case, so the Democrat-led state can be stopped from interfering any more in the 2024 election.<\/p>\n<p>He\u2019s right: Enough is enough.<\/p>\n<p>After a six-week trial, 12 New York jurors found Trump <a href=\"https:\/\/www.westernjournal.com\/breaking-crucial-verdict-reached-trumps-trial\/\" target=\"_blank\" rel=\"noopener\">guilty<\/a> Thursday on all 34 felony counts in a much-disputed case of falsifying business records in relation to payments made to adult film star Stormy Daniels and others during the 2016 presidential campaign.<\/p>\n<p>Manhattan District Attorney Alvin Bragg <a href=\"https:\/\/www.westernjournal.com\/turley-braggs-created-frankenstein-case-trump-based-dead-misdemeanors\/\" target=\"_blank\" rel=\"noopener\">indicted<\/a> Trump on falsifying the records in the first degree, taking what are normally misdemeanor violations and making them felonies by alleging that the former president was seeking to hide an underlying crime.<\/p>\n<p>But Bragg <a href=\"https:\/\/www.westernjournal.com\/levin-no-underlying-crime-listed-trump-indictment-didnt-anything\/\" target=\"_blank\" rel=\"noopener\">was not clear<\/a> on what the underlying crime was, although he suggested when he announced the charges that it had to do with a reported $130,000 payment made to Daniels being a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rand-paul-blasts-bragg-over-trump-indictment-says-da-should-be-put-in-jail\/\" title=\"Rand Paul blasts Bragg over Trump indictment, says 'DA should be put in jail'\">federal campaign finance violation<\/a>.<\/p>\n<p>Both the Federal Election Commission and the Justice Department, which have jurisdiction over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/google-expands-security-efforts-ahead-of-2022-elections\/\" title=\"Google Expands Security Efforts Ahead of 2022 Elections\">campaign finance law<\/a>, reviewed the payments and declined to prosecute.<\/p>\n<p>On July 11, Trump has to be back in Judge Juan Merchan\u2019s courtroom for his sentencing hearing, and the presumptive GOP presidential nominee isn\u2019t happy about it.<\/p>\n<p>Trump posted on Truth Social on Sunday, \u201cThe \u2018Sentencing\u2019 for not having done anything wrong will be, conveniently for the Fascists, 4 days before the Republican National Convention.\u201d<\/p>\n<p>The convention begins July 15 in Milwaukee.<\/p>\n<p>\u201cA Radical Left Soros backed D.A., who ran on a platform of \u2018I will get Trump,\u2019 reporting to an \u2018Acting\u2019 Local Judge, appointed by the Democrats, who is HIGHLY CONFLICTED, will make a decision which will determine the future of our Nation?\u201d the candidate asked.<\/p>\n<p>\u201cThe United States Supreme Court MUST DECIDE!\u201d Trump said.<\/p>\n<p>Perhaps the quickest path to SCOTUS for Trump is if the judge hands down a <a href=\"https:\/\/www.westernjournal.com\/will-trump-go-prison-need-know-following-rigged-hush-trial-money-verdict\/\" target=\"_blank\" rel=\"noopener\">prison sentence<\/a> or some type of home confinement or restrictions about leaving the state of New York during a probationary period.<\/p>\n<p>Trump\u2019s attorneys could file for an <a href=\"https:\/\/www.scotusblog.com\/election-law-explainers\/emergency-appeals-stay-requests\/\" target=\"_blank\" rel=\"noopener\">emergency stay<\/a> on the ruling at the Supreme Court, and if five justices agree, it could be granted while his appeal goes forward.<\/p>\n<p>The lawyers might start at the federal circuit court level first and move up to the Supreme Court if the stay is not granted.<\/p>\n<p>Former federal prosecutor James Trusty told Fox News host Mark Levin on his Sunday program, \u201cI don\u2019t rule out the Supreme Court getting involved just because of the uniquely historical and perhaps horrible context.\u201d<\/p>\n<p>In March, the high court <a href=\"https:\/\/www.westernjournal.com\/scotus-rules-trump-colo-ballot-case-dems-next-move-disqualify-might-take-place-election\/\" target=\"_blank\" rel=\"noopener\">stepped in<\/a> to prevent states from keeping Trump off their ballots based on a claim he violated the 14th Amendment\u2019s insurrection clause.<\/p>\n<p> <iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/qdDAAvvGSXE?si=ANsoNLkOlERCQ3hC&#038;start=211\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Trusty noted it would be a \u201cpyrrhic victory\u201d if Trump won in the normal appeals process, perhaps 15 months from now, but the conviction and sentence ended up costing him the election in November.<\/p>\n<p>\u201cIt is justice delayed being justice denied,\u201d he said.<\/p>\n<p>Levin, who served as chief of staff to Attorney General Edwin Meese during the Reagan administration, called what New York has done \u201cquite diabolical.\u201d<\/p>\n<p>He pointed out Bragg\u2019s office timed the case so it would fall during the heart of the 2024 campaign season and left no room to win on appeal following the normal process before the election.<\/p>\n<p>\u201cThese are federal constitutional violations. This is why I think, Jim Trusty, the judge didn\u2019t give a d***. That was of no consequence to him. The appeal process. Who cares? That will be after the fact, the damage will be done,\u201d Levin said.<\/p>\n<p>Multiple legal experts have pointed to Merchan\u2019s jury instructions and the denial of testimony for former Federal Election Commission Chairman Bradley Smith for Trump as violations of his constitutional rights.<\/p>\n<p>The judge <a href=\"https:\/\/www.westernjournal.com\/judge-merchan-issues-last-minute-jury-instruction-designed-convict-trump-even-jurors-dont-agree\/\" target=\"_blank\" rel=\"noopener\">told the 12 jurors<\/a> that if they found Trump guilty of violating New York tax law, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/registered-foreign-agent-gave-200k-to-mcauliffe-campaign\/\" title=\"Registered Foreign Agent Gave 0K to McAuliffe Campaign\">federal campaign finance law<\/a> (over which New York has no jurisdiction) or falsifying other business records such as bank records, they could convict the former president on the primary crime of falsifying business records.<\/p>\n<p>In other words, the jury breakdown could be four-four-four in what they believed Trump did wrong, which is certainly not the unanimous verdict required under our system of criminal justice, George Washington Law School professor Jonathan Turley in a piece for <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/4697118-braggs-thrill-kill-in-manhattan-could-prove-short-lived-on-appeal\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Trump appeal to the Supreme Court?<\/p>\n<\/p><\/div>\n<p>Merchan\u2019s instructions raise grounds for appeal under the U.S. Constitution\u2019s <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-6\/\" target=\"_blank\" rel=\"noopener\">Sixth Amendment<\/a>, which states the defendant has the right \u201cto be informed of the nature and cause of the accusation.\u201d In other words, one has to know precisely what he or she is being accused of in order to prepare a legal defense.<\/p>\n<p>Trump posted on Truth Social ahead of Thursday\u2019s verdict that Merchan did not allow him to present evidence that he had not violated tax law.<\/p>\n<p>Former federal prosecutor Andy McCarthy <a href=\"https:\/\/www.westernjournal.com\/legal-expert-jonathan-turley-provides-ray-hope-trump-guilty-verdict-case-will-reversed\/\" target=\"_blank\" rel=\"noopener\">said<\/a> Wednesday on Fox News concerning Merchan\u2019s jury instructions, \u201cIt\u2019s really outrageous, because in a normal criminal case, every statutory crime has what we call elements of the offense.\u201d<\/p>\n<p>\u201cThose are the things the jury has to agree on unanimously that were proved beyond a reasonable doubt,\u201d he explained.<\/p>\n<p>In this case, \u201cWhat makes it a felony is that you\u2019re concealing or committing another crime, and here the judge is telling them they don\u2019t have to agree about what the other crime is,\u201d McCarthy said.<\/p>\n<p>ABC News chief legal analyst Dan Abrams said regarding the jury instructions, \u201cThere are some real appellate issues here that are serious questions about why didn\u2019t the defense even know what the charge was they were going to be applying, what law they were going to be applying?\u201d<\/p>\n<p>\u201cSo there were a lot of questions for the defense going into this, I think, as they were making their closing arguments, not even knowing sort of what the law they were going to be battling over was,\u201d he said.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">ABC\u2019s chief legal analyst: \u201cThere\u2019s some real appellate issues here that are serious questions \u2026 why didn\u2019t the defense even know what the charge was that they were gonna be applying \u2014 what law?\u201d <a href=\"https:\/\/t.co\/n3ZzViN7vk\">pic.twitter.com\/n3ZzViN7vk<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/twitter.com\/RNCResearch\/status\/1797273462861398449?\">June 2, 2024<\/a><\/p>\n<\/blockquote>\n<p>Additionally, Trump has the right, under the Sixth Amendment, to \u201chave compulsory process for obtaining witnesses in his favor,\u201d which Merchan also denied.<\/p>\n<p>The former president\u2019s attorneys wanted to put Smith on the stand, but the judge so limited what he could testify to that defense lawyers decided it would be of no help to the case.<\/p>\n<p>What the former FEC chairman said he was fully <a href=\"https:\/\/www.westernjournal.com\/fec-expert-witness-whose-testimony-denied-merchan-reveals-said-trump-trial\/\" target=\"_blank\" rel=\"noopener\">prepared to address<\/a> was a question at the heart of the matter: Did a payment Michael Cohen, then Trump\u2019s personal attorney, made to Daniels qualify as a campaign expense?<\/p>\n<p>And Smith\u2019s testimony to the jury would have been, \u201cNo.\u201d<\/p>\n<p>\u201cFederal law does not say that anything that you think might help you win an election is a campaign expense. Rather, it\u2019s an objective test, in which things like polling, paying for staff, paying for headquarters, paying for advertisements and so on \u2014 those are campaign expenses,\u201d Smith <a href=\"https:\/\/www.westernjournal.com\/fec-expert-witness-whose-testimony-denied-merchan-reveals-said-trump-trial\/\" target=\"_blank\" rel=\"noopener\">told<\/a> Fox News host Laura Ingraham in March.<\/p>\n<p>Based on the constitutional violations Merchan made, Harvard Law School professor emeritus Alan Dershowitz believes SCOTUS can and should get involved in the case.<\/p>\n<p>\u201cIf the court granted review in this case, they would reverse,\u201d he <a href=\"https:\/\/www.westernjournal.com\/will-trump-go-prison-need-know-following-rigged-hush-trial-money-verdict\/\" target=\"_blank\" rel=\"noopener\">said<\/a> Friday on Fox Business. \u201cAnd I think there is a way of expediting the appeal.\u201d<\/p>\n<p>Dershowitz advised Trump\u2019s attorneys to go right to the federal appellate court level and seek an expedited judgment and then take it to the Supreme Court next, if necessary.<\/p>\n<p>\u201cThe Supreme Court should take this case, should reverse the conviction and let the voters decide who should be president without the thumb of an illegal prosecution on the scales of the election,\u201d he said.<\/p>\n<p>Trump is right: It\u2019s time for the Supreme Court to stop New York from interfering any further in this year\u2019s presidential election.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
