This is particularly concerning in situations\u2064 where a woman can auction her unborn child to the highest bidder on surrogacy forums or\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-this-average-american-is-voting-for-donald-trump\/\" title=\"Why This Average American Is Voting for Donald Trump\">social media<\/a>, with the transaction being legally binding as long \u200das it conforms \u200dwith\u2063 the stipulated <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/viral-video-reveals-the-true-dehumanizing-horror-of-surrogacy\/\" title=\"Discover the Harsh Reality of Surrogacy in a Compelling Video Gone Viral\">surrogacy agreement<\/a> requirements.<\/p>\n<p>The bill highlights a troubling area of surrogacy \u2064that blurs the \u200dlines between altruistic surrogate motherhood\u2064 and exploitative financial\u2062 transactions. The text \u200dcritiques how semantics are being used \u200dto disguise activities that would otherwise be\u200c considered \u200bunethical or illegal, like child trafficking. It also\u200b reflects\u2063 on historical abuses within surrogacy laws, \u200bsuch as a \u200cdocumented case \u2064in California where a surrogacy scam involved the illegal\u2064 sale of\u200c babies, underscoring\u200b the potential for misuse and exploitation \u200bwithin\u2063 the legal frameworks of surrogacy.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>On June 12, the Massachusetts House is expected to vote on a bill that would allow mothers to exchange their children for money\u2014that is, engage in baby-selling\u2014under the name of \u201cparentage equality.\u201d<\/p>\n<p>The <a href=\"https:\/\/malegislature.gov\/Bills\/193\/H4672\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cParentage Equality\u201d bill<\/a> seeks to redefine parenthood. Parenthood is recognized on its natural biological basis, or in cases of adoption, justice for a child who has suffered loss by providing them with a safe, loving home. This bill redefines it on the basis of a \u201cperson\u2019s intent to be a parent of a child.\u201d In doing so, it strips all mention of mothers and fathers from parentage law, replacing these vital familial roles with gender-erased language.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-849266903\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-539d1b10a6c68ba2df2af3206be9290f fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-539d1b10a6c68ba2df2af3206be9290f\"><\/div>\n<p>Finally, and most concerning, under H.4672, Massachusetts would allow for commercial surrogacy both in cases wherein the woman carrying the child is genetically unrelated to the child and in cases where she is exchanging her biological child for money.<\/p>\n<h2 class=\"wp-block-heading\"><strong>The \u2018Parentage Equality\u2019 Act Legalizes baby-selling<\/strong><\/h2>\n<p>Surrogacy is an inherently exploitative practice. It commodifies women and treats children as products. This specific bill enables particularly extreme arrangements. Most commercial surrogacy laws and surrogacy agencies restrict contracts to cases where the woman carrying the child is not genetically related to the child. Under genetic surrogacy arrangements, sanctioned by this bill, a woman would be allowed to accept money in exchange for her biological child.<\/p>\n<p>In any other circumstance, if a woman accepts money in exchange for handing over her parental claim on her child, she has engaged in baby-selling. Under this bill, she can do exactly that if she has secured a valid surrogacy contract, even if she makes the arrangement with the purchasing parents after she has become pregnant, providing the contract is validated before the child is born.<\/p>\n<p>Under H. 4672, the following would be perfectly legal: a woman undergoes the physical and mental health screenings required to become a surrogate, becomes pregnant via sperm from a sperm bank, and then posts to a surrogacy forum or social media group that she is not only available as a surrogate but already pregnant. <\/p>\n<div class=\"fdrlst__b89e9-c6a537793a2431ab268f666c992ee677 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-c6a537793a2431ab268f666c992ee677\"><\/div>\n<p>She could then choose to \u201cmatch\u201d with the couple willing to pay the highest \u201cpayment of consideration,\u201d essentially auctioning off her child. As long as the surrogacy agreement meets the requirements outlined in the bill, it could be validated by a court and viewed as not only permissible but legally binding. However, if that same woman became pregnant and decided to make an agreement with a couple to adopt her child, while insisting that she be paid for placing her child with them, she would be prosecuted for baby selling. <\/p>\n<p>The differences between these two scenarios are semantic, yet one would not only be legal and praised as \u201ccompassionate family building,\u201d but, should she hand the baby over to a same-sex couple, a step towards ending <a href=\"https:\/\/www.nbcnews.com\/news\/amp\/rcna151250\" target=\"_blank\" rel=\"noreferrer noopener\">discrimination<\/a>. By contrast, the other case would be derided as child trafficking, despite effectually producing the same result.<\/p>\n<p>No matter how much semantic gymnastics surrogacy proponents use, accepting money in exchange for a child is always wrong.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Surrogacy Laws Have a History of Abuse<\/strong><\/h2>\n<p>Before naysayers object that the above scenario sounds far-fetched, we have already seen the sale of children take place under the mantle of surrogacy. In 2011, three California women were convicted of<a href=\"https:\/\/www.fbi.gov\/news\/stories\/surrogacy-scam-played-on-victims-emotions\" target=\"_blank\" rel=\"noreferrer noopener\"> running an illegal baby-selling ring<\/a> under the guise of a surrogacy agency. <\/p>\n<div class=\"fdrlst__b89e9-117785430fdb9f057dd9c9340d1655c3 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-117785430fdb9f057dd9c9340d1655c3\"><\/div>\n<p>While the women did break California\u2019s surrogacy laws, the existence of legal surrogacy in California enabled them to operate undetected for years. As Dr. David Smolin<a href=\"https:\/\/digitalcommons.pepperdine.edu\/plr\/vol43\/iss2\/2\/\"> <\/a><a href=\"https:\/\/digitalcommons.pepperdine.edu\/plr\/vol43\/iss2\/2\/\" target=\"_blank\" rel=\"noreferrer noopener\">has pointed out<\/a>, this case would not have been possible without California\u2019s surrogacy law permitting the names of unrelated adults to be listed on a child\u2019s birth certificate without any adoption procedure.<\/p>\n<p>One of the most critical aspects of the scandal was that the women running the baby-selling ring filed fraudulent court documents saying that the agreements had been secured prior to pregnancy. The<a href=\"https:\/\/www.fbi.gov\/news\/stories\/surrogacy-scam-played-on-victims-emotions\"> FBI\u2019s <\/a><a href=\"https:\/\/www.fbi.gov\/news\/stories\/surrogacy-scam-played-on-victims-emotions\" target=\"_blank\" rel=\"noreferrer noopener\">statement on the case<\/a> reiterated that a surrogacy agreement must be in place before beginning surrogacy. Imagine how bad actors could exploit a law that allows surrogacy agreements after the pregnancy has begun.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Potential for Money in Exchange for Sex<\/strong><\/h2>\n<p>All the more troubling, Section 28N(d) of the bill addresses the scenario in which a child of surrogacy is alleged to have been conceived <em>not<\/em> through assisted reproduction, but by natural means. In this case, the court would order a genetic test to determine the parentage of a child. However, the bill states:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n[I]f the second genetic source is an intended parent, the court, in its sole discretion, may determine parentage under sections 1 through 27 of this chapter. <strong>Unless the genetic surrogacy agreement provides otherwise<\/strong>, the genetic surrogate is not entitled to any non-expense related compensation paid for acting as a surrogate if the child was not conceived by assisted reproduction. [Emphasis added.]\n<\/blockquote>\n<p>In other words, at the discretion of the courts, a surrogacy agreement could be considered valid in cases where a woman agrees to conceive the child naturally with the intended father\u2014that is, by having sex with him. By stipulating that \u201cunless the genetic surrogacy agreement provides otherwise,\u201d the bill leaves open the possibility of a surrogate being paid beyond expense-related compensation in this scenario.<\/p>\n<p>That\u2019s to say, this bill could allow a woman to accept money in exchange for sex as long as she conceives and then relinquishes her parental rights so the father could raise the child\u2014thus combining both prostitution and child trafficking in one terrible clause. <\/p>\n<p>What further abuses could this bill enable? <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/record-home-affairs-committee-more-india-vietnamese-b2530557.html\" target=\"_blank\" rel=\"noreferrer noopener\">Forced surrogacy is not a hypothetical concern<\/a>. Yet unseen exploitation of both women and children could occur so long as the flimsy requirements for a surrogacy agreement are met.<\/p>\n<p>Women and children are not commodities. Children have a right to be born free, not bought and sold. No amount of saccharine wording can mask the fact that the \u201cParentage Equality\u201d bill monetizes women\u2019s bodies and turns children into products.
