They argue that President Joe Biden&#8217;s 2024 campaign exploited Trump&#8217;s guilty verdict, affecting his\u2062 rights and the \u200cpublic discourse. The defense insists that the limitations\u200b on\u2064 Trump&#8217;s speech post-verdict are \u200cunjustified and impede his First \u200dAmendment \u2063rights as a prominent\u2063 2024 presidential candidate.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Lawyers for former President <a href=\"http:\/\/washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a> on Tuesday asked a <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> judge to lift the gag order imposed on him in the criminal hush money case, citing his opponent, President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>\u2018s 2024 election campaign gloating over his guilty verdict.<\/p>\n<p>Trump has been under a gag order since April that bars him from making comments about the jury that presided over the weekslong trial as well as specific witnesses in the case, family members of prosecutors, and the daughter of presiding Judge Juan Merchan. His defense lawyers pointed to specific moments last week in which the Biden campaign used Trump\u2019s guilty verdict as an excuse to discourage voters from choosing Trump as the next president.<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Trump has asked the judge who presided over his New York criminal trial to lift the gag order that prevents him from speaking about witnesses, jurors and others associated with the case. More below \u2014> <a href=\"https:\/\/t.co\/TTEDiunlvb\">pic.twitter.com\/TTEDiunlvb<\/a><\/p>\n<p>\u2014 Katherine Faulders (@KFaulders) <a href=\"https:\/\/twitter.com\/KFaulders\/status\/1798102049235578955?ref_src=twsrc%5Etfw\">June 4, 2024<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<p>\u201cNow that the trial is concluded, the concerns articulated by the government and the Court<br \/>do not justify continued restrictions on the First Amendment rights of President Trump\u2014who remains the leading candidate in the 2024 presidential election\u2014and the American people,\u201d attorney Todd Blanche wrote in a letter to Merchan.<\/p>\n<p>Blanche argued the justification to lift the gag order is \u201ceven stronger\u201d than their previously unsuccessful fight against it while the trial was ongoing, pointing to various public comments made by Biden and witnesses in the case.<\/p>\n<p>Blanche cited \u201c(1) President Biden\u2019s May 28 campaign event outside the courthouse during the defense summation; (2) President Biden\u2019s public comments regarding the jury\u2019s verdict on May 31; (3) <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mccarthy-endorses-rep-stefanik-to-replace-rep-cheney\/\" title=\"McCarthy endorses Rep. Stefanik to replace Rep. Cheney\">continued public attacks<\/a> against President Trump by government witnesses Michael Cohen and Stormy Daniels; and (4) the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tim-scott-enters-race-for-the-white-house-fec-filing-shows\/\" title=\"Tim Scott joins White House race, according to FEC filing.\">presidential debate scheduled<\/a> for June 27, 2024,\u201d according to the letter.<\/p>\n<p>The defense attorney cited several precedents they say make their case for lifting the gag order, including <em>Brown v. Harltage<\/em>, quoting a section that states, \u201cIt is simply not the function of the government to select which issues are worth discussing or debating, in the course of a political campaign.\u201d<\/p>\n<p>Trump has continued to rail against the gag order against him and has argued both the guilty verdict and the continued suppression of speech are a form of \u201celection interference\u201d while also claiming the New York case and the three other criminal cases he faces are part of a \u201ccoordinated effort\u201d by the Biden administration.<\/p>\n<p>\u201cAnd I\u2019m not even allowed to defend myself because of the gag order,\u201d Trump told <em>Fox &#038; Friends <\/em>during a Sunday interview on Fox News. \u201cHow can you have a witness like so and so and I\u2019m not allowed to mention his name?\u201d Trump said of the prosecutors\u2019 star witness, Michael Cohen.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong> <\/p>\n<p>During the trial, the gag order was expanded to cover the family of Merchan after Trump said the judge should be removed from the case over his daughter\u2019s work for elected Democrats who have made railing against Trump\u2019s legal woes part of their platforms.<\/p>\n<p>Trump has sought to appeal the gag order but has so far failed in New York\u2019s appellate division.
