McCarthy highlighted the importance \u200dof prosecutors proving each\u2064 element\u200c of an offense beyond a reasonable\u2064 doubt. \u200cThe judge&#8217;s approach in the trial was described as unconventional\u2064 and lacking clarity.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>Legal experts expressed outrage on Wednesday over the instructions Judge Juan Merchan gave to the jury as it began deliberations in former President Donald Trump\u2019s hush money case.<\/p>\n<p>Former federal prosecutor Andy McCarthy told Fox News that the instructions were not in \u201cline with the United States Constitution\u201d and had turned into a \u201cmake-it-up-as-you-go-along\u201d situation.<\/p>\n<p>\u201cWhat\u2019s supposed to happen in a criminal trial is a prosecutor has to prove every element of an offense beyond a reasonable doubt,\u201d he explained. \u201cSo every crime, which is a creature of some statute, has different elements. One is a mental element and then there are the things that you have to do to commit the crime. So like with bank robbery you have to, you know, take money by force from a financial institution and do it intentionally. And those are the things the prosecutor has to prove beyond a reasonable doubt. What this judge is telling this jury in this kind of make-it-up-as-you-go-along New York state prosecution of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/waffle-arizona-house-speaker-claims-they-cant-enforce-constitution-wont-commit-to-calling-legislative-hearing\/\" title=\"WAFFLE: Arizona House Speaker Claims They Can\u2019t Enforce Constitution, Won\u2019t Commit To Calling Legislative Hearing\">federal law<\/a> is that when they get to the end of the rainbow and we get to the elements of the offense, the jury doesn\u2019t have to be in agreement on what it is exactly that Trump did or what he was trying to commit or conceal when he allegedly falsified his business record.\u201d<\/p>\n<p>\u201cSo they\u2019re going to give the jury a menu of choices and tell the jury that some of them may believe that this was a criminal objective, some of them may believe something else was, but that they don\u2019t have to be unanimous on that,\u201d he continued. \u201cI actually think that\u2019s pretty outrageous. But in this case, I\u2019m not sure it makes the top ten of outrageous.\u201d<\/p>\n<p>Jonathan Turley, a George Washington University Law School professor, said that the judge \u201cdelivered the coup de grace\u201d with his instructions to the jury.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1716990157394000&#038;usg=AOvVaw33qQydjIo8bet419amChif\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>\u201cHe said that there is no need to agree on what occurred,\u201d he said. \u201cThey can disagree on what the crime was among the three choices. It allows the government to allege the falsification of documents as a felony and then allows such falsification to be also the unlawful means for certain documents. So the jury finds some documents were falsified to use the unlawful means of falsifying other documents.
