Kennedy Jr.\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/presidential\/3028670\/flip-the-script-trump-new-york-landscape-republicans\/\" target=\"_blank\" rel=\"noopener\" title>New York <\/a>residency claim, saying the campaign lied about it in its ballot petition.<\/p>\n<p>The PAC, Clear Choice, is alleging <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/rfk-jr\/\" target=\"_blank\" rel=\"noopener\" title>Kennedy<\/a> has little connection to his New York residence and now lives on the West Coast in a complaint to the state\u2019s Board of Elections.<\/p>\n<p>\u201cThe objectors have proven and, will continue to prove, by clear and convincing evidence that candidate Kennedy violated New York State law when he listed the petition residence on his presidential petitions, and therefore candidate Kennedy should be barred from seeking the public office of president of the United States,\u201d the group\u2019s complaint reads.<\/p>\n<p>A Board of Elections spokeswoman, Kathleen McGrath, <a href=\"https:\/\/www.nytimes.com\/2024\/06\/06\/us\/politics\/rfk-jr-ny-residency-challenged.html\" target=\"_blank\" rel=\"noopener\" title>told<\/a> the<em> New York Times<\/em> that a determination of residency would be \u201coutside the ministerial scope\u201d of the board\u2019s review of petitions.<\/p>\n<p>\u201cI will note that the courts and a judicial proceeding would be the appropriate venue for challenging his residency,\u201d she said. The complaint is likely to stall Kennedy\u2019s efforts to get on the ballot of the state in his quest to get on enough ballots to qualify for the June 27 CNN presidential debate. He has until June 20 to do so, provided he also meets a polling requirement.<\/p>\n<p>If Kennedy can\u2019t get on the New York ballot, it\u2019d be an expensive loss for the campaign. A recent <a href=\"https:\/\/nypost.com\/2024\/05\/28\/us-news\/the-insane-price-tag-that-rfk-jr-paid-to-get-on-the-ballot-in-new-york\/\" target=\"_blank\" rel=\"noopener\" title>report<\/a> indicates Kennedy\u2019s campaign has spent over $1.1 million to secure ballot access in the state, paying \u201cpetition circulators\u201d $90 per hour.<\/p>\n<p>His campaign says Kennedy has been a permanent resident since 1968 and that he has held several jobs in the state, including an early role as an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/calif-da-blasts-gov-newsom-for-not-stopping-release-of-convicted-killer\/\" title=\"Calif. DA blasts Gov. Newsom for not stopping release of convicted killer\">assistant district attorney<\/a> in the borough of Manhattan. Kennedy does not own his residence in New York but pays rent to the owner, a doctor friend in Westchester, New York.<\/p>\n<p>\u201cMr. Kennedy\u2019s best friend invited him to move into his Croton Lake Road residence in which Mr. Kennedy had been a frequent guest,\u201d the campaign said in its statement. \u201cMr. Kennedy transferred his residence in June 2023.\u201d<\/p>\n<p>The dispute likely arises from Kennedy\u2019s ownership of a $5 million Malibu, California, home with his actress wife, Cheryl Hines, which he <a href=\"https:\/\/www.dailymail.co.uk\/tvshowbiz\/article-2765736\/Robert-F-Kennedy-Jr-Cheryl-Hines-s-5-million-Malibu-mansion-complete-recording-studio-two-storey-tree-house.html\" target=\"_blank\" rel=\"noopener\" title>bought<\/a> in 2013. The Kennedy campaign rejects the claim that he doesn\u2019t live in New York.<\/p>\n<p>\u201cHe receives mail there. His driver\u2019s license is registered there. His automobile is registered there. His voting registration is from there,\u201d the campaign said in a statement.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cHe has never claimed any other state as a residency,\u201d the campaign added. \u201cHe intends to move back to New York after his wife retires from acting.\u201d<\/p>\n<p>New York election law states that residence in the state is defined as \u201cthat place where a person maintains a fixed, permanent and principal home and to which he, wherever temporarily located, always intends to return.\u201d<\/p>\n<p>So far, Kennedy has made it onto the ballot in seven states: Utah, Michigan, California, Delaware, Oklahoma, Hawaii, and Texas.
