J.B. Pritzker over the extensive use of automatic license plate reading cameras in the state. The lawsuit\u200d challenges the widespread surveillance \u2063of motorists and \u200dthe sharing of data with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-says-theres-no-rational-basis-for-9mm-pistols\/\" title=\"Biden Says There\u2019s \u201cNo Rational Basis\u201d for 9mm Pistols\">numerous <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oregon-governor-encourages-people-to-call-police-on-neighbors-violating-covid-orders\/\" title=\"Oregon Governor Encourages People To Call Police On Neighbors Violating COVID Orders\">law enforcement agencies<\/a><\/a>. The Illinois State Police have\u200c significantly expanded \u2064the deployment of these cameras, raising concerns about privacy and \u200cconstitutional rights\u2062 violations. Additionally, the budget allocation for more\u200b camera installations has sparked further controversy regarding surveillance practices and individual liberties. \u200cThe\u2064 lawsuit asserts that the system infringes on\u200c Fourth Amendment rights by conducting unwarranted searches and surveillance on a massive\u2063 scale.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2013 Summons have been sent to the Illinois State Police, Attorney General Kwame Raoul and Gov. J.B. Pritzker in a case challenging the use of automatic license plate reading cameras across the state.<\/p>\n<p>On Thursday in the Northern District of Illinois federal court, the Liberty Justice Center filed the lawsuit. Reilly Stephens, counsel on the case, said the ALPRs are virtually everywhere. <\/p>\n<p>\u201cEvery time you drive on one of these expressways, they are tracking every time you go past one of these cameras,\u201d he said. \u201cThey\u2019re feeding that into a national database which is shared by thousands of law enforcement agencies across the country.\u201d<\/p>\n<p>In January of this year, ISP said they were increasing the use of technology to \u201ctarget and track criminal activity.\u201d <\/p>\n<p>\u201cAutomated License Plate Readers (ALPRs) capture a visual of vehicle license plates and anytime a wanted or suspected vehicle is detected by an ALPR, an alert is issued and law enforcement are better able to locate and track the vehicle,\u201d the agency said. <\/p>\n<p>Pritzker said then that the ALPRs around Chicago are \u201canother step to enhance public safety for residents of and visitors to the nation\u2019s third-largest city.\u201d<\/p>\n<p>By the end of 2022, ISP said 289 ALPRs were installed in the Chicago area. In 2023, 139 additional ALRPs were installed in Cook, St. Claire, Champaign and Morgan counties. For 2024, the agency said it planned installations in Macon, Madison, Peoria, Bureau, Lake and Winnebago counties with additional camera in Boon, DeKalb, DuPage, Grundy, Henry, Kane, Kendall, LaSalle, McHenry, Rock Island, Sangamon and Will counties as well along Lake Shore Drive in Chicago.  <\/p>\n<p>An annual ISP ALPR <strong><a href=\"https:\/\/isp.illinois.gov\/StaticFiles\/docs\/DII\/Final%20ALPR%20Annual%20Report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a><\/strong> from August 2023 showed installation in Cook and St. Clair counites cost $6.6 million. Maintenance cost $100,000. The total number of detections, the number of license plate reads captured by the system, is 1.5 million. The number of inquiries where the investigation involved criminal offense totaled 282,118. <\/p>\n<p>The budget legislators approved this week for the coming fiscal year includes $7 million for the Illinois Department of Transportation to install cameras and automatic license plate readers on state routes. <\/p>\n<p>While Stephens said the dragnet may help track a fleeing criminal suspect, it\u2019s capable of tracking much more. <\/p>\n<p>\u201cEvery time you went to the doctor, every time you went to a political rally, a Trump rally, a Joe Biden rally, a Black Lives Matter rally, an NRA event,\u201d he said. <\/p>\n<p>The lawsuit argues the system is a violation of Fourth Amendment rights against unwarranted search and seizure. <\/p>\n<p>\u201cThe permanent tracking of every citizen and all of their travels and whereabouts is a bridge too far,\u201d he said. <\/p>\n<p>ALPRs aren\u2019t just being used by the public sector, private parties like homeowners\u2019 associations, shopping malls and movie theaters are using them. <\/p>\n<p>\u201cThe difference is the movie theater can\u2019t throw me in jail and that\u2019s the power that governments have and that\u2019s why we have more restrictions on governments\u2019 ability to track our whereabouts at all times,\u201d he said. <\/p>\n<p>A spokesperson for ISP said ISP directives and public acts dictate that access and use of ALPR data \u201cshall be for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/atf-will-not-release-information-about-hunter-bidens-guns-because-of-substantial-privacy-interests\/\" title=\"ATF Will Not Release Information About Hunter Biden\u2019s Guns Because Of \u2018Substantial Privacy Interests\u2019\">law enforcement purposes<\/a> only and in compliance with all applicable training, laws, and administrative rules.\u201d<\/p>\n<p>The data is maintained within the Law Enforcement Archival Reporting Network storage platform for 90 days. <\/p>\n<p>\u201cInformation obtained from the ALPR system, software, associated databases, and data shall not be disseminated to the public except as authorized or required by law,\u201d the agency said. \u201cInformation obtained from the ALPR system, software, associated databases, and data may be disseminated to other law enforcement agencies or officers only to be used for law enforcement or public safety functions.\u201d<\/p>\n<p>Stephens was skeptical that the rules are strict enough to stave off abuse. <\/p>\n<p>\u201cI just don\u2019t trust them, to be honest,\u201d he said. \u201cI understand they\u2019re not supposed to use this to check up on their ex-girlfriends but I have yet to see anything in the actual processes here that would prevent that so we think that they\u2019re either going to have to shut down the cameras or they\u2019re going to have \u2026 probable cause and warrant requirements that other Fourth Amendment searches must adhere to.\u201d <\/p>\n<p>The agency said \u201cMisuse or abuse of the ALPR system, software, associated databases, or data may be subject to sanctions and\/or disciplinary action.\u201d <\/p>\n<p>A hearing for the case has yet to be set.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Illinois State Police, Attorney General Kwame Raoul, and Gov.
