He will face President Joe Biden in the rematch of 2020\u2019s mess of an election. Trump also is facing the <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-prison-hush-money-trial-verdict-rcna153963\" target=\"_blank\" rel=\"noreferrer noopener\">possibility of spending the rest of his life in prison<\/a>, depending on the vindictiveness of a New York judicial system that has already proved to be quite vindictive. <\/p>\n<p>But the appeals process is certain to stall any sentencing, probably until after the election. And there is nothing currently stopping Trump from continuing his third presidential run, even with the kangaroo court felony conviction cheered on by his incumbent opponent. <\/p>\n<h2 class=\"wp-block-heading\">\u2018One of the Craziest Things\u2019<\/h2>\n<p>Constitutional law expert Hans von Spakovsky says the conviction isn\u2019t likely to stick, for an array of reasons. Chief among them: Merchan\u2019s convoluted jury instructions, in which the <a href=\"https:\/\/thefederalist.com\/2024\/05\/30\/rigged-biden-donor-judge-whose-daughter-raised-millions-to-defeat-trump-oversaw-soviet-show-trial-conviction\/?utm_source=rss&#038;utm_medium=rss&#038;utm_campaign=rigged-biden-donor-judge-whose-daughter-raised-millions-to-defeat-trump-oversaw-soviet-show-trial-conviction#:~:text=According%20to%20the%20New%20York,Trump's%20radical%20right-wing%20legacy.\" target=\"_blank\" rel=\"noreferrer noopener\">Biden campaign-donor judge<\/a> framed the jury\u2019s deliberations in a way that, <a href=\"https:\/\/twitter.com\/JonathanTurley\/status\/1795923956513337530\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/asian-american-activists-blast-bidens-pandering-anti-racism-order\/\" title=\"Asian-American Activists Blast Biden\u2019s \u2018Pandering\u2019 Anti-Racism Order\">legal expert<\/a> Jonathan Turley, \u201cseemed less like a jury deliberation than a canned hunt.\u201d Merchan told the jurors they didn\u2019t have to agree on the three possible \u201cunlawful means\u201d prosecutors vaguely alleged Trump had employed to \u201cinfluence\u201d the 2016 election. <\/p>\n<p>\u201cThe jurors were told that they could split on what occurred, with four jurors accepting each of the three possible crimes in a 4-4-4 split. The court would still consider that a unanimous\u00a0verdict so long as they agree that it was in furtherance of some crime,\u201d Turley <a href=\"https:\/\/thehill.com\/opinion\/criminal-justice\/4691715-a-manhattan-canned-hunt-the-trump-jury-is-out-but-is-the-case-in-the-bag\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in the Hill before the verdict was handed down. <\/p>\n<div class=\"fdrlst__b89e9-fc455966ac01fc68a2236808e8a263f6 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-fc455966ac01fc68a2236808e8a263f6\"><\/div>\n<p>Accomplice media outlets running interference for Biden and his minions \u2014 and attempting to influence the 2024 election \u2014 <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/false-right-wing-reports-trump-trial-jury-instructions-fuel-threats-ju-rcna154678\" target=\"_blank\" rel=\"noreferrer noopener\">collectively wailed<\/a> that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/snopes-posts-bogus-pro-aoc-fact-check-ends-up-exposing-its-left-wing-bias\/\" title=\"Snopes Posts Bogus Pro-AOC \u2018Fact Check,\u2019 Ends Up Exposing Its Left-Wing Bias\">conservative news outlets<\/a> have been misrepresenting Merchan\u2019s jury instructions. But there\u2019s no denying the unusual nature of the judge\u2019s explanations at the end of a deeply legally flawed trial. <\/p>\n<p>Von Spakovsky said Merchan\u2019s instructions point to reversible error \u2014 \u201can error in trial proceedings that affects a party\u2019s rights so significantly that it is grounds for reversal if the affected party properly objected at trial,\u201d <a href=\"https:\/\/www.law.cornell.edu\/wex\/reversible_error#:~:text=A%20reversible%20error%20is%20an,Contrast%20with%20harmless%20error.\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> the Legal Information Institute. <\/p>\n<p>\u201cThis is such a mistake. \u2026 If I were the court of appeals, the moment this case came in, I would overturn the conviction,\u201d the former Federal Election Commission member and Heritage Foundation fellow told me before the verdict this week on the <a href=\"https:\/\/www.iheart.com\/podcast\/92-simon-conway-20710735\/episode\/interview-with-hans-von-spakousky-180923381\/\" target=\"_blank\" rel=\"noreferrer noopener\">Simon Conway Show<\/a>. \u201cThat is one of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dana-white-you-cant-get-monoclonal-antibodies-to-save-your-life-now-literally\/\" title=\"Dana White: You Can't Get Monoclonal Antibodies 'to Save Your Life Now, Literally'\">craziest things<\/a> I have ever heard and it is a complete violation of President Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/what-gives-them-the-right-to-do-that-cornyn-grills-jackson-on-unenumerated-rights-judicial-policy-making\/\" title=\"\u2018What Gives Them The Right To Do That?\u2019 Cornyn Grills Jackson On Unenumerated Rights, \u2018Judicial Policy-Making\u2019\">substantive due process rights<\/a>.\u201d <\/p>\n<p>Von Spakovsky said the standard in like cases is that jurors come to a unanimous agreement on each of the charges they are deliberating. He said Merchan added an absurd twist to the proceedings after handicapping Trump\u2019s defense throughout the trial. <\/p>\n<div class=\"fdrlst__b89e9-33645c8c81ddb23b461b4721f06b4990 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-33645c8c81ddb23b461b4721f06b4990\"><\/div>\n<h2 class=\"wp-block-heading\">Threw the Constitution \u2018Out the Window\u2019<\/h2>\n<p>Defense attorney Randy Zelin told CNN that Merchan\u2019s jury instructions contained a \u201ckey flaw.\u201d <\/p>\n<p>\u201cWhether you are driving in a Ford or a Ferrari, if someone gives you bad directions, you\u2019re going to end up lost. And those jury instructions were just a complete, just take the Constitution, throw it out a window, burn it, shoot it and hang it,\u201d the attorney <a href=\"https:\/\/dailycaller.com\/2024\/05\/31\/attorneys-on-cnn-rip-juan-merchan-for-throwing-constitution-out-a-window-with-bad-jury-instructions\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> on \u201cCNN Special Report.\u201d<\/p>\n<p>Turley <a href=\"https:\/\/www.foxnews.com\/politics\/legal-experts-say-trump-conviction-target-rich-environment-appeal#:~:text=%22The%20trial%20is%20a%20target,political%20mantra,%22%20he%20said.\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> Fox News that the \u201ctrial is a target rich environment for appeal,\u201d although he said the appeal will likely \u201cstretch beyond the election.\u201d<\/p>\n<p>Speaker Mike Johnson <a href=\"https:\/\/www.axios.com\/2024\/05\/31\/mike-johnson-trump-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">has called on<\/a> the U.S. Supreme Court to quickly take up the case because of its unprecedented constitutional implications.
