team&#8217;<\/a>s request to dismiss multiple charges.<\/p>\n<p>Trump&#8217;s \u2064lawyers also\u200b highlighted issues\u200b with how FBI agents handled the documents obtained\u200d from his \u200dMar-a-Lago property, claiming these actions violated Trump&#8217;s \u2062due process rights by \u200dnot \u200cpreserving the original order of documents, complicating their defense strategy. overseeing the trial of former President Donald Trump on charges of mishandling classified documents on Monday rejected a bid from Trump\u2019s lawyers to have multiple charges dismissed.<\/p>\n<p>U.S. District Judge <a href=\"https:\/\/www.westernjournal.com\/just-judge-hands-trump-massive-win-suspends-trial-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\">Alieen Cannon<\/a> did, however, strike one part of the indictment against Trump that claimed he showed a military map to a former aide who did not have sufficient clearance to view it, according to the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3036795\/cannon-rejects-trump-effort-dismiss-counts-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\">Washington Examiner<\/a>.<\/p>\n<p>In her <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648652\/gov.uscourts.flsd.648652.608.0.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> in the U.S. District Court for the Southern District of Florida, Cannon took a sour tone concerning the indictment brought by special counsel Jack Smith but said most of the claims from Trump did not rise to the level of tossing out the charges against him.<\/p>\n<p>\u201cThe identified deficiencies, even if generating some arguable confusion, are either permitted by law, raise evidentiary challenges not appropriate for disposition at this juncture, and\/or do not require dismissal even if technically deficient, so long as the jury is instructed appropriately and presented with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-cannon-rejects-trump-effort-to-dismiss-counts-against-him-in-classified-documents-case\/\" title=\"Judge Cannon denies Trump's request to dismiss charges in classified documents case\">adequate verdict forms<\/a> as to each Defendants\u2019 alleged conduct,\u201d she wrote.<\/p>\n<p>\u201cHaving reviewed these arguments in their totality and carefully considered the Superseding Indictment as a whole, the Court agrees that much of the language in the Superseding Indictment is legally unnecessary to serve the function of an indictment as explained in the foregoing caselaw,\u201d the judge said.<\/p>\n<p>\u201cThe Court also notes the risks that can flow from a prosecutor\u2019s decision to include in a charging document an extensive narrative account of his or her view of the facts, especially in cases of significant public interest,\u201d Cannon wrote.<\/p>\n<p>She said the allegation about <a href=\"https:\/\/www.westernjournal.com\/trump-strikes-fear-aoc-says-might-get-jail-time-absurd-meltdown-mind\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> showing the document to a person with a clearance was \u201cnot appropriate.\u201d<\/p>\n<p>The former president\u2019s legal team had objected to the section of the indictment, claiming he was charged with possessing certain documents, not showing them to others, according to the Examiner.<\/p>\n<p>The prosecution contended that the section was important to show Trump\u2019s cavalier attitude toward classified documents.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Will Trump beat these charges?<\/p>\n<\/p><\/div>\n<p>Although that challenge did not fully succeed, before the day ended, Trump\u2019s attorneys had launched another attack on the prosecution, according to <a href=\"https:\/\/www.nytimes.com\/2024\/06\/10\/us\/politics\/trump-documents-charges-cannon.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>.<\/p>\n<p>They argued FBI agents acted improperly after snaring boxes of documents in a raid on Trump\u2019s Mar-a-Lago property in Palm Beach, Florida, in August 2022.<\/p>\n<p>The filing said that the prosecution claimed the order of documents in the boxes was intact when it was not.<\/p>\n<p>The defense said the nature of how documents were stuffed in boxes showed the hurried and haphazard way the boxes were packed as the Trump administration left Washington in January 2021, and that by rearranging the contents of the boxes, the FBI had affected Trump\u2019s ability to use that in his defense.<\/p>\n<p>\u201cThe prosecution team violated President Trump\u2019s due process rights by failing to keep the documents intact and in the same order as they were found during the raid,\u201d the filing said.<\/p>\n<p>The prosecution has blamed the <a href=\"https:\/\/www.westernjournal.com\/jack-smiths-team-admits-tampered-key-evidence-trumps-case-misled-court\/\" target=\"_blank\" rel=\"noopener\">shifting of contents<\/a> on the size and nature of items in the boxes.<\/p>\n<p>But the detail is a big deal since part of Trump\u2019s defense is expected to be that documents were packed in chronological order, with no regard for classification marking, according to <a href=\"https:\/\/justthenews.com\/politics-policy\/all-things-trump\/trump-whodunnit-prosecutors-admit-key-evidence-document-case-has\" target=\"_blank\" rel=\"noopener\">Just the News<\/a>.<\/p>\n<p>\u201cProsecutors and investigators should never tamper with or alter evidence in their possession, including the order of documents in a box, because one never knows what may become relevant or crucial to a court or jury later in a case,\u201d Harvard Law Professor Emeritus Alan Dershowitz said.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our
