against former New York State Department of Financial Services Superintendent Maria Vullo in a First Amendment case.<\/p>\n<p>The court ruled that the NRA\u2019s case against Vullo for allegedly violating the organization\u2019s rights under the First Amendment can continue, overruling a decision two years ago from the 2nd U.S. Court of Appeals.<\/p>\n<p>The suit was first filed by the NRA against Vullo in 2018, according to <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/prewrite-supreme-court-rules-nra-coercion-parkland-shooting-rcna151093\" target=\"_blank\" rel=\"noopener\">NBC News<\/a>, because Vullo had encouraged insurance companies not to work with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/study-women-make-up-nearly-half-of-new-gun-buyers\/\" title=\"Study: Women make up nearly half of new gun buyers\">gun-rights advocacy group<\/a>, claiming that being affiliated with it would damage their reputations.<\/p>\n<p>\u201c[I]n the aftermath of the 2018 school shooting in Parkland, Florida, in which 17 people were killed, Vullo urged insurance companies and banks to reconsider any relationships they had with gun rights-affiliated groups,\u201d the outlet reported.<\/p>\n<p>Vullo\u2019s legal team, however, argued that it was \u201cwell established\u201d that authorities in positions similar to Vullo\u2019s at the time could lawfully advocate for the consideration of \u201creputational risks\u201d by private companies.<\/p>\n<p>The NRA argued that that urging amounted to unlawful coercion by a government official, a position that liberal Justice <a href=\"https:\/\/www.westernjournal.com\/justice-sotomayor-reality-liberal-conservative-court-live-frustration\/\" target=\"_blank\" rel=\"noopener\">Sonia Sotomayor<\/a>, authoring the decision, said was at least \u201cplausible\u201d and should be decided by a lower court.<\/p>\n<p>Somewhat surprisingly, the <a href=\"https:\/\/www.westernjournal.com\/aclu-begrudgingly-sides-trump-federal-court-rare-move\/\" target=\"_blank\" rel=\"noopener\">American Civil Liberties Union<\/a> sided with the <a href=\"https:\/\/www.westernjournal.com\/nra-found-liable-civil-lawsuit-brought-new-york-ag-letitia-james\/\" target=\"_blank\" rel=\"noopener\">NRA<\/a>, despite its usual association with left-wing causes and organizations.<\/p>\n<p>The group said in a March <a href=\"https:\/\/www.aclu.org\/news\/free-speech\/why-is-the-aclu-representing-the-nra-before-the-us-supreme-court\" target=\"_blank\" rel=\"noopener\">statement<\/a> that it supports free speech \u201cno matter the speaker.\u201d<\/p>\n<p>\u201c[T]he reality that we have joined forces [with the NRA] \u2026 reflects the importance of the First Amendment principles at stake in this case,\u201d the ACLU wrote.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Are you a member of the NRA?<\/p>\n<\/p><\/div>\n<p>Sotomayor said that the NRA had yet to prove its claims again Vullo, but if those claims are demonstrated to be accurate, its likely that Vullo did violate the group\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/states-push-to-rein-in-big-tech-as-federal-gears-grind-slow\/\" title=\"States Push to Rein in Big Tech as Federal Gears Grind Slow\">free speech rights<\/a>.<\/p>\n<p>\u201cGovernment officials cannot attempt to coerce private parties in order to punish or suppress views that the government disfavors,\u201d she wrote. \u201cPetitioner National Rifle Association (NRA) plausibly alleges that respondent Maria Vullo did just that.<\/p>\n<p>\u201cAs superintendent of the New York Department of Financial Services, Vullo allegedly pressured regulated entities to help her stifle the NRA\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gun-owners-of-america-announces-premiere-second-amendment-convention\/\" title=\"Gun Owners of America announces a 'premiere' Second Amendment convention\">pro-gun advocacy<\/a> by threatening enforcement actions against those entities that refused to disassociate from the NRA and other gun-promotion advocacy groups.<\/p>\n<p>\u201cThose allegations, if true, state a First Amendment claim,\u201d she concluded.<\/p>\n<p>Justices <a href=\"https:\/\/www.westernjournal.com\/neil-gorsuch-keeps-massive-hunting-trophy-wall-reminder-antonin-scalia\/\" target=\"_blank\" rel=\"noopener\">Neil Gorsuch<\/a> and <a href=\"https:\/\/www.westernjournal.com\/justice-ketanji-brown-jackson-true-thoughts-first-amendment-slip-obstacle-hamstringing-government\/\" target=\"_blank\" rel=\"noopener\">Ketanji Brown Jackson<\/a> wrote concurring opinions.<\/p>\n<p>Interested readers can find the Supreme Court\u2019s full opinion <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-842_6kg7.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>Vullo is expected to argue that she is protected by the limited immunity granted public officials. SCOTUS made no decision on that subject.<\/p>\n<p>The limited immunity doctrine \u201callows public officials to evade liability if they were not on notice at the time of the alleged conduct that their actions were unconstitutional,\u201d NBC wrote.<\/p>\n<p>\u201cMs. Vullo did not violate anyone\u2019s First Amendment rights.
