The plaintiffs should be commended for stepping up to bring these important health concerns to \u200dthe\u2064 attention of the highest\u200c court in the land.<\/p>\n<\/div>\n<p>In the ongoing\u200d debate over abortion in \u200dthe United States, the Biden administration has taken steps to\u2062 roll back pro-life protections for women\u200b and children\u2064 while ignoring the dangers associated with chemical abortions. A group \u200dof doctors and medical associations has sued\u200b the\u2064 FDA for its\u200b decision \u2063to lift safety \u2064regulations related to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fda-lifts-restriction-on-remote-prescriptions-of-abortion-drugs\/\" title=\"FDA Lifts Restriction on Remote Prescriptions of Abortion Drugs\">chemical abortion drugs<\/a>, and \u200bthe\u2062 Supreme Court is\u2063 expected to release a decision on the case soon. The administration \u200bargues that the plaintiffs lack standing to bring the case, but the doctors and medical associations \u2064have compelling evidence of the \u2064increasing dangers of chemical abortions and \u200dtheir \u2064impact on the medical community.\u2064 During oral arguments, Justices Thomas and Alito questioned the \u200badministration&#8217;s stance and \u200dthe lack \u200dof specific protections \u200bfor doctors. The outcome \u200cof this case could\u200b have significant \u2064implications for\u2063 the safety of \u200cwomen and girls who choose to \u200bundergo a chemical abortion.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>Americans should be alarmed by the Biden administration\u2019s aggressive attempts to roll back pro-life protections for women and children while ignoring the plethora of dangers associated with chemical abortion \u2014 which accounted for <a href=\"https:\/\/www.foxnews.com\/health\/abortion-pills-spiked-recent-years-new-report-reveals-substantial-increase\" target=\"_blank\" rel=\"noreferrer noopener\">642,700<\/a> abortions in 2023, the first full year after the <em>Dobbs<\/em> decision.   <\/p>\n<p>This trend is not only ethically disturbing but highly troubling from a medical perspective. Thankfully, a group of doctors and medical associations has sued the Biden FDA for its hasty decision to lift safety regulations related to chemical abortion drugs in one of the first cases since the Supreme Court overturned <em>Roe v. Wade<\/em>. The court is expected to release a decision in<em> U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine<\/em> this summer. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-674374855\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-10bca2de9a5ea93e51db76ea9a641d27 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-10bca2de9a5ea93e51db76ea9a641d27\"><\/div>\n<p>And despite the <a href=\"https:\/\/www.nytimes.com\/2024\/03\/26\/us\/politics\/abortion-pill-lawsuits-doctors.html\" target=\"_blank\" rel=\"noreferrer noopener\">argument <\/a>by some that the plaintiffs lack standing \u2014 which is no surprise given the no-holds-barred approach to abortion-on-demand from the media and Biden administration \u2014 there are compelling reasons for the court to hear them out. <\/p>\n<p>Unable to get the FDA\u2019s attention with citizen petitions sounding the alarm on the increasing dangers to women of chemical abortion drugs, four <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/everything-you-need-to-know-about-the-case-freezing-the-fdas-abortion-pill-approval\/\" title=\"Everything You Need To Know About The Case Freezing The FDA\u2019s Abortion Pill Approval\">national medical associations<\/a> and four individual doctors experienced in caring for pregnant and post-abortive patients<a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2022-11\/Alliance-for-Hippocratic-Medicine-v-FDA-2022-11-18-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> sued<\/a> the FDA. Federal district court Judge Matthew Kacsmaryk agreed with the doctors,<a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2023-08\/Alliance-for-Hippocratic-Medicine-v-FDA-2023-08-16-5th-Circuit-Opinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> ruling<\/a> that when the FDA eased requirements for prescribing the drugs its actions were unlawful under the Administrative Procedure Act. This ruling was subsequently <a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2023-08\/Alliance-for-Hippocratic-Medicine-v-FDA-2023-08-16-5th-Circuit-Opinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">affirmed <\/a>by a panel of the Fifth Circuit Court of Appeals.<\/p>\n<p>Predictably, the Biden administration petitioned the Supreme Court for review. Its main claim is that the court should not even consider the merits of the case and throw it out because the plaintiffs lack standing \u2014 the legal right to sue in federal court.   <\/p>\n<p>How convenient.  <\/p>\n<div class=\"fdrlst__b89e9-86d9a8ff42999afee002c175d43206a4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-86d9a8ff42999afee002c175d43206a4\"><\/div>\n<p><a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2023-01\/Alliance-for-Hippocratic-Medicine-v-FDA-2022-11-18-Appendix-MPI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Declarations<\/a> submitted by the doctors and medical associations attest that, as a result of the loosening of guidelines, many more women and girls accessing this drug are suffering complications, often ending up in the emergency room. These doctors \u201cfeel complicit in an elective chemical abortion\u201d\u00a0when treating women suffering from acute complications.<\/p>\n<p>Removal of necessary safeguards for women and girls who use chemical abortion drugs, they explain, \u201cplace physicians in higher-risk situations with less critical information about patients, thus increasing their exposure to allegations of malpractice and potential liability.\u201d<\/p>\n<p>They add, and this is crucial, that \u201cwith the increase in women and girls suffering emergency complications from chemical abortion or seeking to reverse the effects of the chemical abortion regimen, there is a direct correlation in the decrease in time, attention, and resources that emergency department doctors have to treat their other patients.\u201d  <\/p>\n<p>During <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2023\/22-235_q8l1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">oral argument<\/a>, U.S. Solicitor General Elizabeth Prelogar tried to narrow the doctors\u2019 declarations to a mere crisis of conscience that could easily be remedied by asking the hospital to allow them to opt out of caring for a woman who is suffering complications related to medical abortion. \u201cIt\u2019s speculative that any of those women would seek care from the two specific doctors who asserted conscience injuries,\u201d she said. \u201cAnd even if that happened, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-its-first-year-bidens-hhs-relentlessly-attacked-christians-and-unborn-babies\/\" title=\"In Its First Year, Biden\u2019s HHS Relentlessly Attacked Christians And Unborn Babies\">federal conscience protections<\/a> would guard against the injury the doctors face.\u201d<\/p>\n<div class=\"fdrlst__b89e9-d05be77ea1cf022629645cd2bb809229 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-d05be77ea1cf022629645cd2bb809229\"><\/div>\n<p>But the last thing these doctors want is to see women suffer complications of a chemical abortion. The even stronger conscience-based objection they make, and Prelogar ignores, is that because of the FDA\u2019s action, an ever-increasing number of women are now unduly placed in harm\u2019s way. <\/p>\n<p>Justice Clarence Thomas, whose questioning during oral argument is notably brief and always to the point, wasn\u2019t willing to play along. He asked Prelogar, \u201cCould you give us an example of who would have standing \u2026 to challenge these FDA actions?\u201d Instead of answering the question, Prelogar argued that the doctors challenging the FDA \u201cstand at a far distance from the upstream regulatory action they\u2019re challenging.\u201d <\/p>\n<p>Justice Samuel Alito, author of the court\u2019s opinion in <em>Dobbs<\/em>, was not satisfied with this response. He followed up by asking, \u201cIs there anybody who could challenge in court the lawfulness of what the FDA did here?\u201d Prelogar responded: \u201cIn this particular case, I think the answer is no.\u201d Even Chief Justice John Roberts, citing the \u201cremote nature of the injury\u201d and \u201csmall number of adverse effects,\u201d followed up with a chilling question: \u201cWhat percentage of adverse consequences would be enough? What percentage of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/teachers-unions-resist-reopening-schools-despite-cdc-guidance-around\/\" title=\"Teachers unions resist reopening schools despite CDC guidance around\">emergency room visits<\/a> would be enough?\u201d  <\/p>\n<p>It is ironic that for years, Big Abortion challenged the constitutionality of abortion restrictions on behalf of prospective clients but now argues that doctors caring for patients with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/everything-senate-democrats-lied-about-during-their-ivf-and-abortion-for-all-hearing\/\" title=\"Misconceptions Addressed in Senate Democrats' IVF and Abortion Hearing\">abortion-related complications<\/a> can\u2019t complain. In addition to speaking on behalf of their future patients, the doctors and medical groups challenging the FDA\u2019s erasing of safety guidelines clearly satisfy standing requirements, not only because they are made involuntarily \u201ccomplicit in abortion,\u201d but also because their attention to other patients is taxed by the onslaught of medical emergencies afflicting women undergoing chemical abortions. <\/p>\n<p>Judicial review of the FDA\u2019s grossly irresponsible erasure of standards for chemical abortion is urgently needed. Otherwise, we\u2019re betraying the growing number of vulnerable pregnant women and the principled doctors who are treating them when these \u201csafe and effective\u201d treatments go horribly wrong. <\/p>\n<div class=\"fdrlst__b89e9-34d35264794449c26de4a37605afb196 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-34d35264794449c26de4a37605afb196\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Americans should be concerned about the Biden administration&#8217;s efforts to reduce pro-life measures and overlook the risks of chemical abortions, which led to 642,700 abortions in 2023 following the Dobbs decision.
