u2064including gender identity under discrimination based on sex was not a logical interpretation of Title IX. This decision supports Texas&#8217;s position \u2063against the broader federal interpretation of sex discrimination to include gender identity and sexual orientation.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">A federal judge ruled on Tuesday that <a href=\"https:\/\/www.dailywire.com\/topic\/texas\" target=\"_blank\" rel=\"noopener\">Texas<\/a> did not have to follow guidance from the <a href=\"https:\/\/www.dailywire.com\/topic\/biden-administration\" target=\"_blank\" rel=\"noopener\">Biden administration<\/a> which interpreted prohibitions against sex discrimination to include gender identity and sexual orientation. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The judge ruled that Biden\u2019s Education Department had unlawfully exceeded its authority when it issued guidance in 2021 that opened up the door for schools to be liable for discrimination if they adopted policies like limiting bathroom access on the basis of sex. Texas Attorney General Ken Paxton sued the Biden administration in June 2023 to shield Texas from enforcement of the policy. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cNothing in the statute expressly prohibits discrimination based on gender identity or other unexpressed grounds,\u201d U.S. District Judge for the North District of Texas Reed O\u2019Connor wrote in a <\/span><a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Title%20IX%20Guidance%20Injunction%20Order.pdf\"><span style=\"font-weight: 400\">112-page ruling<\/span><\/a><span style=\"font-weight: 400\">. \u201cAnd where Title IX allows for differentiation based on sex due to biological differences \u2014 such as intimate facilities and athletic teams \u2014 recipients may treat persons in accordance with their biological sex without regard to subjective gender identity.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Paxton\u2019s lawsuit came after the Education Department released a memo on June 22, 2021, <a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/06\/22\/2021-13058\/enforcement-of-title-ix-of-the-education-amendments-of-1972-with-respect-to-discrimination-based-on\" target=\"_blank\" rel=\"noopener\">saying<\/a> that it \u201cinterprets Title IX\u2019s prohibition on discrimination \u2018on the basis of sex\u2019 to encompass discrimination on the basis of sexual orientation and gender identity.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The department also said that it would \u201cfully enforce Title IX to prohibit discrimination based on sexual orientation and gender identity in education programs\u201d for schools that receive federal funding. This means schools could face legal challenges if they had policies in place that said transgender-identifying students would have to use the bathroom facility or play on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gender-clinic-sends-legal-demand-after-being-exposed\/\" title=\"\"Gender Clinic\" Sends Legal Demand After Being Exposed\">sports team based<\/a> on sex.  <\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge O\u2019Connor disagreed with the Education Department, saying that it was not logical to include gender identity under sex. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cTitle IX explicitly appreciates the innate biological variation between men and women that occasionally warrants differentiation \u2014 and even separation \u2014 to preserve educational opportunities and to promote respect for both sexes,\u201d the George W. Bush appointee wrote. <\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">The guidance is different from the widely challenged <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/us-department-education-releases-final-title-ix-regulations-providing-vital-protections-against-sex-discrimination#:~:text=The%20final%20rule%20requires%20schools,and%20not%20otherwise%20impermissible%20evidence.\" target=\"_blank\" rel=\"noopener\">Title IX rules<\/a> unveiled in April that officially add gender identity and sexual orientation into federal education discrimination law. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-major-win-blocking-biden-administrations-attempt-force\" target=\"_blank\" rel=\"noopener\">celebrated<\/a> the judge\u2019s decision, saying Biden\u2019s guidance was dangerous. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cJoe Biden\u2019s unlawful effort to weaponize Title IX for his extremist agenda has been stopped in its tracks,\u201d Paxton said in a statement on Tuesday night. \u201cThreatening to withhold education funding by forcing states to accept \u2018transgender\u2019 policies that put women in danger was plainly illegal.
