The unfolding legal proceedings in\u2064 the Delaware Supreme Court reflect intense debates around early voting and absentee\u200b ballot regulations, posing constitutional conflicts that demand thorough examination.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>President Joe Biden\u2019s home state of Delaware has enlisted the help of former Obama administration Solicitor General Don Verrelli to argue in favor of loose election laws in the state.<\/p>\n<p>For Biden \u2014 who has decried election security laws in states like Georgia as \u201cJim Crow 2.0\u201d \u2014 <a href=\"https:\/\/thefederalist.com\/2024\/03\/04\/biden-department-of-justice-declares-war-on-voter-id-and-other-election-security-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">the looser the election laws the better<\/a>. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1474165944\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-156eda43c2190cf43f2cb4ff3a8b3488 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-156eda43c2190cf43f2cb4ff3a8b3488\"><\/div>\n<p>Yet Delaware \u2014 the president\u2019s home state \u2014 doesn\u2019t have universal mail voting or same-day registration, ever since the Delaware Supreme Court <a href=\"https:\/\/thefederalist.com\/2022\/10\/07\/delaware-supreme-court-no-excuse-mail-in-voting-same-day-registration-are-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">struck both practices down<\/a> as unconstitutional in 2022. On Wednesday, the state\u2019s highest court heard a case challenging the constitutionality of Delaware\u2019s early voting period and permanent absentee voter list, after a lower court found that both violated the state constitution.<\/p>\n<p>Surely Biden once understood the pitfalls of things like same-day voter registration, <a href=\"https:\/\/www.bostonherald.com\/2022\/10\/05\/lucas-biden-does-full-flip-on-voter-fraud\/\" target=\"_blank\" rel=\"noreferrer noopener\">having said<\/a> in 1977 \u2014 while representing Delaware in the Senate \u2014 that such a proposal \u201ccould lead to a serious increase in vote fraud.\u201d But safeguarding elections isn\u2019t as appealing to Biden now as it was back in 1977, because Democrats rely on weak election laws to increase their chances of winning.<\/p>\n<p>So it\u2019s interesting that a top dog from the Obama administration like Verrilli, who is perhaps best known for arguing both the Obamacare and <em>Obergefell<\/em> cases before the U.S. Supreme Court, was enlisted to argue against the state-level challenge that is no doubt embarrassing to the president.<\/p>\n<p>Opening arguments began Wednesday in the Delaware Supreme Court, with the Public Interest Legal Foundation (PILF) and former Delaware Attorney General Jane Brady arguing that state laws permitting early voting and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-turning-election-day-into-election-week-and-creating-permanent-mail-voters-violates-delawares-constitution\/\" title=\"Court: Expanding Election Period and Mail Voting Violates Delaware Constitution\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-zuckerberg-funded-nonprofit-helped-shift-michigans-2020-voting-rules\/\" title=\"Exclusive: Zuckerberg-Funded Nonprofit Helped Shift Michigan\u2019s 2020 Voting Rules\">permanent absentee voting<\/a> violate<\/a> the Delaware Constitution. The state legislature passed a law in 2019 permitting early voting in person at least 10 days before Election Day. This law was overturned as a violation of the state\u2019s constitution by the <a href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2024\/02\/S23C-03-014-_008365.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Superior Court<\/a>, which found the state\u2019s constitution requires the general election to be held on the Tuesday after the first Monday of November.<\/p>\n<div class=\"fdrlst__b89e9-35e8c468413706855dba1e93edb55b87 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-35e8c468413706855dba1e93edb55b87\"><\/div>\n<p>The court also found that a state statute passed in 2010 that permitted \u201cpermanent absentee status\u201d violated the state\u2019s constitution because \u201cthe constitution only allows for absentee voting with strict restrictions on eligibility,\u201d a press release from PILF <a href=\"https:\/\/publicinterestlegal.org\/press\/pilf-argues-before-delaware-supreme-court-on-constitutionality-of-early-voting-and-permanent-absentee-voting-laws\/\">explained<\/a>. <\/p>\n<p>Voters who are granted permanent absentee status can receive an absentee ballot each election year, \u201cwithout consideration of the applicant\u2019s eligibility in each subsequent election,\u201d as PILF noted.<\/p>\n<p><a href=\"https:\/\/www.delawarepublic.org\/politics-government\/2024-06-05\/delaware-supreme-court-hears-arguments-on-permanent-absentee-early-voting-laws\" target=\"_blank\" rel=\"noreferrer noopener\">Verrilli<\/a>, on behalf of the state, argued that other states with similar constitutional provisions have not been prevented from operating with practices like early and permanent absentee voting.<\/p>\n<p>A cohort of left-wing attorneys general have also jumped on the bandwagon to defend Delaware\u2019s laws, which have already been ruled to be in violation of the state constitution by a lower court. <\/p>\n<div class=\"fdrlst__b89e9-16dcb30a0cbc4eb69a152d5ee791376b fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-16dcb30a0cbc4eb69a152d5ee791376b\"><\/div>\n<p>In a press release from California Attorney General Rob Bonta, who signed on to the amicus brief supporting the Delaware laws, the left-wing attorney general <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-joins-multistate-coalition-supporting-delaware%E2%80%99s-early\" target=\"_blank\" rel=\"noreferrer noopener\">acknowledges<\/a> that the Delaware Constitution expressly defines \u201cElection Day\u201d as the Tuesday after the first Monday of November but goes on to argue that the state constitution doesn\u2019t prevent the state from creating laws to the contrary.<\/p>\n<p>Bonta contends that the purpose of these loose election laws is to increases the \u201copportunity\u201d for voters to \u201cparticipate\u201d in the electoral process.<\/p>\n<p>But, as my colleague Shawn Fleetwood <a href=\"https:\/\/thefederalist.com\/2024\/04\/08\/media-tacitly-admit-mail-in-balloting-is-not-as-secure-and-reliable-as-they-claim\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>, \u201cwidespread, unsupervised mail-in voting allows <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/antifa-blm-vandalize-ice-building-burn-original-starbucks\/\" title=\"Antifa, BLM vandalize ICE building, burn original Starbucks\">left-wing groups<\/a> to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michigan-landlords-sue-east-lansing-for-forcing-them-to-provide-voter-registration-materials-to-tenants\/\" title=\"Michigan Landlords Sue East Lansing For Forcing Them To Provide Voter Registration Materials To Tenants\">harvest low-effort votes<\/a> and accrue Democrat candidates an advantage over Republicans ahead of Election Day.\u201d<\/p>\n<\/p>\n<div class=\"fdrlst__b89e9-fbb1cda84e38c3b55cf213b5635afc35 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-fbb1cda84e38c3b55cf213b5635afc35\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delaware, President Biden&#8217;s home state, has recruited Don Verrelli, former Obama Solicitor General, to support lax election regulations.
