Experts Weigh In\">falsifying business records<\/a> in an unprecedented verdict against the presumptive Republican presidential nominee just months before the 2024 election. The verdict is likely to be appealed by Trump\u2019s legal team, however, and experts say the final decision in Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-york-judge-sets-date-for-trumps-first-criminal-trial\/\" title=\"Trump's initial criminal trial date fixed by New York judge\">hush-money trial<\/a> could come down to a ruling from the highest court in the land.<\/p>\n<p>Attorney Roger Severino, who is the vice president of Domestic Policy and the Joseph C. and Elizabeth A. Anderlik fellow at the Heritage Foundation, told \u201c<a href=\"https:\/\/www.dailywire.com\/podcasts\/morning-wire\/jury-convicts-trump-on-all-counts-5-31-24\" target=\"_blank\" rel=\"noopener\">Morning Wire<\/a>\u201d on Friday that Trump\u2019s legal team could make \u201cconstitutional arguments that his right to a fair trial was violated.\u201d<\/p>\n<p>\u201cAnd the Constitution means something,\u201d Severino added. \u201cIt means, if anything, you cannot <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/washington-gov-inslee-compares-efforts-to-ban-political-speech-he-doesnt-like-to-ukrainians-fighting-for-their-lives\/\" title=\"Washington Gov. Inslee Compares Efforts to Ban Political Speech He Doesn\u2019t Like to Ukrainians Fighting for Their Lives\">jail political opponents<\/a> because you don\u2019t like what the American people are going to vote for.\u201d<\/p>\n<p>Severino said that he believes the Supreme Court will intervene in the case if Trump doesn\u2019t win on appeal.<\/p>\n<p>\u201cUltimately, I think the Supreme Court, if he doesn\u2019t win on appeal, will take this up and reverse,\u201d the attorney said. \u201cThis is a political prosecution. The former president could face up to four years in prison.<\/p>\n<\/p>\n<p>Lawyer and political commentator Mark Levin also wrote about the possibility of the Supreme Court ruling on Trump\u2019s guilty verdict, <a href=\"https:\/\/x.com\/marklevinshow\/status\/1796284346237640941\" target=\"_blank\" rel=\"noopener\">saying<\/a> he was surprised that \u201cTV lawyers and others\u201d talking about Trump\u2019s conviction\u00a0\u201cignore a federal path to the Supreme Court.\u201d<\/p>\n<p>\u201cThe issue is how to get out of the New York system and bring the case to the Supreme Court, which may or may not take it up,\u201d Levin wrote on Thursday night. \u201cThat is why I look to Bush v Gore, where the S Ct decided to step in BECAUSE it was a presidential election.\u201d<\/p>\n<p>\u201cThere was another court involved, the Florida Supreme Court. And it was that court that the Supreme Court believed was violating the Equal Protection Clause. That was the doctrine it settled on, given the unequal treatment of voters,\u201d he added.<\/p>\n<p>Levin then laid out how the case that was prosecuted by Manhattan Democratic District Attorney Alvin Bragg and decided by 12 Manhattan jurors could go before the Supreme Court.<\/p>\n<p>\u201cIn New York, you would file the notice of appeal, ask for a stay of the trial court, and seek expedited review,\u201d he wrote. \u201cYou need to protect your ability to timely appeal and not abandon it. You might then file applications for common law writs with the US Supreme Court, where the S Ct can take action if it chooses, and legitimately claim the harm is immediate and ongoing not just to a presidential candidate, but to the federal electoral system, federal campaign jurisdiction (reverse federalism), and the precedent that might otherwise be set and spread throughout the country.
