That came after a 23-year sentence for similar charges in New York in 2020, a conviction that the state\u2019s highest court <a href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/2979091\/harvey-weinsteins-sexual-assault-conviction-overturned-new-york-court\/\" target=\"_blank\" rel=\"noopener\" title>overturned<\/a> six weeks ago.<\/p>\n<p>His lawyers said the judge deprived Weinstein of \u201chis constitutional rights to present a defense and led to a miscarriage of justice\u201d by excluding evidence of a romantic relationship with a woman, Jane Doe 1, he was convicted of raping had with the director of a film festival who brought them both to Los Angeles when the alleged rape occurred. Weinstein\u2019s attorneys also argued testimony in the New York case and about alleged assaults with which he was not charged influenced the jury.<\/p>\n<p>\u201cThe introduction of this excessive, cumulative, and remote evidence of prior \u2018sexual assaults\u2019 simply signaled to the jury that the Defendant was a bad man who should be convicted of something irrespective of whether the prosecution proved its case,\u201d the filing reads.<\/p>\n<p>The New York Court of Appeals cited <a href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/2979091\/harvey-weinsteins-sexual-assault-conviction-overturned-new-york-court\/\" target=\"_blank\" rel=\"noopener\" title>similar reasoning<\/a> in its decision to overturn Weinstein\u2019s conviction in that state.<\/p>\n<p>\u201cWe conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,\u201d appellate judges wrote in the majority opinion.<\/p>\n<p>Dave Ring, an attorney representing Jane Doe 1, said in a statement that the California appeal \u201cmakes the same tired arguments that he previously made multiple times, without success, to the trial court.\u201d<\/p>\n<p>\u201cWe are of the strong opinion that the trial court vetted the evidence appropriately and made all the correct decisions in its evidentiary rulings,\u201d Ring said. \u201cWe are confident that Weinstein\u2019s appeal will be denied and he will spend many years in prison.\u201d<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Weinstein, 72, was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2982053\/weinstein-hospitalized-following-conviction-being-overturned\/\" target=\"_blank\" rel=\"noopener\" title>hospitalized<\/a> in April, shortly after his New York conviction was overturned. His attorney, Arthur Aidala, said Weinstein was \u201csomewhat of a train wreck, health-wise.\u201d The film producer remains imprisoned in the Empire State because his Los Angeles conviction still stands.<\/p>\n<p>Manhattan District Attorney Alvin Bragg, who recently successfully prosecuted former President Donald Trump on 34 felony counts of falsifying business records, has indicated he is interested in retrying Weinstein in New York.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Film producer Harvey Weinstein is appealing his Los Angeles rape conviction, claiming an unfair trial.
