However, a Second Amendment group called the SAF has declared that they will sue to defend Trump&#8217;s right to possess a firearm, as they believe his prosecution \u200dis politically motivated. \u2064This \u200dcase brings attention to the fact \u2064that, under New York law and federal \u2062law, convicted felons are \u2062not allowed to\u2062 possess firearms.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2014 A Second Amendment group is vowing to sue to defend former President Donald Trump with the New York Police Department seeking to revoke his concealed carry license following his felony conviction in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trumps-criminal-hush-money-trial-set-for-march-25\/\" title=\"Trump's hush money trial scheduled for March 25\">hush money trial<\/a>.<\/p>\n<p>Trump was convicted by a Manhattan jury last Thursday of 34 felony charges of falsifying business documents to cover up <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-rejects-trump-bid-to-shield-financial-records\/\" title=\"Supreme Court Rejects Trump Bid To Shield Financial Records\">alleged hush money payments<\/a> to porn actor Stormy Daniels. The presumptive Republican presidential nominee plans to appeal the verdict and denies any wrongdoing, claiming the prosecution is politically motivated. <\/p>\n<p>Under New York law, convicted felons are not allowed to have firearm permits. Possession of a firearm by a convicted felon is also a federal crime. Trump\u2019s concealed carry license was suspended last year after he was indicted on the charges, and several media outlets are reporting that the NYPD could permanently revoke his gun rights. <\/p>\n<p>But the Second Amendment Foundation, a Washington-based gun rights group, said it will take New York officials to court if they try to permanently take the former president\u2019s concealed carry permit and his guns. <\/p>\n<p>\u201cIf Donald Trump is further prosecuted for owning firearms, we will offer to defend him and challenge the law,\u201d Alan M. Gottlieb, SAF\u2019s founder and executive vice president, said in a statement. <\/p>\n<p>Gottlieb said under the U.S. Supreme Court\u2019s 2022 ruling in N.Y. State Rifle and Pistol Association v. Bruen case, which requires gun laws to have an analogous connection to \u201chistorical regulation\u201d when the Second Amendment was ratified, Trump should not have his right to carry taken away.<\/p>\n<p>\u201cDonald Trump has no history of violent crime,\u201d he said. \u201cThere is no historical nexus to deny someone, including Trump, of their gun rights over such a conviction.\u201d <\/p>\n<p>Trump could also keep his firearms if a state appeals court ends up overturning his felony convictions from the hush money trial. <\/p>\n<p>He could keep them by applying for a certificate of relief from civil disabilities, but it\u2019s unclear if the former president\u2019s legal team has filed a petition. <\/p>\n<p>Two of the three pistols Trump was licensed to carry were turned over to the NYPD in March 2023, according to published news reports, while a third gun listed on Trump\u2019s New York license was lawfully moved to Florida, now his primary residence.<\/p>\n<p>Gottlieb said the SAF \u2014 whose motto is \u201cWinning Gun Rights One Lawsuit at a Time\u201d \u2014 has successfully litigated many legal challenges in the past to restore gun rights for people convicted of non-violent crimes and expects to prevail in a challenge on behalf of the former president. <\/p>\n<p>\u201cThe attack on Trump\u2019s gun rights emphasizes the need to revisit existing gun control laws and change them to protect an individual\u2019s gun rights,\u201d he said. \u201cUntil that happens, we will be more than happy to meet New York State or the federal government in court.\u201d<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Second Amendment organization plans to sue on behalf of former President Donald Trump after the NYPD sought to revoke his concealed carry license due to his felony conviction in a hush money case.
