If Judge Juan Merchan chooses to take the former president\u2019s advice, however, they would be sent home for good.<\/p>\n<p>In remarks to the media outside the Manhattan courtroom Wednesday, Trump said the judge overseeing the case would \u201csave his reputation\u201d by dismissing the charges, noting \u2014 not erroneously \u2014 that neither the prosecution nor judge seems to agree on what exactly \u201cthe crime is.\u201d<\/p>\n<p>\u201cThe confusion is nobody knows what the crime is because there\u2019s no crime,\u201d <a href=\"https:\/\/www.westernjournal.com\/quaid-will-vote-trump-citing-weaponization-justice-system\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> said, according to <a href=\"https:\/\/www.foxnews.com\/politics\/trump-urges-judge-merchan-save-his-reputation-dismissing-trial\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.<\/p>\n<p>\u201cNobody knows what the crime is. The [district attorney] didn\u2019t name the crime of the moment,\u201d the presumptive Republican presidential nominee said. \u201cThey don\u2019t know what the crime is. That\u2019s what the problem is. It\u2019s a disgrace. This thing ought to be ended immediately.<\/p>\n<p>\u201cThe judge ought to end it and save his reputation.\u201d<\/p>\n<blockquote data-media-max-width=\"560\">\n<p dir=\"ltr\" lang=\"en\">TRUMP: \u201cIt\u2019s a Biden witch-hunt. It\u2019s weaponization.. We already have the win. If we had a fair judge this case would have been over a long time ago.. Consider that the jury has sent the judge two separate notes, including one where the panel asked to hear Merchan\u2019s instructions again.<\/p>\n<p>While juries in New York criminal cases can\u2019t rehear judge\u2019s instructions, the request itself may be telling.<\/p>\n<p>Remember, the whole theory espoused by Manhattan District Attorney <a href=\"https:\/\/www.westernjournal.com\/alvin-braggs-team-begs-judge-pile-even-punishment-trump\/\" target=\"_blank\" rel=\"noopener\">Alvin Bragg<\/a> to charge Trump is that normally misdemeanor charges were upgraded to a felony because they were done to conceal another crime.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Is Trump being persecuted?<\/p>\n<\/p><\/div>\n<p>What crime? Well, Bragg\u2019s team implied that it was a violation of New York\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/march-for-our-lives-issue-biden-1-billion-list-of-gun-control-policy-demands\/\" title=\"March For Our Lives Issue Biden  Billion List Of Gun Control Policy Demands\">campaign finance laws<\/a>.<\/p>\n<p>However, as former federal prosecutor Andrew C. McCarthy noted at <a href=\"https:\/\/www.nationalreview.com\/corner\/the-cat-is-out-of-the-bragg\/?utm_source=recirc-desktop&#038;utm_medium=article&#038;utm_campaign=river&#038;utm_content=more-in-tag&#038;utm_term=first\" target=\"_blank\" rel=\"noopener\">National Review<\/a>, Merchan \u201callowed the state to get away with not putting the \u2018other crime\u2019 in the indictment, and rejected defense attempts to force him to provide explicit disclosure pretrial. Prosecutors hid in the tall grass until summation and are now emphatically describing Trump as having blatantly violated federal campaign law.\u201d<\/p>\n<p>Of course, Bragg has no jurisdiction over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americas-banana-republic-era-is-here-manhattan-grand-jury-votes-to-indict-trump\/\" title=\"America\u2019s Banana Republic Era Is Here: Manhattan Grand Jury Votes To Indict Trump\">federal campaign finance violations<\/a>, which means he can\u2019t <em>charge<\/em> Trump with that.<\/p>\n<p>But don\u2019t let <a href=\"https:\/\/www.westernjournal.com\/judge-merchan-issues-last-minute-jury-instruction-designed-convict-trump-even-jurors-dont-agree\/\" target=\"_blank\" rel=\"noopener\">Merchan<\/a> disabuse you of the notion that he can, considering the presiding jurist \u2014 already under fire for his perceived lack of impartiality handling the case \u2014 has instructed the jurors that they don\u2019t have to agree on which campaign finance law Trump broke to say he broke the law.<\/p>\n<p>As former Judge Jeanine Pirro pointed out on <a href=\"https:\/\/www.foxnews.com\/live-news\/may-29-trump-trial-jury-instructions\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>, Merchan essentially instructed the jury that if \u201cyou believe that any of these three things happened, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/two-trump-targets-fall-two-survive-june-28-primary-challenges\/\" title=\"Two Trump Targets Fall, Two Survive June 28 Primary Challenges\">federal campaign violation<\/a>, a tax violation or the falsification of records, and we don\u2019t really care whether you all agree on which one of these three things happened, then you can give the defendant a felony.\u201d<\/p>\n<p>\u201cThat, to me, is the most shocking part of this,\u201d <a href=\"https:\/\/www.westernjournal.com\/fox-news-announces-new-permanent-role-jeanine-pirro\/\" target=\"_blank\" rel=\"noopener\">Pirro<\/a> said. \u201cIt was almost as if he was making this up as he went along.\u201d<\/p>\n<p> <iframe loading=\"lazy\" title=\"Judge Jeanine: This is the \u2018most shocking part\u2019 of Trump\u2019s trial\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/JazmLKqXoPo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Indeed, this is unique.<\/p>\n<p>If Trump were being charged in a courtroom with violating three different campaign finance laws and the jury couldn\u2019t unanimously agree on any of them, it would be a hung jury.<\/p>\n<p>A reductio ad absurdum of these instructions could see three different 8-4 votes for acquittal \u2014 in which four different jurors voted guilty each time \u2014 into the 12 votes needed to convict Trump of a felony.<\/p>\n<p>And keep in mind \u2014 no felony, no case. The statute of limitations on the falsification of business charges that the former president faces is already up \u2014 remember, this happened during the <em>2016<\/em> election cycle \u2014 unless the state can prove that Trump committed these violations in the act of concealing another crime.<\/p>\n<p>What crime? Well, you know \u2026 you decide, at least per Merchan. We have three to choose from. See if you can all agree that he maybe might have infracted one of them. You don\u2019t even need a majority on each, just get 12 out of 36 possible votes on the three separate charges and we can call it a day, right?<\/p>\n<p>To say that Bragg and Merchan have opened Pandora\u2019s box is an understatement of epic proportions. Does none of the principals involved in this case realize that the \u201cpick a crime, any crime\u201d mentality of the prosecution and the bench here has undoubtedly caught the eye of some ambitious conservative prosecutor in some deep-red jurisdiction? Do they not also know that the current president\u2019s family has a history of shady business dealings and other issues?<\/p>\n<p>In fact, there barely needs to <em>be <\/em>an alleged crime to be a trial, judging by what\u2019s transpired in Gotham. Anyone who wants to make a name for himself or herself in 2024 America \u2014 where all politics are intensely tribal and where fame and infamy are practically alike, judging by the fawning reaction Merchan, Bragg and the porn star at the center of this mess, Stormy Daniels, have received on the left \u2014 is well aware that a shot at President Joe Biden when he leaves office is a visible platform from which to launch a national career.<\/p>\n<p>Merchan being a judge, it\u2019s unlikely that he can use this the same way Bragg and Daniels will continue to prosper off this trial. What he can do is try to stuff all the evils of this trial back into Pandora\u2019s luggage as best he can.<\/p>\n<p>That\u2019s wishful thinking, however \u2014 and it\u2019s likely the charade will continue to dominate the front pages for a few more days, at the very least.<\/p>\n<p>The lasting effects, however, will ripple throughout American political history going forward, and if you think I mean that in a good way, you\u2019re as delusional as the prosecution.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
