In a lawsuit with Judicial Watch and a CNN-led coalition, they seek the audio, anticipating its disclosure through the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-canvassers-rescind-their-votes-to-certify-wayne-county-michigan-results\/\" title=\"Republican Canvassers Rescind Their Votes to Certify Wayne County, Michigan, Results\">legal action<\/a>. Biden&#8217;s memory \u2064lapses during the interviews and the administration&#8217;s \u200bresponse have triggered debate and legal actions to access the full recordings.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Heritage Foundation believes that the effort to force the release of the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3006125\/biden-asserts-executive-privilege-hur-tapes\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/robert-hur-angers-republicans-by-waffling-on-whether-hell-release-audio-tapes-of-biden-interview\/\" title=\"Robert Hur frustrates GOP with indecision on releasing Biden interview recordings\">crucial recording<\/a><\/a> of President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>\u2018s interview with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">special counsel<\/a> <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\/\" target=\"_blank\" rel=\"noopener\" title=\"Robert Hur\">Robert Hur<\/a> will be successful \u2014\u00a0even if the tape doesn\u2019t come to them directly.<\/p>\n<p>Heritage is part of a lawsuit that includes Judicial Watch and a CNN-led media coalition seeking to get the audio of Biden\u2019s interviews with special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\/\" target=\"_blank\" rel=\"noopener\" title=\"Robert Hur\">Robert Hur<\/a>.<\/p>\n<p>\u201cI expect the tape is coming out one way or the other, and that will be because of this lawsuit,\u201d Heritage Oversight Project Executive Director Mike Howell told reporters on a conference call Wednesday afternoon. \u201cBut the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\/\" target=\"_blank\" rel=\"noopener\" title=\"Biden administration\">Biden administration<\/a> would have some flexibility as to how they, politically, wanted to play that.\u201d<\/p>\n<p>Specifically, Howell thinks that if the Biden <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/white-house\/\" target=\"_blank\" rel=\"noopener\" title=\"White House\">White House<\/a> senses it\u2019s going to lose the lawsuit, it will leak the tape to a media \u201cally\u201d to get preferential coverage. <\/p>\n<p>Hur was assigned by the Justice Department to investigate Biden\u2019s handling of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\" target=\"_blank\" rel=\"noopener\" title=\"classified documents\">classified documents<\/a>, and while he did not charge the president, his report still rocked the political world by concluding Biden would present to a jury as an \u201celderly man with with a poor memory.\u201d<\/p>\n<p>That conclusion was based on Hur\u2019s interviews with the president, during which Biden struggled to remember details like what year his son died and what year he stopped being <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-defector-emails-pipeline-to-obama-admin-seen-as-currency\/\" title=\"Hunter Biden Defector Emails: 'Pipeline' to Obama Admin Seen as 'Currency'\">vice president<\/a>. <\/p>\n<p>Only a written transcript of those interviews has been released, with Biden <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3006125\/biden-asserts-executive-privilege-hur-tapes\/\" target=\"_blank\" rel=\"noopener\" title=\"claiming executive privilege\">claiming executive privilege<\/a> over the audio. That has led to furious debate on Capitol Hill and to the Heritage lawsuit. <\/p>\n<p>\u201cThe transcript only has the words in it. It doesn\u2019t have the \u2018uhs\u2019 and \u2018ums,&#8217;\u201d Heritage attorney Sam Dewey said on the call. \u201cYou as reporters know those types of pauses can often indicate someone\u2019s thinking.\u201d<\/p>\n<p>The Biden administration has pushed back forcefully against the notion that it\u2019s trying to hide anything, with White House counsel spokesman Ian Sams reiterating over the weekend that \u201cthe transcripts accurately reflect the words spoken on the audio.\u201d<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Despite its 1M views, this post is a total lie<\/p>\n<p>First of all, this was a court filing by the top career official at the Justice Dept\u2014not the White House<\/p>\n<p>Second, DOJ says the Special Counsel and FBI determined \u201cthe transcripts accurately reflect the words spoken on the audio\u201d <a href=\"https:\/\/t.co\/3N9ziMtLX7\">https:\/\/t.co\/3N9ziMtLX7<\/a><\/p>\n<\/div>\n<p>\u2014 Ian Sams (@IanSams46) <a href=\"https:\/\/twitter.com\/IanSams46\/status\/1797065677229969916?ref_src=twsrc%5Etfw\">June 2, 2024<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<p>Dewey argues that if the transcript is accurate, then the tape should be released.<\/p>\n<p>\u201cThey won\u2019t let the American people judge the matter for themselves,\u201d he said. \u201cWhy is that?\u201d<\/p>\n<p>The matter also came up during a House committee\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3027801\/top-takeaways-merrick-garland-hearing-congress\/\" target=\"_blank\" rel=\"noopener\" title=\"five-hour grilling\">five-hour grilling<\/a> of Attorney General Merrick Garland on Tuesday.<\/p>\n<p>\u201cThe Supreme Court has said that in order to protect the separation of powers under the Constitution, the Congress has to have a legitimate legislative purpose for the things that it\u2019s requesting,\u201d Garland told Rep. Kelly Armstrong (R-ND) at the end of his testimony.<\/p>\n<p>\u201cI understand why you\u2019d rather see the audio, hear the audio, than read the transcript,\u201d he continued. \u201cBut I still do not understand a legislative purpose.
