The allegations carry potential prison time\u200d and fines, sparking debates on \u200dthe legality and\u2063 motives behind the \u200ccharges.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>It was only a matter of time before Wisconsin\u2019s far-left attorney general bowed to leftist pressure and filed charges against former President Donald Trump\u2019s representatives in a politically driven investigation into \u201cfalse electors.\u201d The timing is curious, however \u2014 with the charges dropping just a few days after a <a href=\"https:\/\/thefederalist.com\/2024\/06\/04\/chuck-schumers-brother-works-for-law-firm-behind-braggs-get-trump-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Manhattan kangaroo court<\/a> found Trump guilty in a Soviet-style show trial. <\/p>\n<p>Attorney General Josh Kaul held a crowded <a href=\"https:\/\/www.youtube.com\/watch?v=jy_iBLVkF0o\" target=\"_blank\" rel=\"noreferrer noopener\">press conference<\/a> Tuesday on the steps of the State Capitol to announce <a href=\"https:\/\/wcca.wicourts.gov\/caseDetail.html?caseNo=2024CF001295&#038;countyNo=13&#038;index=0&#038;mode=details\" target=\"_blank\" rel=\"noreferrer noopener\">felony charges<\/a> tied to the 2020 plan by Trump campaign attorneys to draft a slate of alternate electors in the event a recount in the closely contested swing state or a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nc-supreme-court-says-voter-id-amendment-may-be-invalid-because-of-racial-gerrymandering\/\" title=\"NC Supreme Court Says Voter ID Amendment May Be Invalid Because Of Racial Gerrymandering\">court ruling found<\/a> the Republican president had defeated Democrat challenger Joe Biden. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-407776832\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-ed5162538f01103b6d245ab4fe690273 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-ed5162538f01103b6d245ab4fe690273\"><\/div>\n<p>Kaul, as Democrats demanded, <a href=\"https:\/\/www.doj.state.wi.us\/sites\/default\/files\/news-media\/6.4.24_Chesebro_Criminal_Complaint.PDF\" target=\"_blank\" rel=\"noreferrer noopener\">alleges<\/a> attorneys Kenneth Chesebro and Jim Troupis engaged in a scheme to enlist 10 \u201cfalse electors\u201d to help Trump\u2019s alleged attempt to overturn Biden\u2019s victory in the Badger State. The attorney general\u2019s charges against the attorneys, along with political operative Michael Roman, massage a state <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/943\/iii\/38\" target=\"_blank\" rel=\"noreferrer noopener\">forgery-uttering law<\/a> to accuse the defendants of knowingly promoting a false slate of electors as authentic, or at least uttering as much. <\/p>\n<p>The three men each face a maximum sentence of up to six years in prison and a $10,000 fine if found guilty of the Class H felony. <\/p>\n<p>\u201cThis is an investigation into alleged criminal conduct, and we\u2019re gonna follow the facts wherever they lead,\u201d Kaul <a href=\"https:\/\/www.youtube.com\/watch?v=jy_iBLVkF0o\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. \u201cThe investigation is not focused on any particular person, but on those facts, and what information we can gather, and then making a determination based on the law,\u201d Kaul told reporters hungry for the latest get-Trump headline. <\/p>\n<h2 class=\"wp-block-heading\">Change of Heart<\/h2>\n<p>The long-awaited charges \u2014 <a href=\"https:\/\/wisconsinexaminer.com\/2024\/04\/30\/time-for-ag-kaul-to-hold-wisconsins-fake-electors-accountable\/\" target=\"_blank\" rel=\"noreferrer noopener\">demanded<\/a> by angry Democrats and seething left-wing activists for years \u2014 are the latest trumped-up complaints brought by Democrat prosecutors against Trump and his allies. Alternate electors also face criminal counts in Georgia, Michigan, Nevada, and, most recently, Arizona. <\/p>\n<div class=\"fdrlst__b89e9-203405109c7666e2e2e499bc7f01a648 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-203405109c7666e2e2e499bc7f01a648\"><\/div>\n<p>Kaul, who previously served as an attorney with <a href=\"https:\/\/www.wispolitics.com\/2022\/rep-allen-asks-if-attorney-general-josh-kaul-was-aware\/\" target=\"_blank\" rel=\"noreferrer noopener\">debunked Russian dossier peddler Marc Elias\u2019 <\/a>old law firm, had long remained mum on possible charges. In <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/04\/26\/wisconsin-could-prosecute-trump-2020-fake-electors\/73452583007\/\" target=\"_blank\" rel=\"noreferrer noopener\">late April<\/a>, Kaul spokeswoman Gillian Drummond told USA Today that the office would not \u201cconfirm or deny the existence of an investigation, except in unique public safety circumstances.\u201d She did say that Kaul \u201cbelieves that those who committed crimes in an effort to unlawfully subvert the outcome of an election\u00a0should be held accountable.\u201d<\/p>\n<p>The leftist AG was taking a lot of heat for failing to deliver the heads of Trump\u2019s allies on a political platter, despite the fact that the Wisconsin Elections Commission had <a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\">twice rejected complaints<\/a> from a leftist lawfare group about the Republican alternate electors. Interestingly, the Wisconsin Department of Justice said the Republicans who attempted to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ginni-thomas-transcript-from-j6-panel-reveals-witch-hunt-operation-without-a-witch\/\" title=\"Ginni Thomas Transcript of J6 Panel Reveals Witch Hunt Operation Without A Witch\">cast electoral votes<\/a> for Trump did not violate any election laws. <\/p>\n<p>Kaul\u2019s agency \u201cconcluded that Republicans were legitimately trying to preserve Trump\u2019s legal standing as courts were deciding if he or Biden won the election,\u201d the Associated Press <a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n<p>So why the sudden change of heart? It\u2019s not clear whether the reporters at Kaul\u2019s celebratory press conference asked that question. <\/p>\n<div class=\"fdrlst__b89e9-638a742dc0b5e9b2c1ddfb7595a869d4 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-638a742dc0b5e9b2c1ddfb7595a869d4\"><\/div>\n<p>One legal expert who spoke to The Federalist said Kaul seemed to have found an opening after a Manhattan jury last week found Trump guilty on 34 felony counts of <a href=\"https:\/\/www.newsweek.com\/donald-trump-hush-money-frankenstein-case-jonathan-turley-1891185\" target=\"_blank\" rel=\"noreferrer noopener\">Frankensteinian charges<\/a> of improper bookkeeping and election interference tied to a reported nondisclosure agreement involving an on-screen prostitute. If Manhattan District Attorney Alvin Bragg could get a guilty conviction on a lemon of a case that legal experts assert is <a href=\"https:\/\/thefederalist.com\/2024\/05\/31\/intentional-misfeasance-makes-show-trial-conviction-ripe-for-reversal-legal-experts-say\/\" target=\"_blank\" rel=\"noreferrer noopener\">easily reversible on appeal<\/a>, Kaul stands a pretty good chance of racking up convictions in a liberal Dane County Court, the source said. Like Manhattan, Madison, Wisconsin, \u2014 the state capital city and the seat of Dane County \u2014 is one of the deepest blue communities in the country. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Weaponizing Wisconsin\u2019s Judiciary\u2019<\/h2>\n<p>\u201cI think these are political prosecutions that are outside of the law,\u201d <a href=\"https:\/\/www.heritage.org\/staff\/hans-von-spakovsky\" target=\"_blank\" rel=\"noreferrer noopener\">Hans von Spakovsky,<\/a> a senior legal fellow in the Heritage Foundation\u2019s Edwin Meese III Center for Legal and Judicial Studies told me <a href=\"https:\/\/thefederalist.com\/2024\/05\/02\/the-lefts-phony-fake-electors-crusade-ramps-up-as-2024-election-draws-closer\/#:~:text=%E2%80%9CI%20think%20these%20are%20political,for%20Legal%20and%20Judicial%20Studies.\" target=\"_blank\" rel=\"noreferrer noopener\">last month<\/a> about Democrats\u2019 prosecutions against Republican alternate electors. \u201cQuite apart from the historical precedent for the moment, keep in mind that what these individuals did in Arizona, Georgia, and elsewhere is get alternate electors to be ready as a contingency if it was decided the election should be overturned.\u201d <\/p>\n<p>There\u2019s nothing illegal about that, von Spakovsky, a former member of the Federal Election Commission, said. <\/p>\n<p>As The Federalist recently reported, leftists have tried \u2014 and failed \u2014 to push their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-lefts-phony-fake-electors-crusade-ramps-up-as-2024-election-draws-closer\/\" title=\"The Left's Fake Electors Crusade Grows as 2024 Election Nears\">phony \u201cfake electors\u201d lawfare scheme<\/a> elsewhere. <\/p>\n<p>In Pennsylvania, even far-left Democrat Gov. Josh Shapiro, who was the Keystone State\u2019s attorney general at the time, was <a href=\"https:\/\/www.timesleader.com\/news\/1538076\/shapiros-office-gop-elector-plan-not-illegal-but-misleading\" target=\"_blank\" rel=\"noreferrer noopener\">forced by the facts to concede<\/a> that \u201cour office does not believe this meets the legal standards for forgery.\u201d The Trump alternate electors there specified that <em>if<\/em> the courts later determine that they are the \u201c<a href=\"https:\/\/www.spotlightpa.org\/news\/2023\/07\/pennsylvania-trump-fake-electors-jan-6-committee-charges-explainer\/\" target=\"_blank\" rel=\"noreferrer noopener\">duly elected and qualified electors<\/a>,\u201d their certification of the election for Trump would then be considered valid. <\/p>\n<p>In New Mexico, Democrat Attorney General Ra\u00fal Torrez looked into the alternate electors plan by Republicans but <a href=\"https:\/\/apnews.com\/article\/new-mexico-fake-electors-9ec6f35313c6bbfe8f1ac65e8d5b323c\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> the conduct did not warrant criminal charges. <\/p>\n<p>Kaul insists Wisconsin is different because the alternate electors there, unlike in some other states, didn\u2019t include conditional language noting that they were merely attempting to preserve Trump\u2019s right to claim the electors, should circumstances change. Andrew Hitt, former chairman of the Wisconsin Republican Party, has <a href=\"https:\/\/www.wpr.org\/politics\/former-wisconsin-gop-chair-says-false-electors-were-tricked\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> that the alternate electors were \u201ctricked\u201d into believing as much. Such claims were at the center of a civil lawsuit in which Chesebro and Troupis admitted no \u201cliability or culpability\u201d but agreed they would not prepare alternate slates of electors in the future without being \u201ccertified as the persons elected as presidential electors under state law,\u201d Wisconsin Public Radio <a href=\"https:\/\/www.wpr.org\/news\/gop-attorneys-troupis-chesebro-settlement-wisconsin-false-electors-lawsuit\" target=\"_blank\" rel=\"noreferrer noopener\">reported.<\/a> <\/p>\n<p>The leftist lawfare plan in Wisconsin, as elsewhere, was to extract a confession of wrongdoing from their \u201celection-denying\u201d political enemies \u2014 and <a href=\"https:\/\/www.wpr.org\/jury-trial-wisconsin-fake-electors-case-scheduled-2024-presidential-election\" target=\"_blank\" rel=\"noreferrer noopener\">$2.4 million<\/a>. They didn\u2019t get what they were hoping for on either account. Troupis, a former judge and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/discredited-democrats-attack-durham-to-deflect-from-their-own-tarnished-reputations\/\" title=\"Disgraced Dems target Durham to divert attention from their tarnished image.\">long-time attorney<\/a> for the Republican Party, at the time said he signed the agreement \u201cto avoid endless litigation, and nothing in today\u2019s settlement constitutes an admission of fault, nor should it.\u201d <\/p>\n<p>In a <a href=\"https:\/\/www.wpr.org\/wp-content\/uploads\/2024\/03\/Troupis-and-Fernholz-Statements-on-Settlement-updated.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>, the attorney cited Harvard Law School Professor Lawrence Lessig\u2019s report fully supporting the Trump team\u2019s actions in Wisconsin. <\/p>\n<p>\u201cHe concludes, as we did at the time, that given the results of the 2020 recount were appealable (and were appealed) to the United States Supreme Court, it was a reasonable course of action and expected that the Trump-Pence electors would cast alternate elector ballots.
