The court affirmed the NRA&#8217;s claims\u200d against Vullo and Cuomo&#8217;s actions. The U.S. Supreme Court&#8217;s recent ruling\u200c found that New York officials infringed on the National Rifle Association&#8217;s First Amendment rights by\u2063 pressuring\u200b regulated companies to \u2064limit \u2063NRA\u2062 advocacy. Superintendent Maria\u2063 Vullo spearheaded\u200c the effort, \u200dcompelling\u2063 insurers to cut ties \u2062with the NRA.\u2063 The court upheld the NRA&#8217;s allegations \u2063against Vullo and Cuomo&#8217;s actions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>The U.S. Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-842_6kg7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unanimously ruled<\/a> on Thursday that state officials in New York violated the National Rifle Association\u2019s First Amendment rights when they waged a coercion campaign against companies they regulated to \u201cpunish or suppress the NRA\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sotomayor-hands-nra-victory-in-supreme-court-free-speech-case\/\" title=\"Sotomayor's Ruling Benefits NRA in Supreme Court Free Speech Case\">gun-promotion advocacy<\/a>.\u201d<\/p>\n<p>New York Department of Financial Services Superintendent Maria Vullo led the charge against the NRA by opening a 2017 investigation into affinity insurance program Carry Guard. She determined Carry Guard violated New York laws, which prompted the organization\u2019s insurance broker to suspend its partnership. Encouraged by this outcome, Vullo extended \u201cher investigation into the NRA\u2019s other affinity insurance programs.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1671773207\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-475958eb68a18ab7dc61ff95ae6c70b5 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-475958eb68a18ab7dc61ff95ae6c70b5\"><\/div>\n<p>Spurred on by the Parkland, Florida, shooting in February 2018, Vullo called a meeting with insurance executives at Lloyd\u2019s. In that discussion, she <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-2nd-circuit\/1913021.html\" target=\"_blank\" rel=\"noreferrer noopener\">used her personal<\/a> \u201cviews on gun control and [her] desire to leverage [her] powers to combat the availability of firearms.\u201d She told the company that its partnership with the NRA appeared to violate \u201can array of technical regulatory infractions\u201d that could only be remedied by refusing to grant coverage to Second Amendment organizations like the NRA.<\/p>\n<p>Shortly after that in April, Vullo penned a letter to every insurance and financial entity regulated by her office deeming the \u201ctragic devastation caused by gun violence\u201d a \u201cpublic safety and health issue\u201d and not so subtly threatening \u201creputational risks\u201d \u201cmay arise\u201d for companies that work with NRA. Then-Gov. Andrew Cuomo issued a <a href=\"https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr1804191\" target=\"_blank\" rel=\"noreferrer noopener\">same-day press release<\/a> affirming Vullo\u2019s stance and demanding companies sever ties with the NRA.<\/p>\n<p>Vullo and Cuomo\u2019s combined bullying worked. In September 2018, Lloyd\u2019s <a href=\"https:\/\/www.lloyds.com\/news-and-insights\/news\/lloyds-withdraws-from-national-rifle-association-programmes\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> it would no longer insure the NRA to avoid further scrutiny and inquiry by Vullo\u2019s department. Others followed. <\/p>\n<p>\u201cDFS subsequently entered into separate consent decrees with Lockton, Chubb, and Lloyd\u2019s, in which the insurers admitted violations of New York\u2019s insurance law, agreed not to provide any NRA-endorsed insurance programs (even if lawful), and agreed to pay multimillion dollar fines,\u201d the court syllabus states. <\/p>\n<div class=\"fdrlst__b89e9-08eda710f6226f1409ede30f9776cd48 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-08eda710f6226f1409ede30f9776cd48\"><\/div>\n<p>The NRA sued both Vullo and Cuomo on the grounds that the state used its authority and power to stifle and silence the pro-Second Amendment organization\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-u-s-senate-acquits-trump-seven-republicans-vote-guilty\/\" title=\"BREAKING: U.S. Senate Acquits Trump; Seven Republicans Vote Guilty\">constitutionally protected speech<\/a> and advocacy. <\/p>\n<p>A district court originally denied Vullo\u2019s attempt to get the case dismissed. The Second Circuit reversed that decision using \u201callegations in isolation\u201d and claiming Vullo\u2019s actions amounted to \u201cexamples of permissible government speech\u201d and \u201clegitimate enforcement.\u201d<\/p>\n<p>The Supreme Court, however, ruled on Thursday that the Second Circuit failed to \u201cdraw reasonable inferences in the NRA\u2019s favor.\u201d<\/p>\n<p>\u201cNothing in this case immunizes the NRA from regulation nor <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-will-decide-if-officials-can-be-sued-for-blocking-social-media-critics\/\" title=\"Supreme Court will decide if officials can be sued for blocking social media critics\">prevents government officials<\/a> from condemning disfavored views. The takeaway is that the First Amendment prohibits government officials from wielding their power selectively to punish or suppress speech, directly or (as alleged here) through private intermediaries,\u201d the syllabus concludes.<\/p>\n<div class=\"fdrlst__b89e9-eaf7f810a018c9d94406f20131015447 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-eaf7f810a018c9d94406f20131015447\"><\/div>\n<p>In her majority opinion, Justice Sonia Sotomayor conceded that Vullo \u201cwas free to criticize the NRA and pursue the conceded violations of New York insurance law.\u201d <\/p>\n<p>\u201cShe could not wield her power, however, to threaten enforcement actions against DFS-regulated entities in order to punish or suppress the NRA\u2019s gun-promotion advocacy,\u201d Sotomayor wrote, noting that\u2019s exactly what Vullo did. <\/p>\n<p>Using the court\u2019s<em> Bantam Books, Inc. v. Sullivan<\/em> ruling, justices confirmed that a government official like Vullo \u201ccannot do indirectly what she is barred from doing directly.\u201d<\/p>\n<p>\u201cA government official cannot coerce a private party to punish or suppress disfavored speech on her behalf,\u201d Sotomayor warned. <\/p>\n<p>In his concurring opinion, Justice Neil Gorsuch warned lower courts against making the same mistakes the Second Circuit did in its now-overturned ruling. <\/p>\n<p>\u201c\u2018Ultimately, the critical\u2019 question is whether the plaintiff has \u2018plausibly allege[d] conduct that, viewed in context, could be reasonably understood to convey a threat of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/two-states-sue-biden-admin-for-pressuring-and-colluding-with-big-tech-to-censor-free-speech\/\" title=\"Two States Sue Biden Admin for \u201cPressuring and Colluding\u201d With Big Tech to Censor Free Speech\">adverse government action<\/a> in order to punish or suppress the plaintiff \u2019s speech,\u2019\u201d he wrote. <\/p>\n<div class=\"fdrlst__b89e9-cf28648f55b7b12d8a1ff875a8391944 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-cf28648f55b7b12d8a1ff875a8391944\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Thursday, the U.S. Supreme Court unanimously found that New York state officials infringed on the National Rifle Association&#8217;s First Amendment rights by pressuring regulated companies to hinder the NRA&#8217;s advocacy.
