href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-request-to-move-chauvin-trial-limits-evidence\/\" title=\"Judge denies request to move Chauvin trial, limits evidence\">judge presiding<\/a> over his trial gave instructions to the jury that could bode poorly for his prospects of acquittal in the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/manhattan\/\" target=\"_blank\" rel=\"noreferrer noopener\">Manhattan<\/a> hush money case.<\/p>\n<p>Judge Juan Merchan told the jury that the burden of proof is on the prosecution and not Trump, while noting that Trump not testifying in the case cannot be used as a factor for determining whether he is guilty or innocent \u201cbeyond a reasonable doubt.\u201d However, Merchan affirmed that the jury need not agree on what the other crime is that Trump allegedly sought to conceal when he <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-sheriff-on-leave-after-machine-gun-scheme-indictment\/\" title=\"Maryland sheriff on leave after machine gun scheme indictment\">allegedly falsified documents<\/a>.<\/p>\n<p>\u201cMerchan just delivered the coup de grace instruction,\u201d George Washington University law professor Jonathan Turley <a href=\"https:\/\/x.com\/JonathanTurley\/status\/1795829624502681688\" target=\"_blank\" rel=\"noopener\" title=\"said\">said<\/a> while listening to instructions from within the courtroom.<\/p>\n<p>Merchan said the jurors \u201ccan disagree on what the crime was among the three choices\u201d presented by prosecutors, Turley noted, which include violations of tax laws, falsification of other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-hunter-biden-still-owns-stake-in-chinese-equity-firm\/\" title=\"Report: Hunter Biden still owns stake in Chinese equity firm\">business records<\/a>, or violations of the Federal Election Campaign Act, known as FECA.<\/p>\n<p>\u201cThus, this means that they could split 4-4-4 and he will still treat them as unanimous,\u201d Turley added.<\/p>\n<p>Although Merchan said that the jury must be unanimous in deciding whether Trump is guilty on each count of falsification of business records, legal experts in the room suggested there does not appear to be much flexibility for a mixed verdict, or a finding that Trump was guilty or innocent of some but not all charges.<\/p>\n<p>\u201c34 guilty verdicts or 34 not guilty verdicts or a hung jury.\u00a0 I cannot foresee a verdict with some counts as guilty and others as not,\u201d former federal prosecutor Trey Gowdy said.<\/p>\n<p>Merchan told the jurors that reasonable doubt does not mean having no doubts at all, explaining that \u201cthere are very few things in this world that are known without some uncertainty.\u201d But he gave a caveat that for the jury, \u201cit is not sufficient to conclude the defendant is probably guilty.\u201d<\/p>\n<p>The judge also referenced the witnesses brought by the prosecution in the case, namely former Trump attorney Michael Cohen, who made the $130,<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-isis-bride-claims-media-covered-up-affair-with-rep-van-taylor\/\" alleged business record falsifications at issue.<\/p>\n<p>Merchan said that Cohen is legally viewed as an \u201caccomplice\u201d in Trump\u2019s case, and that they may not convict Trump solely on Cohen\u2019s testimony.<\/p>\n<p>\u201cOur law is especially concerned about the testimony of an accomplice\u2026 particularly when the accomplice has received, expects or hopes for a benefit in exchange for their testimony,\u201d Merchan said.<\/p>\n<p>In other words, even if jurors find Cohen\u2019s testimony believable, despite his history of perjury in the courtroom, they \u201cmay not
