GOP\u2063 representatives and senators, using\u200b the Congressional Review Act,\u200b are actively working to rescind this regulation, \u2064arguing\u2062 it threatens\u200c Second Amendment rights by potentially paving the way for a \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/second-amendment-advocates-fear-biden-admin-will-limit-private-gun-sales\/\" title=\"Second Amendment supporters worry about potential restrictions on private gun sales under the Biden administration.\">national gun\u2062 registry<\/a> and gun\u2063 confiscation. \u200bHouse GOP leadership and key Senate Republicans are supporting legislative efforts to overturn the rule, maintaining that\u200d it\u2062 represents an overreach\u2062 of \u2062executive \u200cpower against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">law-abiding citizens<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Republican lawmakers are seeking ways to overturn a Biden administration rule aimed toward cracking down on so-called <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/2962382\/white-house-cracks-down-gun-show-loophole-new-rules\/\" target=\"_blank\" rel=\"noopener\" title>gun show loopholes<\/a> after the new mandate was used to cancel a gun show in Montana last month. <\/p>\n<p>The gun show in Hamilton, Montana, was canceled in response to the new Bureau of Alcohol, Tobacco, Firearms and Explosives rule, <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/04\/11\/fact-sheet-biden-harris-administration-announces-new-action-to-implement-bipartisan-safer-communities-act-expanding-firearm-background-checks-to-fight-gun-crime\/\" target=\"_blank\" rel=\"noopener\" title>which took effect on May 20<\/a> and requires vendors selling guns to be federally licensed and to conduct background checks \u2014 rules that are typically <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2987599\/paxton-leads-push-kill-effort-close-gun-loophole\/\" target=\"_blank\" rel=\"noopener\" title>not enforced at gun shows.<\/a><\/p>\n<p>The canceled event, which was supposed to take place on the <a href=\"https:\/\/www.mtssa.org\/mt-gun-show-cancelled-batfe-regulation\/\" target=\"_blank\" rel=\"noopener\" title=\"weekend of May 17 to 19\">weekend of May 17 to May 19<\/a>, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/severe-addiction-rise-feared-as-at-home-drinking-soars-in-lockdown-ireland\/\" title=\"Severe Addiction Rise Feared as At-Home Drinking Soars in Lockdown Ireland\">raised alarm bells<\/a> for some Republican lawmakers who warned the new rule could be used as a catalyst for the Biden administration to further restrict gun laws unilaterally. <\/p>\n<p>\u201cI think what people really need to understand is that the language is very subjective. It grants more authority to the ATF,\u201d Rep. Matt Rosendale (R-MT) told the <em>Washington Examiner<\/em>. \u201cAnd everyone should be concerned about that. The fact that we just had a gun show canceled, and specifically because of the uncertainties and possible criminal liabilities created by the new regulation \u2014 now we\u2019re not speaking about theory anymore. We\u2019re talking about the harsh realities, that this is just the tip of the iceberg.\u201d<\/p>\n<p>GOP lawmakers in both the House and Senate have long vowed to challenge the ATF rule, but the canceled gun show in Montana has sparked a new sense of urgency among several of these Republicans. <\/p>\n<p>There are two coinciding efforts in both chambers to overturn the rule through the Congressional Review Act, an obscure procedure that allows lawmakers to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-mount-challenge-to-biden-administration-crippling-labor-rule\/\" title=\"House Republicans Challenge Biden Administration's Labor Rule\">overturn final rules issued<\/a> by federal agencies. The method is rarely successful, only overturning a handful of rules since its inception in 1996. <\/p>\n<div>\n<p>House Republicans have repeatedly used the tool under the Biden administration since taking the majority last year, introducing more than a half dozen this Congress. President Joe Biden has vetoed more than nine CRAs during his time in the White House while signing into law three rules repealed under his administration.<\/p>\n<p>Now, Rep. Andrew Clyde (R-GA), <a href=\"https:\/\/clyde.house.gov\/news\/documentsingle.aspx?DocumentID=1476\">who is leading the effort in the House<\/a>, has called on lawmakers to back his measure to avoid future cancellations \u201cand additional trampling of Americans\u2019 Second Amendment liberties.\u201d<\/p>\n<\/div>\n<p>\u201cUnfortunately, we\u2019re already seeing the dire consequences of the ATF\u2019s \u2018engaged in the business\u2019 rule,\u201d Clyde told the <em>Washington Examiner. <\/em>\u201cThis measure marks President Biden\u2019s latest attempt to institute universal background checks \u2014 which I\u2019ve long warned will eventually lead to a nationwide firearms registry and subsequent gun confiscation.\u201d<\/p>\n<p>The resolution has received support from House GOP leadership, with Majority Leader Steve Scalise (R-LA) telling the <em>Washington Examiner <\/em>the rule is an example of the Biden administration \u201cweaponizing the administrative state against law-abiding American citizens.\u201d<\/p>\n<p>\u201c[Biden\u2019s] continued attacks on the Second Amendment, this time to restrict Americans\u2019 ability to buy and sell firearms to each other, undermines our constitutional rights,\u201d he said. \u201cHouse Republicans will continue to fight for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a> and push back against these attacks on the Second Amendment.\u201d<\/p>\n<p>A similar effort is being worked through in the Senate by Sens. John Cornyn (R-TX), Thom Tillis (R-NC), and 43 other Senate Republicans to overthrow the rule. However, that effort is likely to be stonewalled by the Democratic majority, meaning passage in the House could be crucial for the legislation to be sent to Biden\u2019s desk. <\/p>\n<p><a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/IF\/IF10023\" target=\"_blank\" rel=\"noopener\" title>Under congressional rules<\/a>, if a CRA joint resolution passes the House, Republican senators could force consideration of the measure through a discharge petition, which, if successful, would send the legislation to Biden for consideration. <\/p>\n<p>Even then, Biden could veto the CRA should it reach his desk. As a result, some lawmakers such as Rosendale acknowledged overturning the rule may not be possible during this Congress, suggesting future efforts under a possible Trump administration next year. <\/p>\n<p>Some state officials <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3009872\/texas-judge-blocks-biden-atf-rule-background-checks\/\" target=\"_blank\" rel=\"noopener\" title>have also opposed the new rule<\/a>, with a federal judge in Texas temporarily blocking the Biden administration from enforcing the mandate pending a challenge from Republican Texas Attorney General\u00a0Ken Paxton last month. <\/p>\n<p>\u201cI am relieved that we were able to secure a restraining order that will prevent this illegal rule from taking effect,\u201d Paxton said in a <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-temporary-restraining-order-against-biden-administration\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. The challenge to the ATF measure was also joined by the Gun Owners of America, a pro-Second Amendment group.<\/p>\n<p>Officials in Louisiana, Mississippi, and Utah also signed on to the lawsuit, but the temporary restraining order does not apply to other states. <\/p>\n<p>The <em>Washington Examiner <\/em>contacted a spokesperson for ATF about pushback to its rule.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Republican lawmakers are challenging a Biden administration rule designed to close gun show loopholes.
