DeSantis accused Worrell of hindering attorneys from\u2063 seeking minimum mandatory sentences \u2062for drug and gun offenses, enabling violent criminals to evade accountability. The suspension, effective since \u2062August 9, 2023, affects Orange \u2063and \u200dOsceola\u2063 counties in the\u200d 9th Judicial Circuit.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>By a 6-1 decision, the<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noopener\" title> Florida<\/a> Supreme Court upheld Gov. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ron-desantis\/\" target=\"_blank\" rel=\"noopener\" title>Ron DeSantis<\/a>\u2019s (R-FL) suspension of State Attorney <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2448594\/suspended-florida-attorney-monique-worrell-asks-state-supreme-court-to-invalidate-move-by-desantis\/\" target=\"_blank\" rel=\"noopener\" title>Monique Worrell<\/a>.<\/p>\n<p>DeSantis suspended Worrell, who worked in the 9th Judicial Circuit representing Orange and Osceola counties, on Aug. 9, 2023, for \u201cneglecting her duty to faithfully prosecute crime in her jurisdiction.\u201d<\/p>\n<p>DeSantis said Worrell had prevented attorneys in her office from seeking \u201cminimum mandatory sentences\u201d for both <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/west-coast-democrat-leaders-create-safe-haven-for-out-of-state-abortion-seekers\/\" title=\"West Coast Democrat Leaders Create \"Safe Haven\" for Out-of-State Abortion Seekers\">drug trafficking offenses<\/a> and gun offenses, allowing for \u201cviolent criminals to escape the full consequences of their criminal conduct.\u201d<\/p>\n<p>In his executive order, DeSantis noted that the Osceola County Sheriff\u2019s Office referred 58 nonhomicide robberies with a firearm to prosecutors in 2021 and 2022, but only one of those cases resulted in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-suspends-soros-backed-state-attorney-for-neglecting-her-duty-to-prosecute-violent-criminals\/\" title=\"DeSantis suspends Soros-backed attorney for neglecting duty to prosecute violent criminals.\">minimum mandatory sentence<\/a> of 10 years.<\/p>\n<p>A month after her suspension, Worrell filed a petition arguing DeSantis did not cite specific behavior that would give him the authority under <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-ca-gov-overstepped-his-authority-with-covid-order-issues-permanent-injunction-restraining-newsom-from-further-issuing-unconstitutional-orders\/\" title=\"Judge Rules CA Gov Overstepped His Authority with Covid Order, Issues Permanent Injunction Restraining Newsom From Further Issuing Unconstitutional Orders\">state law<\/a> to suspend her.<\/p>\n<p>\u201cThe Executive Order is invalid because it fails to allege any specific conduct of Ms. Worrell that, if true, would constitute a basis for suspension on the ground of neglect of duty or incompetence,\u201d the <a href=\"https:\/\/acis-api.flcourts.gov\/courts\/68f021c4-6a44-4735-9a76-5360b2e8af13\/cms\/case\/d4e628d0-04c0-4817-8ab5-8c6430849be1\/docketentrydocuments\/84dab1ab-91e8-442b-9602-2941d59956de\" target=\"_blank\" rel=\"noopener\" title>petition<\/a> reads. \u201cInstead, the Order wrongly attempts to infer her \u2018practices and policies\u2019 from inapposite data, but even if such practices and policies existed, they would not constitute a ground for suspension.\u201d<\/p>\n<p>However the court <a href=\"https:\/\/supremecourt.flcourts.gov\/content\/download\/2435518\/opinion\/Opinion_SC2023-1246.pdf\" target=\"_blank\" rel=\"noopener\" title>found <\/a>Worrell\u2019s claim that the allegations in the executive order were vague to be false.<\/p>\n<p>\u201cWe have said that a suspension order does not infringe on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/twitter-hacker-to-spend-time-in-juvie-for-high-profile-bitcoin-scheme\/\" title=\"Twitter Hacker To Spend Time In Juvie For High-Profile Bitcoin Scheme\">state attorney\u2019<\/a>s lawful exercise of prosecutorial discretion where it alleges that such discretion is, in fact, not being exercised in individual cases but, rather, that generalized policies have resulted in categorical enforcement practices,\u201d the majority opinion reads.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>While Worrell remains barred from her duties as state attorney, she is still qualified to run for reelection and is the only Democratic candidate on the ballot.<\/p>\n<p>Worrell was first elected in 2020.<a href><\/a><\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a 6-1 decision, the Florida Supreme Court affirmed Gov.
