This request follows \u200dTrump&#8217;s claims about FBI agents authorized \u200bto shoot him during a search, which prosecutors argue have put officers at risk. Special counsel Jack Smith is pursuing\u200d a gag order\u2064 against\u2064 former President Donald Trump to prevent him from \u200btalking about the law enforcement officers who \u200bdiscovered classified \u2062documents\u2063 in \u2064his Florida residence. Trump&#8217;s recent remarks about FBI \u2063agents\u200b being permitted to shoot him during a search\u2063 have raised concerns about the safety\u200c of the officers, \u2063according to prosecutors.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\/\" target=\"_blank\" rel=\"noopener\" title>Jack Smith<\/a> is making a <a href=\"https:\/\/www.courtlistener.com\/docket\/67490070\/united-states-v-trump\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\" target=\"_blank\" rel=\"noopener\" title>second request<\/a> that a gag order be imposed on former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump <\/a>after Judge Alieen Cannon rejected the previous motion.<\/p>\n<p>Smith\u2019s request would bar Trump from making statements about the law enforcement officers who searched his Mar-a-Lago home and found large stashes of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\/\" target=\"_blank\" rel=\"noopener\" title>classified documents<\/a>. In Florida, Trump is charged on 40 counts stemming from his alleged mishandling of classified documents after he left the White House and efforts to obstruct the Justice Department\u2019s investigation.<\/p>\n<p>\u201cThese deceptive and inflammatory claims expose the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oregon-governor-encourages-people-to-call-police-on-neighbors-violating-covid-orders\/\" title=\"Oregon Governor Encourages People To Call Police On Neighbors Violating COVID Orders\">law enforcement professionals<\/a> who are involved in this case to unjustified and unacceptable risks: they invite the sort of threats and harassment that have occurred when other participants in legal proceedings against Trump have been targeted by his invective,\u201d prosecutors Jay Bratt and David Harbach wrote. <\/p>\n<p>Smith originally made the request <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3017581\/classified-documents-prosecutors-seek-block-trump-statements-endanger-law-enforcement\/\" target=\"_blank\" rel=\"noopener\" title>in response<\/a> to a claim Trump made last week regarding the FBI agents who searched his home in August 2022, stating they were \u201cauthorized to shoot me\u201d and were \u201c<a href=\"https:\/\/thehill.com\/policy\/technology\/4679715-trump-falsely-says-biden-was-locked-loaded-and-ready-to-take-me-out-in-mar-a-lago-search\/\" target=\"_blank\" rel=\"noopener\" title>locked &#038; loaded<\/a> ready to take me out &#038; put my family in danger.\u201d<\/p>\n<p>During the search, FBI agents used their standard use-of-force policy, which prohibits the use of deadly force except when the officer has a reasonable belief that the subject being searched has an intent to harm the officer or another person.<\/p>\n<p>The prosecution said Trump\u2019s comments have created \u201ca grossly misleading impression about the intentions and conduct of federal law enforcement agents\u2014falsely suggesting that they were complicit in a plot to assassinate him\u2014and expose those agents, some of whom will be witnesses at trial, to the risk of threats, violence, and harassment.\u201d<\/p>\n<p>In a <a href=\"https:\/\/www.cnn.com\/2024\/05\/31\/politics\/trump-special-counsel-gag-order-classified-documents\/index.html\" target=\"_blank\" rel=\"noopener\" title>statement<\/a>, Trump\u2019s lawyers said the request was \u201ca blatant violation of the First Amendment rights of President Trump and the American People, which would in effect allow President Trump\u2019s political opponent to regulate his campaign communications to voters across the country.\u201d<\/p>\n<p>Trump\u2019s legal team took <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3018658\/trump-lawyers-sanctions-jack-smith-unconstitutional-gag-order-request\/\" target=\"_blank\" rel=\"noopener\" title>issue with the timing<\/a> of Smith\u2019s original request, which was made on a Friday afternoon before a holiday weekend, calling the timing \u201csuspicious.\u201d Smith\u2019s second request also came in late on a Friday, which <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3019157\/jack-smiths-gag-order-request-for-trump-denied-in-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\" title>could be worrying<\/a> for his team because Cannon said \u201csufficient time\u201d needs to be given or parties could be subject to sanctions.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cAny future, non<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smiths-gag-order-request-for-trump-denied-in-classified-documents-case\/\" title=\"Jack Smith's request for a gag order on Trump denied in classified documents lawsuit\">-emergency motion brought<\/a> in this case \u2014 whether on the topic of release conditions or anything else \u2014 shall not be filed absent meaningful, timely, and professional conferral,\u201d Cannon said. <\/p>\n<p>The trial has no set start date yet and <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3021032\/wavering-confidence-meticulousness-behind-snails-pace-cannons-courtroom\/\" target=\"_blank\" rel=\"noopener\" title>has moved slowly <\/a>so far.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Special counsel Jack Smith seeks a new gag order against ex-President Donald Trump.
