Under both the Obama \u2062and Biden administrations, efforts were made to redefine the law\u2019s interpretation, \u2063facing criticism\u200d for potentially undermining biological women&#8217;s rights in sports.<\/p>\n<p>In 2022, new opposition arose against these \u200dredefinitions from various attorneys general, claiming the changes jeopardized\u200c the essence of Title IX. In June 2023, Texas filed a lawsuit\u2064 arguing \u2064the Biden administration\u2019s guidance was overreaching by including &#8220;sexual orientation&#8221; and \u2062&#8221;gender identity&#8221; as protected\u2062 classes under Title IX. \u2063This led to other similar filed lawsuits by multiple states.<\/p>\n<p>The ruling\u2063 issued by Judge Reed O\u2019Connor of the U.S. District Court in Texas \u2063concluded that the federal government&#8217;s imposition of new interpretations on \u200bstate \u2063educational institutions\u200d was unlawful under\u200b federal law. This \u200cdecision marks a significant moment in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-weighs-second-amendment-rights-for-domestic-violence-offenders\/\" title=\"Supreme Court considers Second Amendment rights of domestic violence offenders.\">ongoing legal debate<\/a> over Title IX and\u200d its scope of protection.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2013 A federal court on Tuesday handed Texas its first win in a lawsuit filed against the Biden administration over a mandate issued by two federal agencies before the administration amended Title IX to redefine biological sex to include \u201csexual orientation\u201d and \u201cgender identity.\u201d<\/p>\n<p>Title IX, which is part of the Education Amendments Act of 1972, states, \u201cNo person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.\u201d<\/p>\n<p>The law was enacted at a time when women and girls had limited athletic opportunities. \u201cBefore Title IX, few opportunities existed for female athletes,\u201d according to <a href=\"http:\/\/history.com\/\">History.com<\/a>. After Title IX, participation in female sports increased exponentially, the girl\u2019s high school dropout rate decreased and the number of women pursuing higher education and who completed college degrees increased, it says.<\/p>\n<p>Under the Obama and Biden administrations, regulatory efforts sought to redefine sex to include \u201csexual orientation\u201d and \u201cgender identity\u201d by providing an unfair advantage to biological boys and men wanting to compete in women\u2019s sports, a coalition of attorneys general have argued. In 2022, they <strong><a href=\"https:\/\/www.thecentersquare.com\/montana\/article_53fe0ad0-b737-11ec-be7f-b7b8ca0f8e16.html\" target=\"_blank\" rel=\"noreferrer noopener\">opposed<\/a><\/strong> a Biden administration plan to reimpose Obama-era changes to Title IX that the Trump administration ended.<\/p>\n<p>Despite widespread opposition, including from women\u2019s groups, the Biden administration began amending Title IX through several methods, arguing doing so would \u201cadvance educational equity and opportunity for women and girls across the country.\u201d<\/p>\n<p>It proposed a rule change to change the law and issued mandates through the U.S. Department of Education and Department of Justice, agencies responsible for administering and enforcing Title IX.<\/p>\n<p>In response to the proposed rule changes, a coalition of 18 AGs <strong><a href=\"https:\/\/www.thecentersquare.com\/national\/article_66bea966-fc94-11ec-b4d6-97343ea5f13e.html\" target=\"_blank\" rel=\"noreferrer noopener\">pushed back<\/a><\/strong>, arguing the changes \u201cdemolished\u201d women\u2019s and girls\u2019 rights, \u201cmaking a mockery of Title IX\u2019s fundamental organization principle \u2013 basic biology.\u201d<\/p>\n<p>In response to the agency mandates, in June 2023, Texas sued, arguing agency guidance was \u201carbitrary and capricious\u201d and \u201cunlawfully extended Title IX to include \u2018sexual orientation\u2019 and \u2018gender identity\u2019 as protected classes.\u201d<\/p>\n<p>Earlier this year, after the Biden administration formalized its rule change to Title IX, multiple states sued. Texas filed its own lawsuit. Louisiana, Mississippi, Montana and Idaho filed a separate lawsuit. Alabama, Florida, Georgia and South Carolina filed a third lawsuit, The Center Square <strong><a href=\"https:\/\/www.thecentersquare.com\/national\/article_7af42b28-065a-11ef-a6bd-ebc4c06134c7.html\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a><\/strong>.<\/p>\n<p>On Tuesday, the first court ruling handed Texas a win, setting a precedent for rulings to come.<\/p>\n<p>Judge Reed O\u2019Connor, presiding over the U.S. District Court Northern District of Texas Fort Worth Division, said the issue he was asked to rule on was \u201cwhether the federal government may lawfully impose conditions on a state\u2019s educational institutions by purporting to interpret Title IX of the 1972 Educational Amendments as prohibiting discrimination based on sexual orientation and gender identity.\u201d<\/p>\n<p>\u201cThe court concludes that Defendants cannot regulate state educational institutions in this way without <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cdc-exposed-inflated-covid-deaths-by-1600-throughout-the-election-violated-multiple-federal-laws-peer-reviewed-study-findsstate-local-governments-must-act\/\" title=\"CDC Exposed: Inflated Covid Deaths By 1600% Throughout The Election, \u201cViolated Multiple Federal Laws\u201d Peer-Reviewed Study Finds\u2026State, Local Governments Must Act\">violating federal law<\/a>,\u201d he wrote in his <strong><a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Title%20IX%20Guidance%20Injunction%20Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">112-page ruling<\/a><\/strong>. He also said the DOE and DOJ \u201cengaged in unlawful agency action taken in excess of their authority, all while failing to adhere to the appropriate notice and comments requirements when doing so.\u201d<\/p>\n<p>O\u2019Connor chastised the agencies, saying they \u201cfailed to follow the proper procedures. Rather than promote the equal opportunity, dignity, and respect that Title IX demands for both biological sexes, [the DOE\u2019s] Guidance Documents do the opposite in an effort to advance an agenda wholly divorced from the text, structure, and contemporary context of Title IX.\u201d<\/p>\n<p>He said to allow the administration\u2019s \u201cunlawful action to stand would be to functionally rewrite Title IX in a way that shockingly transforms American education and usurps a major question from Congress. That is not how our democratic system functions.\u201d<\/p>\n<p>O\u2019Connor granted Texas\u2019 motion for summary judgement and denied the Biden administration\u2019s request to dismiss. He also vacated the guidance nationwide and issued a permanent injunction against its enforcement in Texas.<\/p>\n<p>The DOE\u2019s and DOJ\u2019s guidance \u201cwould have forced Texas schools and universities to allow biological males to use women\u2019s restrooms, locker rooms, and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/there-is-one-pro-women-camp-in-american-politics-and-its-the-right\/\" title=\"There Is One Pro-Women Camp In American Politics, And It\u2019s The Right\">sex-specific spaces<\/a>,\u201d Attorney General Ken Paxton said. \u201cAny Texas school refusing to follow the mandate risked losing federal education funding.\u201d<\/p>\n<p>The guidance, like the rule change, threatened to withhold federal education funding if states refuse to accept the administration\u2019s redefinition of sex and other stipulations.<\/p>\n<p>O\u2019Connor\u2019s ruling \u201censures that no school district in the State of Texas will have to comply with the Biden Administration\u2019s interpretation of Title IX as including gender-identity requirements, including allowing men into women\u2019s restrooms or locker rooms or sports teams, or requiring students or teachers to use pronouns based on gender identity rather than biological sex,\u201d Paxton said.<\/p>\n<p>The DOE and DOJ have yet to say if they will appeal the ruling.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal court ruled in favor of Texas in its lawsuit against the Biden administration regarding a mandate by two federal agencies.
