Elie Honig, a former prosecutor, highlighted that Trump&#8217;s conviction\u200c on 34 charges\u2064 doesn&#8217;t \u2063equate to justice, calling the case unjust from its inception. The expert unveiled \u200dunsettling details\u200b about the case, questioning its integrity and motive.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><a href=\"https:\/\/www.dailywire.com\/topic\/cnn\" target=\"_blank\" rel=\"noopener\">CNN\u2019s<\/a> top legal expert dismantled the Manhattan District Attorney\u2019s Office\u2019s criminal case this week against former President Donald Trump, saying that prosecutors only brought the case to get Trump.<\/p>\n<p>Elie Honig, a former federal and state prosecutor, wrote in a newsletter on Friday that just because the jury convicted Trump on all 34 felony counts does not mean that justice was carried out because the case should have never been brought.<\/p>\n<p>\u201cBoth of these things can be true at once: The jury did its job, and this case was an ill-conceived, unjustified mess,\u201d he said. \u201cSure, victory is the great deodorant, but a guilty verdict doesn\u2019t make it all pure and right. Plenty of prosecutors have won plenty of convictions in cases that shouldn\u2019t have been brought in the first place. \u2018But they won\u2019 is no defense to a strained, convoluted reach unless the goal is to \u2018win,\u2019 now, by any means necessary and worry about the credibility of the case and the fallout later.\u201d<\/p>\n<p>Honig then laid out damning \u201cundeniable facts\u201d about the case:<\/p>\n<blockquote>\n<p><em>The judge donated money \u2014 a tiny amount, $35, but in plain violation of a rule prohibiting New York judges from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-to-resume-funding-candidates-but-only-those-who-certified-bidens-win\/\" title=\"Facebook to Resume Funding Candidates, but Only Those Who Certified Biden's Win\">making political donations<\/a> of any kind \u2014 to a pro-Biden, anti-Trump political operation, including funds that the judge earmarked for \u201cresisting the Republican Party and Donald Trump\u2019s radical right-wing legacy.\u201d Would folks have been just fine with the judge staying on the case if he had donated a couple bucks to \u201cRe-elect Donald Trump, MAGA forever!\u201d? Absolutely not.<\/em><\/p>\n<p><em>District Attorney Alvin Bragg ran for office in an overwhelmingly Democratic county by touting his Trump-hunting prowess. He bizarrely (and falsely) boasted on the campaign trail, \u201cIt is a fact that I have sued Trump over 100 times.\u201d (Disclosure: Both Bragg and Trump\u2019s lead counsel, Todd Blanche, are friends and former colleagues of mine at the Southern District of New York.)<\/em><\/p>\n<p><em>Most importantly, the DA\u2019s charges against Trump push the outer boundaries of the law and due process. That\u2019s not on the jury. That\u2019s on the prosecutors who chose to bring the case and the judge who let it play out as it did.<\/em><\/p>\n<p><em>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/after-commuting-his-sentence-ca-gov-newsom-reverses-parole-for-convicted-double-murderer\/\" title=\"After Commuting His Sentence, CA Gov. Newsom Reverses Parole For Convicted Double Murderer\">district attorney\u2019<\/a>s press office and its flaks often proclaim that falsification of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-arraignment-what-we-know-ahead-of-former-presidents-first-court-appearance\/\" title=\"Trump Arraignment: What We Know Ahead of Former President\u2019s First Court Appearance\">business records charges<\/a> are \u201ccommonplace\u201d and, indeed, the office\u2019s \u201cbread and butter.\u201d That\u2019s true only if you draw definitional lines so broad as to render them meaningless. Of course the DA charges falsification quite frequently; virtually any fraud case involves some sort of fake documentation.<\/em><\/p>\n<p><em>But when you impose meaningful search parameters, the truth emerges: The charges against Trump are obscure, and nearly entirely unprecedented. In fact, no state prosecutor \u2014 in New York, or Wyoming, or anywhere \u2014 has ever charged federal election laws as a direct or predicate state crime, against anyone, for anything. None. Ever. Even putting aside the specifics of election law, the Manhattan DA itself almost never brings any case in which falsification of business records is the only charge.<\/em><\/p>\n<p><em>Standing alone, falsification charges would have been mere misdemeanors under New York law, which posed two problems for the DA. First, nobody cares about a misdemeanor, and it would be laughable to bring the first-ever charge against a former president for a trifling offense that falls within the same technical criminal classification as shoplifting a Snapple and a bag of Cheetos from a bodega. Second, the statute of limitations on a misdemeanor \u2014 two years \u2014 likely has long expired on Trump\u2019s conduct, which dates to 2016 and 2017.<\/em><\/p>\n<p><em>So, to inflate the charges up to the lowest-level felony (Class E, on a scale of Class A through E) \u2014 and to electroshock them back to life within the longer felony statute of limitations \u2014 the DA alleged that the falsification of business records was committed \u201cwith intent to commit another crime.\u201d Here, according to prosecutors, the \u201canother crime\u201d is a New York State election-law violation, which in turn incorporates three separate \u201cunlawful means\u201d: federal campaign crimes, tax crimes, and falsification of still more documents. Inexcusably, the DA refused to specify what those unlawful means actually were \u2014 and the judge declined to force them to pony up \u2014 until right before closing arguments. So much for the constitutional obligation to provide notice to the defendant of the accusations against him in advance of trial. (This, folks, is what indictments are for.)<\/em><\/p>\n<\/blockquote>\n<p>He noted that in nearly all key aspects of the case, norms were shattered as the case was \u201ccrafted individually for the former president and nobody else.\u201d<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1716990157394000&#038;usg=AOvVaw33qQydjIo8bet419amChif\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>He called the case a \u201cFrankenstein Case\u201d that was constructed out of random \u201cill-fitting parts into an ugly, awkward, but more-or-less functioning contraption that just might ultimately turn on its creator.\u201d<\/p>\n<p>Honig said that Trump has a decent chance of getting the case overturned on appeal in New York, although he cautioned that the Democrat-controlled state has \u201cbroad and hazy\u201d laws that could allow the conviction to stand.<\/p>\n<p>\u201cProsecutors got their man, for now at least \u2014 but they also contorted the law in an unprecedented manner in their quest to snare their prey,\u201d he concluded.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>CNN&#8217;s premier legal expert discredited the Manhattan District Attorney&#8217;s criminal case against former President Donald Trump, suggesting it was solely motivated to target Trump.
