She emphasized that such concerns, even if technically\u2063 flawed, do not necessitate dismissal provided the \u2062jury receives correct instructions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Judge Alieen Cannon, who is presiding over <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a>\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\/\" target=\"_blank\" rel=\"noopener\" title>classified documents<\/a> case in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noopener\" title>Florida<\/a>, denied a request from the former president to dismiss some of the charges in the indictment.<\/p>\n<p>Trump and his co-defendants sought to have several of the 41 indictments thrown out, but Cannon refused. However, she did <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648652\/gov.uscourts.flsd.648652.608.0.pdf\" target=\"_blank\" rel=\"noopener\" title>rule<\/a> that one paragraph from the indictments must be stricken, noting its \u201cprejudicial\u201d nature. The paragraph details an occurrence in which Trump is alleged to have shown a highly sensitive military map to one of his close aides after leaving the presidency.<\/p>\n<p>\u201cThe identified deficiencies, even if generating some arguable confusion, are either permitted by law, raise evidentiary challenges not appropriate for disposition at this juncture, and\/or do not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-reasserts-presidential-immunity-in-federal-election-case\/\" title=\"Trump claims presidential immunity in federal election case.\">require dismissal<\/a> even if technically deficient, so long as the jury is instructed appropriately and presented with adequate verdict forms as to each Defendants\u2019 alleged conduct,\u201d Cannon wrote in her ruling.<\/p>\n<p>She said paragraph 36 is inappropriate for the prosecution to include because it is not directly connected to any of the crimes Trump is accused of, as Trump is not being charged with disclosing classified material to anyone after leaving office. The paragraph details Trump\u2019s alleged showing of a classified document to someone without a security clearance in 2021.<\/p>\n<p>Trump\u2019s lawyers said the inclusion of the paragraph was <a href=\"https:\/\/www.nytimes.com\/2024\/06\/10\/us\/politics\/trump-documents-charges-cannon.html\" target=\"_blank\" rel=\"noopener\" title>irrelevant<\/a>, as Trump was only charged with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/vivek-ramaswamy-announces-foia-request-to-expose-merrick-garlands-communications\/\" title=\"Vivek Ramaswamy seeks to reveal Merrick Garland's communications through FOIA request.\">keeping documents<\/a> after leaving office. Cannon dismissed Trump\u2019s lawyers\u2019 request to dismiss the charges altogether, although she agreed with Trump\u2019s legal team that much of the language in the indictment was \u201clegally unnecessary.\u201d <\/p>\n<p>Jay Bratt, of the prosecution, argued that the paragraph had been included not as charged behavior but in order to try and highlight the former president\u2019s tendency of mishandling classified material. He said the paragraph was permissible under Rule 404(b) of the federal criminal procedure, which allows prosecutors to inform the jury of the defendant\u2019s \u201cbad acts.\u201d <\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Prosecutors may still be able to introduce the story of Trump and the classified document as evidence in the trial, just not in the charging document.
