Judge\u200c Aileen Cannon rejected Smith&#8217;s gag order \u200cmotion, citing procedural errors and stressing \u2063the importance \u2062of \u2064legal \u200cprotocols and \u200cprofessionalism.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/%20\"><span>Warner Todd Huston<\/span><\/a> <\/span> <span>   May 28, 2024 at 1:03pm <\/span> <\/span>  <\/header>\n<section>\n<p>Special counsel Jack Smith was dealt another blow Tuesday in his ongoing effort to quash former President Donald Trump\u2019s freedom of speech in the face of Democratic warfare being waged against him in the courts.<\/p>\n<p>U.S. District Judge Aileen Cannon, in the Southern District of Florida, denied Smith\u2019s demand that Trump be smothered with a gag order to prevent Trump from speaking out against the Biden administration\u2019s approval for the FBI to use deadly force if necessary when it <a href=\"https:\/\/www.westernjournal.com\/breaking-mar-lago-siege-raided-occupied-according-trump-fbi-executes-surprise-search-warrant\/\" target=\"_blank\" rel=\"noopener\">raided<\/a> Trump\u2019s Mar-a-Lago Club home in Palm Beach in August of 2022.<\/p>\n<p>Smith\u2019s office filed the motion on Friday, seeking to stifle Trump from <a href=\"https:\/\/www.westernjournal.com\/just-biden-admin-authorized-deadly-use-force-mar-lago-raid\/\" target=\"_blank\" rel=\"noopener\">calling out Biden<\/a> for giving the FBI the legal cover to do what Trump called \u201cthe unthinkable.\u201d<\/p>\n<p>\u201cBIDEN\u2019S DOJ WAS AUTHORIZED TO SHOOT ME!,\u201d Trump wrote in a fundraising email, according to a New York Times report Wednesday. \u201cIt\u2019s just been revealed that Biden\u2019s DOJ was authorized to use DEADLY FORCE for their DESPICABLE raid in Mar-a-Lago. You know they\u2019re just itching to do the unthinkable \u2026 Joe Biden was <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smith-requests-gag-order-after-trump-says-fbi-agents-were-ready-to-take-me-out\/\" title=\"Jack Smith Seeks Gag Order Following Trump's Assertion of FBI Agents' Threat\">locked &#038; loaded ready<\/a> to take me out &#038; put my family in danger.\u201d<\/p>\n<p>But Cannon denied Smith\u2019s motion, adding that, \u201cthe Special Counsel\u2019s pro forma \u2018conferral\u2019 to be wholly lacking in substance and professional courtesy,\u201d <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4689299-judge-aileen-cannon-chastises-jack-smith-denies-donald-trump-gag-order-request\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a> reported.<\/p>\n<p>Both parties in the case are required to confer with each other before filing motions with the court, according to The Hill.<\/p>\n<p>Smith\u2019s team did not do so until sending an email to Trump attorneys at 5:30 p.m. on Friday, the day before a holiday weekend, The Hill reported.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">BREAKING: Judge Cannon, as expected, denies Jack Smith\u2019s proposed gag order, warns sanctions could be next if he keeps violating the rules. <a href=\"https:\/\/t.co\/T2Yxb1zvm6\">pic.twitter.com\/T2Yxb1zvm6<\/a><\/p>\n<p>\u2014 Julie Kelly \ud83c\uddfa\ud83c\uddf8 (@julie_kelly2) <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1795475409112272989?\">May 28, 2024<\/a><\/p>\n<\/blockquote>\n<div id=\"firefly-poll-container\">\n<p>Are the prosecutions of Trump politically motivated?<\/p>\n<\/p><\/div>\n<p><a href=\"https:\/\/www.westernjournal.com\/jack-smith-compares-saint-court-brief-trump\/\" target=\"_blank\" rel=\"noopener\">Smith<\/a> had demanded that Cannon rule that Trump \u201cmay not make statements that pose a significant, imminent, and foreseeable danger to law enforcement agents.\u201d<\/p>\n<p>But Cannon found the request lacked merit and violated rules to give due time and to confer with the defense team.<\/p>\n<p>Along with slapping down Smith\u2019s request on the merits, Cannon went on to scold Smith for the prosecution team\u2019s disregard of procedure.<\/p>\n<p>\u201cIt should go without saying that meaningful conferral is not a perfunctory exercise. Sufficient time needs to be afforded to permit reasonable evaluation of the requested relief by opposing counsel and to allow for adequate follow-up discussion,\u201d Cannon wrote.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/just-judge-hands-trump-massive-win-suspends-trial-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\">Cannon<\/a> also included rules to force Smith\u2019s team to confer with Trump attorneys before filing future motions, writing that, \u201cFailure to comply with these requirements may result in sanctions.\u201d<\/p>\n<p>Trump\u2019s legal team also filed a motion over the Memorial Day weekend blasting Smith\u2019s gag order demand, and calling Smith\u2019s request to quash the former president\u2019s freedom of speech was an \u201cextraordinary, unprecedented, and unconstitutional censorship application,\u201d <a href=\"https:\/\/www.cnn.com\/2024\/05\/28\/politics\/trump-gag-order-cannon-classified-documents\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a> reported.<\/p>\n<p>Trump attorneys also said that Smith \u2014 whom they called a \u201cself-appointed Thought Police\u201d \u2014 was \u201cseeking to condition President Trump\u2019s liberty on his compliance\u201d with Smith\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/black-widow-stranger-things-star-david-harbour-says-no-one-could-disagree-with-socialism\/\" title=\"Black Widow, Stranger Things Star David Harbour Says No One Could Disagree With Socialism\">personal political views<\/a>.<\/p>\n<p>This is <a href=\"https:\/\/www.westernjournal.com\/federal-judge-hits-trump-partial-gag-order-jack-smiths-request\/\" target=\"_blank\" rel=\"noopener\">not the first time<\/a> that Smith has sought to slap Trump with a <a href=\"https:\/\/www.westernjournal.com\/jack-smith-files-gag-order-trump\/\" target=\"_blank\" rel=\"noopener\">gag order<\/a>.
