Douglas Golden<\/span><\/a> <\/span> <span>   June 3, 2024 at 8:27am <\/span> <\/span>  <\/header>\n<section>\n<p>Makers of popular drink that claims to be a healthy alternative to soda will potentially have to defend the merits of their concoction in court after a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/class-action-settlement-deadline-to-file-for-3-6-million-spartan-mosquito-repellent-settlement-in-three-days\/\" title=\"3-day deadline to claim .6M in Spartan Mosquito repellent settlement\">class-action lawsuit accused<\/a> the beverage of being bad for you.<\/p>\n<p>According to <a href=\"https:\/\/www.scrippsnews.com\/us-news\/poppi-prebiotic-soda-isnt-as-healthy-as-it-claims-to-be-lawsuit-alleges\" target=\"_blank\" rel=\"noopener\">Scripps News<\/a>, Poppi Soda has advertised itself \u2014 often with the help of celebrities \u2014 as a salubrious alternative to Coke or Pepsi thanks to its inulin prebiotic content. The fibers can help with <a href=\"https:\/\/www.westernjournal.com\/mom-breaks-tragic-news-sweet-10-year-old-died-sleep-sugar-crash-sleepover\/\" target=\"_blank\" rel=\"noopener\">stabilizing your blood sugar<\/a>, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-study-majority-of-working-parents-are-burned-out-but-this-diet-helps\/\" title=\"New Study: Majority of Working Parents Are Burned Out\u2014But This Diet Helps\">healthy bowel movements<\/a> and improving gut bacteria.<\/p>\n<p>However, the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.430241\/gov.uscourts.cand.430241.1.0.pdf\" target=\"_blank\" rel=\"noopener\">suit<\/a> notes that the fiber in the drink is too little to \u201ccause meaningful gut health benefits for the consumer from just one can.\u201d<\/p>\n<p>In the suit, filed Wednesday by plaintiff Kristin Cobbs on behalf of \u201csimilarly situated\u201d consumers in the Northern District of California, says that the drink \u2014 distributed by Austin, Texas-based VNGR Beverage LLC \u2014 only contains two grams of <a href=\"https:\/\/www.westernjournal.com\/youve-been-throwing-away-avocado-pits-for-years-but-all-this-time-you-shouldve-been-eating-them\/\" target=\"_blank\" rel=\"noopener\">the fiber<\/a>, along with fruit juice and apple cider vinegar.<\/p>\n<p>\u201cAccordingly, a consumer would need to drink more than four Poppi sodas in a day to realize any potential health benefits from its prebiotic fiber. However, even if a consumer were to do this, Poppi\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soaring-inflation-squeezing-sales-in-dollar-stores\/\" title=\"Soaring Inflation Squeezing Sales in Dollar Stores\">high sugar content<\/a> would offset most, if not all, of these purported gut health benefits,\u201d the lawsuit states.<\/p>\n<p>It continued: \u201cAlthough Poppi\u2019s rise in popularity can be attributed to its enticing flavors and clever marketing, the core of Poppi\u2019s success is primarily owed to a particular ingredient: agave inulin, the Products\u2019 so-called \u2018Prebiotic.\u2019<\/p>\n<p>\u201cBut, despite Poppi\u2019s \u2018prebiotic\u2019 marketing claims, which assure consumers, on the can, that they can \u2018Be Gut Happy [and] Be Gut Healthy,\u2019 as one nutritionist bluntly explained: the Products \u2018are basically sugared water.&#8217;\u201d<\/p>\n<p>In the suit, Cobbs, a resident of San Francisco, said she purchased the drink numerous times up to March of this year because of the marketing.<\/p>\n<p>\u201cThus, Plaintiff reasonably relied on Defendant\u2019s representations when she decided to purchase the Products,\u201d the suit states.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you drink these sodas?<\/p>\n<\/p><\/div>\n<p>\u201cAccordingly, those representations and warranties were part of the basis of her bargains, in that Ms. Cobbs would not have purchased the Products on the same terms had she known that those representations were not true \u2026 Had Ms. Cobbs known that Defendant\u2019s representations and warranties about the Products were false, she would not have purchased the Products or would have paid substantially less for them.\u201d<\/p>\n<p>The suit seeks $5 million on behalf of <a href=\"https:\/\/www.westernjournal.com\/fans-openly-discussing-class-action-lawsuit-disney-racing-game-makes-change\/\" target=\"_blank\" rel=\"noopener\">the class<\/a>.<\/p>\n<p>Leaving aside the relative merits of filing a class-action suit because of a disgruntled customer or three who probably should have read nutritional labels more carefully, the legal action raises questions about how a supposedly healthful treat beloved by millennial and Gen Z consumers could become so popular without real scrutiny about the claims its maker made.<\/p>\n<p>The Poppi brand, founded in 2016, became renown after its founders appeared on the show \u201cShark Tank.\u201d <a href=\"https:\/\/www.westernjournal.com\/world-health-organization-calls-huge-global-tax-increases-alcohol-soda\/\" target=\"_blank\" rel=\"noopener\">The soda<\/a> is now one of the fastest growing beverage brands in the United States, outpacing more established drinks like Gatorade and Liquid Death in terms of growth, according to <a href=\"https:\/\/www.businessinsider.com\/poppi-soda-gut-health-claims-mislead-consumers-new-lawsuit-alleges-2024-6\" target=\"_blank\" rel=\"noopener\">Business Insider<\/a>.<\/p>\n<p>It currently sits at a 19 percent market share, more than one and a half times more than Coca-Cola branded products, <a href=\"https:\/\/www.forbes.com\/sites\/yolarobert1\/2024\/03\/05\/how-poppi-is-reshaping-soda-culture-for-gen-z-and-millennials\/?sh=243ff6367466\" target=\"_blank\" rel=\"noopener\">Forbes<\/a> reported in March.<\/p>\n<p>The drink\u2019s increased visibility is based in no small part on celebrity endorsements, as well.<\/p>\n<p>\u201cAlong the way, we\u2019ve become beloved by some new besties like Post Malone, Hailey Bieber, Kylie Jenner, Billie Eilish, Russell Westbrook, JLo, Olivia Munn, and more,\u201d the brand notes on its website.<\/p>\n<p>And, as Forbes noted, in just two years, \u201cPoppi has built a grassroots strategy using organic social and influencer marketing amounting to 204MM impressions and 2.3MM engagements in 2023.\u201d<\/p>\n<p>\u201cPoppi\u2019s become so much more than a soda, it\u2019s a tight-knit community and lifestyle at this point,\u201d said brand creator Allison Ellsworth, according to Forbes.<\/p>\n<p>\u201cWe\u2019re a part of people\u2019s daily lives, and we don\u2019t take that for granted! From exclusive merch to exciting collaborations with other brands, we\u2019re creating hype and interest that goes beyond a product.<\/p>\n<p>\u201cAs soda lovers, we want to share the joy and the freedom of drinking soda again and normalizing it. For a long time, soda has had a bad reputation and it\u2019s our mission to turn that around. The response we see from Gen Z lets us know we\u2019re on the right path!\u201d<\/p>\n<p>Poppi officials did not respond to requests for comment by either Scripps News or Business Insider, so we don\u2019t know how Poppi feels about being on the \u201cright path\u201d after this lawsuit.
