The controversy, sparked by reports in The New York Times, highlighted tensions over \u2062pending Court matters.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>On Thursday, <a href=\"https:\/\/www.dailywire.com\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> Chief Justice <a href=\"https:\/\/www.dailywire.com\/topic\/john-roberts\" target=\"_blank\" rel=\"noopener\">John Roberts<\/a> rejected a request from Senate Democrats for a meeting to discuss flags seen flying at Justice <a href=\"https:\/\/www.dailywire.com\/topic\/samuel-alito\" target=\"_blank\" rel=\"noopener\">Samuel Alito<\/a>\u2018s homes that have drawn ethics complaints from the Left.<\/p>\n<p>Roberts conveyed his message in a <a href=\"https:\/\/s3.documentcloud.org\/documents\/24705122\/2024-05-30-cjr-letter-to-chairman-durbin-and-senator-whitehouse.pdf\" target=\"_blank\" rel=\"noopener\">brief letter<\/a> to Senate Judiciary Chairman Dick Durbin (D-IL) and Sen. Sheldon Whitehouse (D-RI), chairman of the Judiciary Subcommittee on Federal Courts,\u201d who sent a missive last week asking for an audience with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-senate-judiciary-committee-confirms-amy-coney-barrett-for-supreme-court-democrats-boycott-committee-vote\/\" title=\"BREAKING: Senate Judiciary Committee Confirms Amy Coney Barrett for Supreme Court -- Democrats Boycott Committee Vote\">chief justice<\/a>.<\/p>\n<p>\u201cI must respectfully decline your request for a meeting,\u201d Roberts said, adding later, \u201cSeparation of powers concerns and the importance of preserving judicial independence counsel against such appearances.\u201d<\/p>\n<p>He continued, \u201cMoreover, the format proposed \u2014 a meeting with leaders of only one party who have expressed an interest in matters currently pending before the Court \u2014 simply underscores that participating in such a meeting would be inadvisable.\u201d<\/p>\n<p>The controversy took flight with a pair of <a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/justice-alito-upside-down-flag.html\" target=\"_blank\" rel=\"noopener\">recent<\/a> New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/05\/22\/us\/justice-alito-flag-appeal-to-heaven.html\" target=\"_blank\" rel=\"noopener\">reports<\/a> that said an upside-down American flag and an \u201cAppeal to Heaven\u201d flag were spotted at homes owned by Roberts after similar flags were witnessed at the U.S. Capitol breach on January 6, 2021.<\/p>\n<p>Durbin and Whitehouse additionally <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/Letter%20from%20Justice%20Alito%20to%20Senators%20Durbin%20and%20Whitehouse.pdf\" target=\"_blank\" rel=\"noopener\">urged<\/a> Roberts to \u201censure\u201d Alito would recuse himself from any <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/4-ways-the-equality-act-could-damage-religious-freedom-in-america\/\" title=\"4 Ways The \u2018Equality Act\u2018 Could Damage Religious Freedom In America\">cases related<\/a> to the 2020 election or the Capitol riot, including those that relate to the question of former President Donald Trump\u2019s claims of <a href=\"https:\/\/www.dailywire.com\/news\/eric-trump-warns-of-escalating-lawfare-if-supreme-court-rules-against-immunity\" target=\"_blank\" rel=\"noopener\">immunity<\/a>.<\/p>\n<p>Alito <a href=\"https:\/\/www.dailywire.com\/news\/justice-alito-tells-democrat-senators-he-will-not-recuse-himself-from-supreme-court-cases\" target=\"_blank\" rel=\"noopener\">told<\/a> Senate Democrats on Wednesday he would not bend to their demands. He denied being involved in putting up either flag and said his wife, Martha-Ann, put them on display as she is \u201cfond of flying flags\u201d and has the same First Amendment rights as every other American.<\/p>\n<p>\u201cA reasonable person who is not motivated by political or ideological considerations or a desire to affect the outcome of Supreme Court cases would conclude that this event does not meet the applicable standard for recusal.
