The case was reopened by District\u200b Judge Jacqueline \u200bScott Corley for not allowing\u2064 DePape to speak,\u2064 as mandated by federal law. The attacker of Speaker Emerita Nancy Pelosi&#8217;s husband was given a second 30-year prison term due\u200d to a\u2063 judicial mistake that \u200cled to a retrial. District Judge Jacqueline Scott Corley reopened the case for failing\u2063 to\u2063 grant DePape the opportunity to speak, a requirement \u200bunder \u2064federal law.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>The man who assaulted Speaker Emerita <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/nancy-pelosi\/\" target=\"_blank\" rel=\"noopener\" title=\"Nancy Pelosi's\">Nancy Pelosi\u2019s<\/a> (D-CA) husband was once again sentenced to 30 years in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/prison\/\" target=\"_blank\" rel=\"noopener\" title=\"prison\">prison<\/a>.<\/p>\n<p>David DePape, 44, was already sentenced to 30 years on May 17, but he had to be <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/angry-mob-storms-old-folks-home-in-hunt-for-emmett-till-accuser\/\" title=\"Angry Mob Storms Old Folks Home In Hunt For Emmett Till Accuser\">retried due<\/a> to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/legal-fiction\/\" title=\"Legal Fiction\">judicial error<\/a> during his sentencing. (San Francisco Police Department via AP, File)<\/figcaption><\/figure>\n<p>District Judge Jacqueline Scott Corley had to reopen the case after realizing that she did not give DePape time to speak, as <a href=\"https:\/\/apnews.com\/article\/paul-pelosi-hammer-attack-depape-sentencing-02e423f2bb78041430d5934d7a222a8f\" target=\"_blank\" rel=\"noopener\" title=\"required\">required<\/a> by federal law.<\/p>\n<p>DePape took his time to speak on Tuesday to apologize for his actions, saying that he never meant to hurt Paul Pelosi. Nevertheless, his address, intended to mitigate his sentence, had no effect.<\/p>\n<p>David DePape was previously convicted by a jury of not only assaulting Paul Pelosi but also attempting to kidnap then-House Speaker <a href=\"http:\/\/washingtonexaminer.com\/tag\/nancy-pelosi\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nancy Pelosi<\/a>. Prosecutors <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3000549\/doj-requests-40-year-sentence-man-assaulted-paul-pelosi\/\" target=\"_blank\" rel=\"noopener\" title=\"argued\">argued<\/a> that a sentence of 40 years in prison was needed to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-requests-40-year-sentence-for-man-who-assaulted-paul-pelosi\/\" title=\"DOJ seeks 40-year term for attacker of Paul Pelosi\">assure elected officials<\/a> that they wouldn\u2019t live in fear.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cHere, it is not the public that needs protecting, but the public officials. Our public officials should not live in fear of their lives, but attacks like the defendant\u2019s breed fear and dissuade people from running for office or otherwise taking roles in the public sphere,\u201d prosecutors <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.403618\/gov.uscourts.cand.403618.234.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cAt this moment in time, this defendant continues to present as a strong risk \u2014 to the Speaker Emerita and others \u2014 because of his failure to accept responsibility.\u201d<\/p>\n<p>In a trial lasting less than a week, DePape was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2441368\/paul-pelosi-hammer-trial-david-depape-found-guilty-in-attack-on-nancy-pelosis-husband\/\" target=\"_blank\" rel=\"noreferrer noopener\">convicted<\/a> by a jury late last year of attempted kidnapping of a federal official and assault upon an immediate family member of a federal official.
