The court filing questions the legality of federal agencies aiding in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/voter-rolls-group-gives-personal-data-to-politically-driven-organizations-report\/\" title=\"Report: Voter rolls group shares personal data with 'politically motivated' organizations\">voter registration\u200d efforts<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>President Joe Biden has no authority to order federal agencies to run a voter registration campaign assisted by leftist third-party organizations, argue members of Congress and top state elections officials filed in support of a lawsuit looking to shut down \u201cBidenbucks.\u201d <\/p>\n<p>Eleven Republican members of the U.S. House of Representatives and nine state secretaries of state have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/groups-on-google-payroll-flood-supreme-court-with-briefs-defending-google\/\" title=\"Groups on Google Payroll Flood Supreme Court With Briefs Defending Google\">submitted amicus briefs<\/a> to the U.S. Supreme Court arguing that Biden\u2019s <a href=\"https:\/\/thefederalist.com\/2024\/05\/29\/targeting-felon-votes-with-bidenbucks-democrats-court-the-criminal-caucus\/\" target=\"_blank\" rel=\"noreferrer noopener\">Executive Order 14019<\/a> is unconstitutional for many reasons.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-658625393\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-a3b1f340631cd0a4c8a25d713aa86a74 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-a3b1f340631cd0a4c8a25d713aa86a74\"><\/div>\n<p>\u201cAllowing the executive branch and its political appointees to operate a \u2018get out the vote\u2019 program on the national level and with the assistance of federal authority and funding threatens to convert the White House into a partisan political campaign headquarters,\u201d asserts the <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1162\/311758\/20240528122455525_23-1162%20Amici%20Motion%20and%20Brief%20Members%20of%20U.S.%20House%20of%20Representatives%20PDFA.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">court filing<\/a> from the House members, including seven representatives from Pennsylvania.  <\/p>\n<h2 class=\"wp-block-heading\">\u2018No Such Authority is Granted\u2019<\/h2>\n<p>The high court is considering taking up the <a href=\"https:\/\/thefederalist.com\/2024\/04\/23\/exclusive-pennsylvania-lawmakers-appeal-to-supreme-court-in-case-challenging-bidenbucks\/\" target=\"_blank\" rel=\"noreferrer noopener\">appeal<\/a> of 27 Pennsylvania state lawmakers who earlier this year filed the complaint in federal court alleging the order \u201cnullifies the votes of the individual legislators, nullifies the enactment of the Legislature, violates the Electors Clause, violates the Elections Clause, deprives the legislators of their particular rights, and jeopardizes candidates\u2019 rights to an election free from fraud and abuse.\u201d <\/p>\n<p>The amicus filings from the House members and the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/voting-machines-in-pennsylvania-county-decertified-due-to-2020-election-audit-effort\/\" title=\"Voting Machines In Pennsylvania County Decertified Due To 2020 Election Audit Effort\">top election officials<\/a> in Arkansas, Indiana, Louisiana, Mississippi, Montana, New Hampshire, Tennessee, West Virginia, and Wyoming echo those charges.<\/p>\n<p>\u201cThe President\u2019s use of executive action to convert federal agencies into get-out-the-vote operations is prohibited by the United States Constitution,\u201d the secretaries\u2019 <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1162\/311796\/20240528154947274_23-1162%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">brief<\/a> states. \u201cThe Elections Clause of the Constitution empowers the states to regulate elections subject to Congresses\u2019 pre-emption power. No such authority is granted to the executive branch.\u201d<\/p>\n<div class=\"fdrlst__b89e9-3c93e57bebd872c661099dfae4d1be3a fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-3c93e57bebd872c661099dfae4d1be3a\"><\/div>\n<p>They argue that Biden\u2019s order is a violation of Section 7 of the <a href=\"https:\/\/www.justice.gov\/crt\/national-voter-registration-act-1993-nvra\" target=\"_blank\" rel=\"noreferrer noopener\">National Voter Registration Act,<\/a> which \u201crequires that States offer voter registration opportunities at certain State and local offices, including public assistance and disability offices.\u201d<\/p>\n<p>\u201cThe states, not the executive branch of the federal government, determine what offices it shall designate as a Section 7 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soros-helps-spreadhead-anti-election-integrity-efforts-ahead-of-midterms\/\" title=\"Soros Helps Spreadhead Anti-Election Integrity Efforts Ahead of Midterms\">voter registration agency<\/a>,\u201d the court filing states.\u00a0\u201cUnder no circumstances have those state legislatures voluntarily agreed to designate a federal office as a voter registration agency.\u201d<\/p>\n<h2 class=\"wp-block-heading\">\u2018Dangerous Precedent\u2019<\/h2>\n<p>As the secretaries note, the executive order has deputized federal agencies to do what they have not been granted authority to do by Congress or the U.S. Constitution. For instance, under Biden\u2019s fiat the U.S. Department of Housing and Urban Development\u2019s Office of Field Policy and Management has \u201cconnected with local election officers and placed <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-house-republicans-demand-investigation-into-bidens-order-to-promote-voter-registration\/\" title=\"EXCLUSIVE: House Republicans Demand Investigation Into Biden\u2019s Order To \u2018Promote Voter Registration\u2019\">voter registration materials<\/a> in all ten HUD Regional offices across the country,\u201d according to the brief. The Department of Agriculture Food and Nutrition Service has \u201cissued letters to state SNAP and WIC [Women, Infants and Children] agencies to encourage the promotion of President Biden\u2019s voter registration drive.\u201d<\/p>\n<p>Critics of the federalized GOTV effort call it <a href=\"https:\/\/thefederalist.com\/2024\/04\/15\/bidenbucks-make-zuckbucks-look-like-chump-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cBidenbucks,<\/a>\u201d a nod to Zuckbucks, the hundreds of millions of dollars in private donations that Facebook founder Mark Zuckerberg dropped on local election offices during the 2020 election. Biden claims his order is all about promoting the \u201cexercise of the right to vote\u201d and eliminating \u201cdiscrimination and other barriers to voting.\u201d Such lofty-sounding goals, however, get lost in the implementation of the plan, which appears to be created to target traditionally Democrat voters with the assistance of White House-\u201capproved\u201d leftist groups. Longtime Obama-Biden adviser <a href=\"https:\/\/thefga.org\/press\/fga-condemns-bidens-unlawful-attempt-to-federalize-elections-through-executive-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">Susan Rice<\/a> was in charge of the initiative before <a href=\"https:\/\/www.nbcnews.com\/politics\/white-house\/susan-rice-step-bidens-domestic-policy-chief-rcna80654\" target=\"_blank\" rel=\"noreferrer noopener\">stepping down<\/a> last year. <\/p>\n<div class=\"fdrlst__b89e9-ce911709c49916216950bfec6211ad0b fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-ce911709c49916216950bfec6211ad0b\"><\/div>\n<p>In March, Judge Jennifer P. Wilson of the Middle District of\u00a0Pennsylvania granted the Biden administration\u2019s motions to dismiss the Pennsylvania lawsuit <a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/pennsylvania-lawmakers-to-appeal-bidenbucks-lawsuit-to-u-s-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">because<\/a> of the \u201cPlaintiffs\u2019 lack of standing to raise the claims at issue.\u201d The Keystone State legislators then appealed the case to the U.S. 3rd Circuit Court of Appeals but asked it go directly to the Supreme Court as November\u2019s presidential election looms. Attorneys for the plaintiffs are asking SCOTUS to decide the critical \u2014 and conflicting \u2014 question of whether individual lawmakers have the right to take up such constitutional issues in federal court.
